I think the bigger risk is getting denied. Then risking a much tougher journey . For the sake of taking easier route

I didn't realize that AOS on the VWP was allowed... why do they allow this, and why doesn't everyone do it, if it is that easy? The only downside is not being able to work, right?

We had no intent on marrying but he started looking on VJ just to see what kind of options he had... and came across a post like this, saying that it was possible to do. I didn't believe him, which is why I posted myself. He has a return flight and has to work in Paris as soon as he goes back... wouldn't that be enough proof? What would be the downside of just AOS after marrying? Also... I was under the impression that if someone came over on the VWP for 90 days they had to stay out of the country for 90 days before they could come back....

Thank you so much for the info. His return flight is for June 13th. What is the average time it takes for them to recieve the AOS? What if his 90 days ran out before they recieved the AOS, would he be able to go back to the UK even though we sent in an AOS?

Hello all,
Sorry if I am writing this in the wrong place-or if this question has already been answered. Here is the situation.
My boyfriend is here visiting me on the VWP from the UK. He has a flight to return back to the UK before his 90 days are up. If we were to get married before the 90 days... can he apply for AOS and stay? If so... what steps do we have to take? Thank you so much in advance!

Are you seeking a spousal visa or a fiancee visa?
SPOUSAL VISA- WE ARE GETTING MARRIED IN OCTOBER HE WILL BE HERE ON THE VWP AND THEN GO BACK TO THE UK AND START THE I-130.
Don't worry so much about previous trips... save all that you can from the October trip and you will be fine....

OBVIOUSLY WHEN I MET MY FIANCE I DIDN'T KNOW THAT WE WOULD HAVE A DAUGHTER AND GET MARRIED. IS THERE ANYWAY TO GET A PRINTOUT OF OUR OLD PLANE TICKETS AND WHAT NOT?

Ok heres my question...
When I met my fiance I obviously didn't know that we would be getting married. We hadn't saved our plane tickets, receipts, etc. Is there a way to get information like that? How long does it take to get the info if they can get it for us.

What forms? I-130/I-129f are available from the USCIS website (VJ has links in the download section)

So how long does it take for the I 130 to be recieved? On average that is, I realize it is different for everyone.

ok... here is my situation.
My fiance and I are getting married 10/2/08. He is from the UK so he will come over to the USA on the visa waiver. After we are married he will be going back to the UK... but What form do I start off with?? PLEASE HELP ME!

Thank you everyone for your replies. If we did decide to go that route... He would not be going back to his job. I was just pointing out, that we had not intended to go this route/ or even knew it existed- as he still is employed in the UK. But we have not made any decisions, it was just a spur of the moment idea. There is a child involved in the picture, which is why we do not like the idea of being seperated.
