  1. Hi Frnds,

This forum has been very helpful to us and great medium for us to share our experience, problems and solutions. I am opening this thread to share opinion & view for filers with priority date between April 2014 - Oct 2014. I have seen 2-3 I-130 cases for June getting approved for Vermont and many for California. Please join and share your experience if you fall within this priority dates.

I have filed my wife's thru Vermont service center in Sep 2014 and yet no updates. So would like to gather people in same boat and share experience.

My wife filed for her son in April of 2014. It went to Vermont and so far we have heard nothing. I checked processing times again and they have not moved at all. The PD is April 9,2014 so I have no idea what's going on there?

  2. Well to be honest we didn't have the police certificate translated. Only her birth and divorce certificates. From what I remember they said they will only use the police certificate at the Embassy and it didn't need to be translated. I remember I had the NVC number but don't remember using it for anything. I know the receipt number will allow you to set the interview appointment.

Another little tip, if you are setting the interview more than a month in advance you might have to wait until that month opens up on the site. We wanted ours in July and I paid for her visa in May so I had to wait until mid June to set the appointment at the Embassy.

  3. I posted a lot of questions (and received a lot of great help, advice, etc.) during this entire K-1 process and our interview is finally almost here! It's the morning of March 19 (Wednesday) in Moscow. My fiancee is currently on his way to Moscow for his medical exam (03/18) and then the interview.

I am so nervous! I can't even express how much I want it to be approved. I feel like my nerves are the worst now that the interview date is finally here, because I am so scared about something going wrong!

For those of you who completed the process, how did you deal with those last few days leading up to the interview? They're incredibly exciting, but also terrifying.. can't wait to hear a "I got approved!" from my fiancee...

    *fingers crossed*

    ~ Samantha =)

Really I wasn't that nervous to be honest and I don't know why? I guess I figured they really don't have a good reason to deny her the visa. She was nervous but since I went with her it helped. You might want to tell him to be there early if it is an 8:30am appointment. When we got to the Embassy at 7:30 there was a line 50 yards long! The interview itself was very easy and lasted about 5 minutes. She got her visa a week later in the mail.

I'm sure everything will go well for you!:) That Embassy has very good reviews and the consular that did our interview was very polite. Good Luck!:)

  4. Our case is now "ready" on the site. I need to get my invoice number and with that and the case number I can pay for the interview and the visa application. But what is this "packet 3" I keep hearing about and how will my fiancé receive it? How will they know where to send it?

There is no 'packet 3' really, just an email for you and a letter for your fiancee. They will use the information you provided for her address for her letter. If I remember right you don't need the NVC number either. I believe it took about a week to get my email and about two weeks for her to get the letter. If fact by the time she got the letter the appointment was set and the visa paid for already. I did everything for her and paid with a credit card to the Russian Standard Bank and you use that receipt number to set the interview appointment at the Embassy.

    Hope this helps? Good Luck!:)

  5. Yes, you can. Anyone fluent in both languages can place a certification on the translated document and sign it. USCIS provides a sample certification format to use. Scroll halfway down this page and see what USCIS says about translations. Nowhere is it stated you must hire a third party. http://www.uscis.gov/forms/forms-and-fees/general-tips-assembling-applications-mailing

We only had to get two documents translated into English ( birth certificate and divorce certificate) and the price of 20 dollars was well spent to get that official stamp on it from a Russian lawyer. That way there is no question about it being accurate. Her daughter did the translations but is a certified translator in her country.

In the end it's up to you what you feel comfortable doing!:) Good Luck!:)

  6. evidence for uscis dont need be translate.

And he can translate his papers if he is flenty in english.

Read the guides here, there are a lots of example letters how you can translate yourself your papers even for aos.

From page 2 of I-129f instructions: Translations: Any document submitted to USCIS with information in a foreign language must be accompanied by a

full English translation. The translator must certify that the English language translation is complete and accurate, and that he/she is competent to translate from a foreign language into English.

