    I am looking for a link which lists the documents my wife should take with her to the K3 interview. (I am sure such link exists). If not it would be great if someone could please list the docs she'll need to take..It'll serve as a great checklist... I just want to ensure shes not missing anything!

  2. That is precisely our problem. It actually has to be apostilled if done in most if not all foreign countries. This is not an option for us as it would require my wife to travel in order to get this done and it isn't worth the hassle and expense. I think I am just going to file married separate for now or request an extension and take my prepared return with me to the interview. Along with my W-2, pay stubs and employment letter, I don't think they'll blink.

    Has anyone had any success with this? Can I just send my tax extension copy along with my W2 to my wife for the interview? Or does it have to be a completed return (but not yet submitted)?

    It would be great to hear that from someone whose tried and has had success

  3. My wife got her packet 3.5 and she's about to send it back..This is what my wife is sending in packet 3.5:

    Form DS-230

    Birth Certificate (original)

    Marriage Cert (original)

    Evidence of relationship --- my recent phone bill since that hs record of our conversation in last month.. Is this okay, or do I need to send the past years phone bill??

    ---- pictures of our wedding..

    ----it asks for my old passport. Why is that requireD?

    ----anything else?

    Form I-134..<-----Question: In form i-134 it says the bank statement should contain ALL deposits made last year. My bank said they cannot do this. They'll only give me past 90 days avg balance. Is that good enough?

    I thought evidence of relationship was required in interview, not when the packet 3.5 is sent.. Can someone confirm that my wife needs to send evidence of relationship with packet 3.5?

  4. yes. I called them up and they said they had forwarded my file to Islamabad..

    Whats the next step now? Do I need to pay any fee online? I thought before the file gets transferred, I needed to pay? Or is that only for CR1?

    I guess Islamabad will send the package to my wife now in pak..will they ask her to submit the documents and then schedule the interview date, or will they just schedule the interview date and ask her to bring the docs to the interview?

  5. I am a bit confused as to what happens after we get NOA2. I see on the official website that NVC contacts the beneficiary and petitioner directly, and there is no payment of fee to NVC..

    In forums, I see people discussing and making payments to NVC.. I am wondering what the exact process is since what I am reading conflicts with what I see on US state website.

  6. Congrats!!! You should get your I-130 approval soon...check back in a couple of hours. My I-129F approval came first, and then half an hour later I got my I-130 approval.

    nothing yet..been 24hours plus.. what happens if I don't recieve the I-130 approval? Do I have to wait for that before moving on to NVC?

    I am thinking of moving, but my wifes K3 visa is in progress. Does changing the address in middle of the process change anything? Will it affect the timing negatively?

    What do I need to change the address with CSC in case I do decide to move, and whats the procedure?

    YOu file a AR 11 online within 10 days of your moving. Sponsor files a I-865 within 30 days.

    I am a USC..i thought AR 11 was for non US citizens? I haven't recieved NOA2 yet. (only noa1) do i still file I-865?

  8. An ITIN is typically obtained at the same time as tax filing. Rin and I married in October 2006 and she received her visa and came to the USA in April 2007. I filed my 2006 return in April 2007 and had to include the form for the ITIN with it (submitted a paper return and had to send to a different address). By doing so, I could file "married filing jointly" even though Rin was not present in the USA a single day of 2006 (she had no foreign income, but would have had to include it if she had).

    With regards to the SSN, Rin and the children did not get one until September 2008. I had waited to file AOS until we were relatively positive that the green cards would be after our 2nd anniversary (making them 10 yr gc's instead of 2 yrs). The only issue for us, was I delayed filing taxes this year until after they had SSNs because a SSN was necessary to get the tax rebate. Otherwise I would have filed this year with the ITIN again.

    Questions:

    Kirstein24 - When were you married? If in 2007, your husband could have filed "married filing jointly". If you had little or no foreign income this would have lowered your taxes or increased your refund. Also, you cannot be listed as a dependent. You are a spouse. Your husband's only filing options are "married filing jointly" or "married filing separately".

