  1. My wife is eligible to apply for citizenship since July 2012. However, we have not applied. Her Green card is valid till 2020. Can she continue w/ Green card and then later apply when necessary for citizenship. Is there anything that prevents her for continuing w/ GC or anything that mandates that she convert into citizen after having K1/K3 visa category. Thanks.

  2. Congrats  !! You'll get an approval notice letter and GC in a week or so and that's it!! End of the ROC process!

By the way, you are not on the list. We can add you to the list if you give us sent date, NOA date and Bio date!

    Our sent date - June 14, 2011

    NOA date - June 21, 2011

    Biometrics - July 22, 2011

    Card ordered - Aug 16, 2011

    Received - Aug 20, 2011

Today,we received a notice I-797D which gives instructions about the card and to hold the mailer in case we lose the card or we need to order a new one.

The card expires in August 2021 - which is 10 years from today. However, I thought green cards always expired in 10 years. My wife had a conditional card since 2009. Is it normal to have a green card for 2 + 10 years = 12 years?

Please let us know if we need to do anything more? Do we need to go to Social Security Office to inform them about the new card and give them a copy of the new green card? Thanks

  3. On August 16, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you.

Is this the end of this process?

After this in the post decision part - they have mentioned that they have mailed us a notice that our petition has been approved.

Are we good to go? OR will they forward it to Department of State or National Visa center any more?

    Thanks.

  4. Hello guys!!

    Need some help

Here's what it says in my wife's online status.

On June 16, 2011, we received this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

    1. Why does it say CRI89 - We filed I751

    2. We did biometrics on 7/22. There is no update in the USCIS website indicating we have completed biometrics? Is it normal. Do they usually update? How soon do they update?

    Thanks.

  5. Of course, we showed that and it also proved that we were married. In fact her SSN is in her married name and we went with the SSN. EAD is in her married name. We even went and got it changed at the SAVE system - which came after two weeks indicating all clear. Still when we went with the permanent card, they said, there was a discrepancy...It's annoying...

    \

Will this create a problem, if we leave the country and at the POE immigration w/ her permanent card?

How do we actually get it fixed in the "system," whatever system means?

    Thanks.

When leaving/entering the country it shouldn't be a problem as long as she carriages her marriage certificate.

When my wife travels outside the usa, we buy the plane ticket in her maiden name because her passport is still in her maiden name, and is also easier to go through the TSA agents that way.

When returning to the usa, at the exiting country she shows her passport that has her maiden name, along with the marriage certificate that shows her new name, and she also shows the greencard that has the married name.

Upon entering the usa, she only shows the greencard. They could ask for the passport and marriage certificate, but that has not happened.

Also, if the DMV showed her maiden name, why didn't you show the marriage certificate to prove that she changed her name?

  6. Hello all,

My current wife entered the country on a K Visa with her maiden name. After the marriage, she took my last name. Does any one else have a similar experience. We went to the DMV as soon as we got her EAD card and the DMV folks told us that the SAVE system shows a different name than what her EAD card. Turns out, it was the maiden name. We have applied for her SSN, EAD, GC all in her married name.

We then went to a DMV office abt 50 miles from where we live and filed the application for SAVE validation. A couple of weeks later we got a letter stating that there are no issues w/ the name. We wanted to wait till we get the permanent card and went to the DMV office after that...this time w/ the permanent card. This time around, the DMV folks raised the same objection...however, since we had the previous letter, they allowed us to get learners permit.

Now, has someone else faced this issue w/ SAVE and name change after marriage?

Will this create a problem, if we leave the country and at the POE immigration w/ her permanent card?

How do we actually get it fixed in the "system," whatever system means?

    Thanks.

  7. Thanks all...sorry for the delay in writing back...My wife got her GC approved and her card as well a couple of days back...Best of luck to everyone...Take care.