Maybe it's different in the Embassy they are going to but in our case they had to be translated by a certified translator and have an official stamp on it. NO the evidence does not have to be translated but a birth certificate or divorce agreement does.

  7. Hi,

Does the evidence of meeting and things like that require translations? Like for instance bus tickets, rent contracts and hotel reservations. We have a bunch of them in spanish and most of the content of a whole contract or a hotel reservation looks pretty useless to me so I was wondering if it's necessary to translate the whole things or just some parts or nothing at all? Maybe just an explanation of the paper is enough? And also, can I translate or do I need to hire a translator?

    Thanks for the answers smile.png

All documents have to be translated into English. The evidence like hotel, bus tickets and things I wouldn't worry about translating them. Always use a certified translator. In other words you can't translate them.

  8. Hi everyone,

Ok, my husband's ds-3025 sheet is not complete as he is missing the Tdap and also the date for MMR is not written. We are going to a civil surgeon, but now (March 13) is still considered flu season. The thing is I am terrified of flu shots, I am afraid he's going to get sick and also that I will get sick and I am pregnant. It's a phobia from the vaccine thinking that each time you take it you actually get it, and everyone around me has had that reaction.

My question is, should I go ahead and subscribe it to the I-693 without the flu shot thinking that when they actually get to the case the flu season will be done?

or wait for 17 days and then do it on April 1st?

Thanks and waiting for your advise

    Thanks

    Hi,

My wife's DS-3025 was incomplete as well and because she was missing 3 vaccinations. Tdap, chickenpox, and flu shot. We went to the local board of health and got the chickenpox and flu shot but couldn't get the Tdap because the time interval wasn't long enough between the Td and Tdap. We then went to a civil surgeon and had the I-693 filled out and he gave her a waiver for the Tdap. When we went to the interview they never asked for the I-693 so I guess in the end she didn't need them after all? So if you don't want the flu vaccination I would just wait a few days and then file.

  9. Our AOS interview went very quickly and we were told we would be approved. However the officer never asked to keep the requested paperwork we brought. Is this normal or could we get an RFE because he doesnt have the most recent I-864? Im hoping that this is ok as I didnt discover the mistake until we got home. Hopefully I am just worrying needlessly here but its been a long journey and we dont want to trip up just as we approach the finish line!

If the officer said you were approved then your good!:)

  10. Hello everyone, I received my letter today for my interview for my GC adjusting from K1...I'm a bit worried because it asks for

    - "A medical examination (form i 693) and vaccination supplement in a sealed envelope (unless already submitted)

I did my physical examination 07/16/2013 for my K1 visa, which was a chest x ray and a sealed envelope - however, they took it at the border and I never got it back?!

So does this mean I have to go get this form i 693 filled out by another doctor here??? I'm so confused, and my interview is in a month.

Did any of you make a complete checklist of what you brought that can share with me?

Any help I can get, I would REALLY appreciate it...

I made a copy of every form I sent them, but last week I was in Detroit volunteering to clean up the city and someone broke into my car, stole my backpack which had my laptop and binder of copies of all my forms I sent...including affidavt of support, i 485, i 765, i 131, etc...Did you bring those copies with you to the interview? Should I reprint them and fill them out as I did originally?

    Thanks everyone!

You won't need the x-rays. Yes, we did take all the forms you mentioned to the interview along with an I-693 we updated because she didn't have all the vaccinations and it was marked 'incomplete'. They didn't look at one piece of evidence, not one! We did however bring everything they asked for in the letter for our appointment just in case they did ask for them. You should be good with the medical exam because it is within one year.

Just look at everything they ask for and try to have it with you when you go to the interview. If you have had all the vaccinations I wouldn't worry about the I-693, if not then you can go to a Civil Surgeon and get the paperwork filled out after you get the vaccinations.. I would get the vaccinations at a county health clinic or a free clinic if you can. Just take the paperwork you get from them to the doctor and they will fill out the rest.

    Hope this helps? Good luck!:)

  11. Hello,

I was just curious if we will get approved at the time of the interview like we did for the K1 interview, OR if they take time to decide if it's approved or denied?

