  1. My fiancee filed for a petition for me in June last year. We got NOA2 after 3 mos only. I went to the U.S last March 23, 2009....since some things didnt work out for us then,

    and financially too, he is not doing well, we decided I come home and wait for a better time for us to get married. I came home to the Philippines 2 days ago.. we both miss each other now and want to re apply for a K1 visa again sometime this year.. We have wasted money and made mistakes but are willing to try to work things out again..

    Can anyone help us please and give us information as to what we are going to do as far as a re-application is concerned.... What do we need to do and submit to USCIS? Thank you so much. Any idea shared from anyone will be greatly appreciated..

    IMBRA places two new restrictions on multiple K1 visas in cases where the petitioner has:

    Filed two or more K-1 visa petitions at any time in the past, or

    Previously had a K-1 visa petition approved within two years prior to the filing of the current petition.

    A waiver may be obtained, however. Factors the USCIS will consider in evaluating the waiver application include, but are not limited to:

    Whether unusual circumstances exist (e.g. death or incapacity of prior beneficiary(ies));

    Whether the petitioner appears to have a history of domestic violence;

    Whether it appears the petitioner has a pattern of filing multiple petitions for different beneficiaries at the same time, of filing and withdrawing petitions, or obtaining approvals of petitions every few years.

    So, your petitioner will need to apply for a waiver to bring you back with another K-1 with the info you provided.

My fiance called embassy yesterday and was told that a consul officer has my additional documents already..he was told nung nakasagot sa kanya to be patient coz it normally takes 2months for review process to be done and to wait longer for a few more weeks pa..hahay..tedjen, pray without ceasing..yun na lng magawa natin sa ngayon..

    Paki include po ng pangalan ko sa list ng naghihintay ng visa at under review pa yung case sa USEM.

    My interview date was NOv.19, 2008...yung additional requirement ko was submitted Dec 3, 2008 via DHL..

    Until now, still waiting pa rin for my visa..

  5. Me too, I find it strange that its a no no to mention kids and work during interview. You are applying for fiancee visa for heaven's sake. Don't you talk about future plans like having kids and money matters before getting married??? I dont believe the consul doesnt want to hear your fiancee wants to work. The consul wants to hear from your fiancee that worse comes to worst, your fiancee will help you with financial matters and not just sit and watch you kill yourself by working for the family or be a public burden. That's all. Just give what they want.

    By the way, I put yes on the question if I intend to work on DS156.

  6. I'm surprised they'd count an un-concieved child, I wonder if that's more a misunderstanding of some sort or an actual policy.

    The bit about not mentioning an intention to work seems strange, it sounds like great advice for someone getting a visitors visa where there is no legal option to work, but for a k-1 visa... that's the start of a life together, and most people will work, I'd be more suspicious if someone planned to come to the US and expected not to work! I guess the real question is how it's asked though, the most immediate thing is of course to get married, but obviously someone will eventually get around to seeing at least some of america and wanting to be able to work sooner or later.

    The problem with this, I assume, is the fact that beneficiaries seem to be treated like catttle, or just some piece of furniture the USC wants to import. Of course most of us will work, and most of us actually have been doing that all this time (wherever we are from), but it's apparently assumed that once we get into the US, we'll become leeches and any and all our knowledge and experience will get somehow erased. =/

    You are right. I guess her fiance was asked if she's willing to work to help out and assist their income, after they get married or once she gets a permit, onlypeople with tourist visas are not allowed to work.

  7. Manila Usem does not accept co-sponsors for K1 visas. Your fiance should state in her letter that she is willing to work to be able to help out with your finances ONCE PERMITTED to do so, like once she gets her greencard or after she gets a work permit. She should not forget to say that her main reason to go to the U.S is to be with and marry you.

  8. I was also asked to submit a sustained income. until now, I still didnt get my visa. It will be 3weeks on wednesday since I submitted the required document. I suppose your fiance was interviewed by consular officers at window 30? they're crazy..

    hello Pinkria, wag kang mawalan ng pag asa....god will find a way...I'm so touch in your situation naiyak tuloy ako.even we didnt filed yet i know now how difficult it is....maybe those person who review your document not in the mood thats why he/she ask for more....

  11. We're on the same boat, I had my interview on November 21. I got pink slip and white paper indicating the document to be submitted (NBI clearance with a.k.a).. I submitted the doc on November 24 and am hoping and praying to get my visa in less than 2 weeks...

  12. does he have assett's ? a house with equity, more than one vehicle, maybe his mom has jewlery they can have appraised and use for assett's, etc. good luck !!

    they did not ask for assets or bank statements..they were asking for an evidence or proof of sustained yearly income....I am hoping that what I am to submit to them this week is enough to show that he can make more than the required income per year...thanks...

  13. My fiance's mother volunteered to become a co-sponsor, but the consul did not accept it. :-(

    She said, unfortunately, for this type of visa that we're applying for which is K1, they do not accept co-sponsors.

    However, I think my fiance can reach or even exceed that amount a li'l bit if we include his projected income(of 5mos.) which is from jan-april2008 & Dec 2008.

  14. Hello Everyone!

    I had my interview last Wed, Nov 19. (K1) The consul officer said everything looks good except for my fiance's income. They looked at his 2005-07 tax transcript(all under poverty level too) and his 3 recent paystubs.

    I was asked to send or submit a sustained income of not less than $17,000/yr along with my passport.

    I was given a pink slip and asked to pay at Delbros booth P250.00

    I am worried because my fiance doesnt have a fixed income. He is working for a car dealership company since April 2008 and is paid on a commission basis.

    I am still waiting for my fiance to send me his paper. He is looking for a new job too and has a job interview tomorrow.

    will it help if I also send along his bank statement? He doesnt have a big amount of money in his account but maybe it can help? Is there a deadline as to when I should send to the embassy the required document?
