update about my case: still in Madrid, my attorney is preparing a rebutted, I called department of state (almost everyday) told me is no notes wrote by the CO, what they have is my husband never show for the interview.
the visa specialist gave me the fax number from Madrid embassy, told me to send a letter with all my evidences and ask what is my status, also I got an email with the I-130 my brother in law filed for my husband, the case was transferred doesn't said where,this email was in June 10 and was touch in June 15. I called today to know where was transferred but because am not the petitioner I was no able to have any information, tomorrow I will call with my brother in law, this is the email

Hi Amanda, Lisa, Jackie, Kiyah and everyone who support me until now, I was so busy calling the Embassy, Lawyers, Congressman, Representatives........ I hired an Attorney Marc Ellis, he interview my husband, he is preparing the rebuttal if my case is back to USA, still in Madrid, so far one of my Senators told me I will need to wait until my case is back to USA because is not denied, my other Congressman still sending emails because he call the department of state and my case is not there still in Madrid, so again he send another email requesting another interview, we waiting for the reply .... I just keep my fingers cross, what about you Amanda, I know this month is your interview, good luck inshallah everything will be fine.

Hi Beth, thank you for you prayers, and yes all this process is getting me sick, I'm still fighting I know will take time I know won't be 2 months, 6 months maybe will be more but inshallah later this will be a dream,
my case is back to USCIS just half hour ago I got the email, I don't know exactly how long I will have to wait but thanks to kiyah i have a good lawyer who is guiding me and we're finally seeing the light at the end of the tunnel.

Just make sure you follow it up. Those guys at the embassy think they are some kind of god and they can definitely return it on assumption just to be mean. Ours was returned because I guess they didn't believe our relationship was real, it has only set us about a year plus back in starting our family but they have been put to shame. You'll be alright.
Hey, We have been returned also, April 28, 09. I spoke with USCIS and NVC, Monday, neither place has our case, or so they say. I spoke with my Senators office yesterday, they were calling today to USCIS to see where it is. My case worker at the senators office told me 2-4 weeks for the case to physically get to US. Well its been 6 for us. So we wait for the call again. This is so frustrating.

My case is back with USCIS I guess was fast because I been calling everyday and went to my Congressman and Representative, today I called the department of state and they told me my case still in Madrid and to send by fax more evidence, the visa specialist gave me the fax number she was very nice maybe because I don't stop criying and just right now I got this.

I think .MythaG- is on the right trail. I think maybe the CO asked about "previous" marriages for you and maybe your husband thought she meant how many times have you been married. The CO knows you are married now, so if the question was about the past, the answer would be once. Talk to your husband and see if he can remember the exact wording of the question. My wife has interview in June and I told her to make sure she understands the question being asked before giving an answer. Once you answer, it is too late to take it back. I agree with others that you want to stop the case from going back to U.S. If you can convince them he maybe didn't understand question, you will get 2nd interview. Best Wishes and Good Luck to you.
I also understand like that, he include our marriage, I just call Madrid Embassy, the unit about immigrant visa is open from 3 to 5pm no one can help me at this time, I will wake up at 8 am i need to convince them to have a new interview and my attorney told me to be present this time, good luck to your wife with the interview

Did he get ANY paper when he has his interview ? They are required to give him a notice if they don't issue the visa. If he didn't recieve anything it may be a wedge that your respresentive can use to get the case held at the embassy. If he was handed anything have him fax you a copy. Also have him write a transcript of what happen during the interview while his mind is still fresh. Include what was said and done even if it didn't seem art of the interview.
he did not get any paper, my husband said she ask for his passport and he gave him back and he said (my husband )did you finish with me? she said yes, and he said can I go? she said yes, that is all, tomorrow the attorney will make him write exactly what you said, what happen in the interview. am here right now waiting to call the Embassy they open 8:30 am

Keep your hopes up! I know it is very sad, because yall are man and wife. They probably will give you another interview. When a person is officially denied they will send your passport and other info. back to you. My finacee from the Phils. was denied, it was stated on her letter, they determined the intent was for immigration to the USA only. I have been there to see her 3 times. Good luck, keep your chin up, and think positively. I am planning to appeal their decision, having already contacted my Senator's senior staff. May God Bless!

What make me feel so sad is my husband telling me this: honey can you talk to the Ambassador why she make fun of me? why she keep telling me why you look to my hair do I have something? she said more than once

I am so sorry this has happened to you. I don't know any specifics of your case, but the topic pinned at the top of the MENA forum does have information that can be helpful to you.
This is however not a "hard denial" it is a visa refusal by the consulate (DOS)...the consulate is returning the file to the original approving USCIS office for review. The USCIS (DHS) will review the returned petition/application and then send you an NOIR (Notice of Intent to Revoke) or NOID (Notice of Intent to Deny) giving you a specific amount of time to rebut the consular findings.
There is a very short window in which a petitioner has a slight chance in stopping the file from being returned. It does require you to contact your senator/congressman and provide them with all necessary information on the case, and why it is so important to try and turn this around before the file is actually returned. Your government rep has a better chance of getting this reviewed by consular management before it is returned...if you know the reason(s) why they want to return the file, it may be possible for you to provide evidence to them. Not all consulates allow this, but there are a few cases I know of where the petitioner was able to get the file reviewed by consular management and a visa was actually issued without having to go through the return process. It is definitely worth trying.

I been married twice, he is my second marriage and he said twice, so I don't know what is going on, they have my divorce paper, am lost, tomorrow I have to call the Embassy to see if they can reconsider a new interview, other way the lawyer i spoke this morning told me to wait until the case is back will take 6month to 1 year
and we will have the chance to fight, so in the mean time I will go back to Spain and stay with my husband is that is the case.

I've read some here who was able to get 2nd interview and passed.
Call embassy first, confirm what happened. Maybe they lost your divorce papers... or maybe there was a typo in the system.
I called, but today is only interviews, tomorrow they will answer all the call for citizens, I paid 10 euros just to know that, of course I will requested a second interview because I am so lost, even the lawyer told me something is wrong there, but i will call tomorrow, I even want to take a plane and be there face to face

the reason they said our marriage is fake , the officer ask questions and answer herself, she ask how many times i been married my husband said 2 and he said is not true, he argument because i married twice, so i don't know what is going on, I already spoke 2 attorneys one told me to submit a reconsideration request as soon is possible and if they denied wait until the case is back and after that we have the chance to fight, I am so lost but I will keep fighting

First of all why did they say it was a fake marriage? Something must have happened or been said for them to come to that conclusion. You need to overcome this obstacle. Did they say the file was going to be sent back to USCIS?

Hi everyone, I submitted a petition for my wife I 130 in September 08, but i still have not gotten the the second notice yet. I called USCIS several times. The last time i called i was told that my case is out of the processing time. Since it was USCIS fault for delaying my case, I requested an expedite process. The next day,i received an email saying that my request for an expedite process is approved. It was on the 25th of March 09. since that date i have not heard anything from them. I decided to call again last week and i was told that my case is still pending. Iam sick and tired of this painful and bureaucratic process of the USCIS. Pls help what should I do!!!

I just stop to say hi everyone, I been in NY with my husband family and now am back in Florida just to pick up my stuff and return to NY to be ready for my trip to Jordan I will be arriving Aug. 22 just on time for Ramadan, am arriving in Delta at 7:15pm and my husband is arriving from Spain around the same time
I will see my husband after 6 months and am so happy. updates about my case: nothing new until now,
my case still in Spain and the Attorney is taking care everything we just need to wait. one more time thank you so much for the support
