  1. If you can pull this off, don't separate.

    If your spouse doesn't want to "play along," you have no choice but to file, wait for the RFE, then have your attorney at the court day ask for the deportation proceedings to be put on hold until your divorce if final.

    All if this is a huge inconvenience. Therefore, it really would be great if you could avoid this.

  2. Hi Everyone,

    I'm so glad i found this forum. My husband (the conditional green card holder) and I are separating. In my state, there is a mandatory 1 year separation before a final divorce can be granted. That is the problem. I have read about the waivers, but you have to be able to produce the final divorce decree. If we separate now, we will not be able to legally divorce until July 2011. However, we need to file for removal of conditions in November of this year. So, the question is, do we separate and file jointly, wait to separate (thus delaying the inevitable), or have him file with the waiver knowing that the divorce will not be final in time to meet the requirements?

    any suggestions?

    I have a ton of questions that some of you may be able to help me with.

    long story short, my husband came here on K1 (approved March 24), 2008). We listed his daughter on the petition as "to-follow." We chose at the time to not issue her a visa, but do so at a later date.

    We are to the point now where we are ready for his daughter to join us. So the question is, is it still possible to bring her over on a K2, or is it better to persue the I-130. Futher, which one is more cost effective at this point?

  5. If it were me, i would first talk to your PhD program advisor and explain your situation. In the unfortunate case that your program advisor is also your adacemic advisor, you could speak with the dean of the school. You are surely not the only student that has run into this problem and there are likely very reasonable solutions to your current situation.

    as for switching to a master program, i think it really depents on your field of study. In many instances, you would be better of with a PhD, even from a lesser university, than a Masters from a top ranked universtiy. You are already 3 years into a 4-6 year program, so you would really only cut one year off of your current studies, and have a much lesser degree in my opinion Again, much of what I'm saying here really depends on what you are studying. If you don't think that the difference in degrees is something that will impact your current situation, I urge you to call potential employeers ans ask questions about job responsibilities and salary differences between masters and PhD.

We had out interview today and were APPROVED! it was painless. they didn't ask for any evidence or anything. the officer that had our case was training and his supervisor was there making sure he did everything right. After verifying the information on the forms and asking the mandatory questions, we were done. He had my husband sign the white paper about removing conditions in 2 years and that was it. He told me to get back to class! :dance:

    He took our AP, but not the EAD. he also didnt say how long the card would take, but i'm assuming about a month. anyone know?

  7. Hi Everyone. my nerves are starting to set in and I want to make sure we have everything we need to have a successful interview.

    We have:

    -apartment lease in both our names

    -bank account in both our names

    -cards addressed to both of us

    -utility bills (one with my name, one with my husbands name) sent to the same address

    -tons of photos from the from when we met, the wedding and everything inbetween and after

    -letter of employment and pay stubs

    -completed I-864

    -and everything else official they ask for

    do we have it? are we ready? I would love some confirmation or advice about what else we can bring.

  8. Hi everyone!

    we are preparing everything for our interview next week. It really gets me that we had an interview for our K1 visa less than a year ago, and now we have to do it again. In any case, i'm trying to think of things to show that we are a bonofied marriage. so far i have our apartment lease & joint bank account. I have utility bills for each of us...they do not have both of our names, but they have the same address. The utility companies will not let us put both names on the bill. I also have cards that have been sent to both of us, and a ton of photos. Does anyone have any other recommendations of things to bring to the interview?

  9. hello everyone. just a little update:

    we went to an infopass appointment today to check where our case was. the IO was nice enought to tell us the he passed the FBI name and finger print checks. good news. also, that at the end of october there is a note in our case file that says its ready to be scheduled for an interview. so now we just have to wait for the letter. While i'm sad we have to do an interview. i'm glad that they at least know where our case is.

    I am so frustrated here. We have not had any updates, touches, transfers, or interview letters. I figured it was because the system was not updating our case information. so, i decided to call USCIS to see if they had any other news for me. The lady that answered the phone was less than pleasant and took me for a moron. I finally said "so you are using the same database that I am to look up the case information." after a little bit of a struggle, she admitted that they very same database we use on uscis.gov to look up the case status....so it does me absolutely no good! :dance:

    i just want to have a clue about where our case is. I know people wait for years, but this is infurating. So...i asked her if the infopass people would have more info. she said they do, but wasn't sure they would be willing to share. So, i made an infopass appointment to get an update. Just remember, the last time i talked to the uscis people they confirmed that my AP was wrong and i would have to re-apply (not true..after an infopass appointment we found out it was correct after all!)

  11. Congratulations Richo and all others with good news!

    on your interview letter, did it say if there is a way to reschedule? did you get any touches, or did the letter just show up??

    I'm concerned that if we get an interview, it will be for when we plan to be out of the country traveling for the holidays. i have already booked our tickets, so i'm feeling that we will almost definately get out inteview appointment for while we are gone..... :wacko:

    does anybody have any ideas about this?

    If you haven't been transferred by now (3+ months), I don't think you will be. I think chances are very good that you will be interviewed. No need to stress out over it though. Good luck.

    Depending on how backed up your local office is, you should get an interview notice in the next month or two.

    do you think so? i don't really mind, but i just want to get this over with. we waited over a year and a half for the K1, so i was hoping that this would be quick and painless.