    Thanks smile.png

We had to go to the Cleveland office last week and the officer told us after the (very short) interview that he would recommend approval of our petition. Monday I got two messages on my phone that our status had changed. So I went to the site and it was in the Card/Document Production stage. Later that same day I got another message saying the status changed again. So I go to the site and now it's in the Decision stage. First it said the card would be there in 30 days now it says 60 days. They sent a hard copy out Tuesday so I'll have to wait and see what's going on here. Not sure if there's a problem or not yet but it is kind of strange that the status changed twice in a day.

  12. Incorrect. See what I said above your post. The fees for the I-765 and I-131 are waived when filed with a pending I-485. The fees are waived if you file for them together or if you file for them after you have filed the I-485. You just need to send a copy of your I-485 receipt notice when applying and the fees are still waived because you have an I-485 pending. See the info from the actual USCIS website > http://www.uscis.gov/i-485

Opps! My bad! I could have sworn I read you had to pay if you file separate... Sorry!!

  13. To make a long story short my wife's vaccination record was marked "incomplete" from her medical exam last July. So we went to get her missing 3 vaccinations ( flu, chickenpox and Tdap) The problem is she can't have the Tdap vaccination because she had the TD back in July and needs more time between the vaccinations. The civil surgeon gave her a waiver for that vaccination for one year so I'm not sure what to expect next week at the interview? She did have another vaccination in 2010 but am not sure if it was the TD or Tdap? I suppose when we travel back to Russia to get her passport renewed she can go to her doctor and find out which one she had but not sure that would count anyway? So we might have to wait a year to finish her green card, I hope not but it looks like we really have no choice?

Good news is she got her EAD and AP card this week!:)

  14. I am getting ready to file AOS forms, I have a couple of questions. If I dont have any certain dates to travel out of the US, can I still file for AP and use it at my convenience? Is it recommended to file this with the entire package, any problems with reentry, and can it be used more than once as long as its valid? Thanks G

We just got her EAD and AP the other day and it is one card (like a photo ID) and it is good for one year. If you file for these with your I-485 it is free, if you wait to file for EAD and AP later you have to pay to file them. Good Luck!

  15. Here here. I just went into our local bank today and they told me that they can't add me to my husband's account because it has "valid for work with DHS authorization only" on my SSN card. This is after another branch had checked and said they could with the documents I provided. We are going to open a bank account at Bank of America instead and they can shove it.

Yes, her card says the same thing on it. Believe me I feel your pain! Just a little frustrating at times to say the least. This checking account was with a local credit union so I will try another bank this week.

  16. Having a marriage certificate doesn’t prove a bona fide marriage, just that you are married. You need to prove that you are in a bona fide marriage, hence joint assets or liabilities.

I was able to change my name using my marriage certificate, then I was able to get state id and be added to my husbands account. I was then able to open my own account and have my own line of credit (before ead).

Your wife should be able to change her name using her marriage certificate, so she can receive an updated ssn. If not, you can provide lease agreements, car lease or insurance, utility bills, cell phone bills, medical insurance... Anything in both of your names.

Well we filed a joint tax return (of course in her maiden name because it matches her SSN). She does have a credit card on my account. She is listed as a beneficiary for insurance and 401k and she is on my health insurance and has her own card. She is also on the lease for the apartment but I would like to have that checking account as well. I will go up there this week and see what I can do. Does the BMV give state issued ID's or where would I get that?

  17. Ok, the USCIS wants joint accounts to prove you are a couple. I guess a marriage certificate signed by a judge isn't enough for them? Sooo, I go to get a joint checking account and am told that since she is not a US citizen and doesn't have a government issued ID she can't be on the account! Something about the patriot act. She has a SSN but of course it's in her maiden name because they also wouldn't take the marriage certificate unless the USCIS changed her name. They did change her last name at her biometrics appointment so I suppose I could go back to SS and get her name changed but she still doesn't have her EAD yet. We have our interview here in about two weeks, so how do I get the checking account? Could be the guy we talked to doesn't know what he's doing?