    Out interview experience:

On the day of the interview we carried some pictures as well as joint bank statements and credit cards. I had also added her to my medical insurance at work, so carried a copy of it. That's all. The rest of the docs we had were from K1.

When we went there, they made us go thro' security and directed us to go to the designated waiting area. We waited there for about 45 minutes, when a pleasant looking immigration officer came and greeted us. She asked us some basic questions regarding our DOBs as well as where my wife lived and the phone number. That's all...Then she said that we have been approved...and we should expect the card in 3 weeks...Got it in second week itself. Thanks.

  8. Need some help here. Yesterday went to get State ID for my wife.

The lady at the DMV office was hardly helpful...rolling her eyes etc...

She said that our name on the SSN. EAD (married name) is different from what they have in their SAVE system. They have asked us to go to some office and get that fixed as USCIS takes a long time to fix it...

What are we to do? Any ideas on anyone who has gone thro' this.

My wife had no last marriage and on the visa. Now she has taken my last name. That was the reason they gave me.

    Thanks.

  9. My wife has received an initial interview in Sept. We have still not received EAD, AP etc..We took our biometric information only last week. Is this the final interview or THE interview? Please let me know. Thanks.

Also, will she get her green card just after this? Also, let me know why I see in some cases, where ppl tell us that their case has been forwarded to California. We did not see anything like taht? Where should we see?

    Thanks.

  10. Classic -

    1) A # use the one from NOA2. Make sure that the I-94 number (it is not printed, they might have written in pencil) and NOA2 A# are one and the same.

    2) Yes, fill out supplement 7. Take an example in vj OR ***removed***.

    3) Yes fill NOA2 notice with I485 that's what we did.

    4) Submit latest W2 - 2008 and then at least tax trasncript for 2008 in I864. If you feel that you can get 2006, 2007 use that as well.

Attach employment letter as well. Bank statemetn didnt seem necessary...however, I just included that as well.

    5) For us the household size came to 2 - total me and my wife.

    6)I485, I765, I131, I864, I693a are all needed. Nptice 693a. Dont need I130 at all as u filled out I129f.

We sent to the chicago lock box address via USPS Priority...

    Take care,

    Guys:

Moksha/Dilbert - I sent separate emails to you. I am trying to get everything completed this weekend. Got some bad news on Thursday. I am being severed from my job in 30 days. Not sure the implications it will have on AOS. Trying to get everything out ASAP.

Have my medical appt to get vaccination records transferred tomorrow.

I posted my questions on the AOS forum. Wanted to post here so I can get some help from you guys. Not sure if Karri has applied yet.

    Here are my questions...

    1) Do we put the the I-94 number or the A-number on the different forms. My wife has the A number (or what looks like the A number) on the I94 card.

    2) Form 1-131, Adv Parole. Do we need to fill out Supplement, part 7 ? Is it required/necessary ?

    3) K1 Approval notice..I send a copy of the K1 approval notice not the original, right

    4) I864 questions...

Do I need to submit tax transcripts/W2s etc for the last 3 years or just most recent year, i.e. 2008?

Do I need to send an employment letter

    Bank statements ?

I am thinking of what I had to do for I134, but I864 does not specify those things.

    I-864, Ques 21, c (re: Household size). Do I put 0 or 1 ? The example form says 0.

I693 -- the parts that need to be filled out...

    Part 1 (we fill this)

Part 2, #5, the Civil surgeon fills this out.

Part 5, the Civil surgeon fills this out.

For forms, we need to send the following ?

    I485, I765, I131, I864, I693.

What about I-130 .. is that required ?

Where do you file the whole packet ?

    File at:

    USCIS

    P.O. Box 805887

    Chicago, IL 60680-4120

    For courier/express delivery:

    USCIS

    Attn: AOS

    131 South Dearborn - 3rd Floor

    Chicago, IL 60603-5520

If I am sending everything overnight/Fedex, I should send it to the Dearborn address, right ?

    Thanks for your help.