    Rogerbhai - Yes you can get an ITIN for a spouse even if they do not reside in the USA. I did while waiting for Rin's K3 approval.

I did while waiting for Rin's K3 approval." can you please clarify what you meant.. can I apply for my wifes ITIN now, or do I have to wait till I file taxes?

  9. hi people..i would like to ask some questions regarding ITIN. i got here in the US last July 9,2008 as a K3 Visa. we haven't started the process for AOS since its kinda expensive and really need to earn for it. my husband haven't updated his status or haven't declared me as his dependent on his tax file. should we go ahead and file an ITIN or just wait until i get an SSN? does the two have big difference? thanks! godbless!

    ITIN is only good for filing taxes and usually for opening a bank account (depending on state and/or bank). You can not use it for work, starting a credit history or for identification. (for example) :thumbs:

    We just went through this. ITIN isn't worth the paper its wrote on.

    State to state dont think makes any difference. Bank accounts

    can be opened with your passport, depends on the bank.

    My husband is going to send the I-129F package next week. He wants to know if the Copy of I-130 Transfer Notice (Procedure #3 in Assembling the I-129F Package Checklist) and a Copy of the

    NOA 1 from the I-130 (Procedure #10 in Assembling the I-129F Package Checklist) are the same? Please see procedure below (red font)*

    Or does he need to wait for the I-130 Transfer Notice?

    FYI, he just received I-797C Notice of Action from the I-130. It is indicated in the form that it is a RECEIPT NOTICE and not a TRANSFER NOTICE.

    We'll appreciate very much your reply to this inquiry.

    Once you receive the NOA1 for the I-130:

    Assembling the I-129F Package: Checklist

    Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.)

    1. Payment as required by USCIS (I-129F petitions for K-3 status filed on/after July 30th 2007 have no fee since the I-130 cost was increased). Use a check so you can track the payment.

    2. Cover Letter. Should include a description of what your are petitioning for (K-3 Visa), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

    3. Copy of I-130 Transfer Notice (indicating where your underlying I-130 petition was routed to after it was filed at the appropriate Chicago Lockbox).

    4. Form I-129F: Petition for Alien Fiance(e). This form may be used to obtain a K-3/K-4 visa for your alien spouse and her or his child. Fill out the form as directed, except assume that "fiancé" or "fiancé(e)" means "spouse." answer Questions B.17 and B.18 by stating "N/A." Note that filing this form is only necessary to facilitate the entry of your spouse and her or his child as a nonimmigrant.

    5. G-325A (all four pages) filled out by the US Citizen signed and dated

    6. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <US Citizens Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    7. G-325A (all four pages) filled out by the foreign fiance(e) signed and dated

    8. One passport-type photo (see specification) of the foreign Spouse. Write the full name of the foreign Spouse on the back. Place in a plastic bag and label the bag "Photo of <Foreign Spouses Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    9. Copy of the Birth certificate for the US Citizen (front and back) or a copy of ALL pages of the US Citizen's passport or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

    10. Copy of the NOA1 from the I-13011. A copy of your marriage certificate (If not in English then again get a translation)

    12. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

    Hi, was this ever replied to? Are items #3 and item#10 the same thing that we need to send with I-129f?

    I am about to send in my I-130 to initiate the K3 visa process. This is what I am sending as a package. Please let me know if I am missing anything:

    I-130

    copy of my naturalization certificate

    marriage certificate in urdu (native language)

    marriage certificate in english

    passport photo of me (with my name, A# at back)

    passport photo of wife (with her name at the back)

    G-325A for me

    G-325A for wife

    affidavit attesting our marriage from my parents and hers.

    copy of letter from bank saying we have an account.

    I suggest you take some time and check on just doing the CR-1. They are a MUCH better visa and at this time almost as fast as the K3.

    that takes longer...I know they are a better visa, but to my knowledge CR-1 takes about 2 years, where as K3 takes a year or less
