  1. Hang in there everyone....All of you will get there.

    My up date is:

    Went back in Sept. to see Ling and the boys.

    Hot and Humid....Guangzhou and Nanning

    While there, Ling received her P-3, I was amazed because it usually

    takes about 3 months.

    From NVC to Guangzhou to P-3 ,it was only Three weeks.... :dance:

    Filled out the P-3 while I was there and sent it back on Sept. 18.

    As of to day, The tracking EMS label says they have sent the P-4.

    I will be going back to China for Ling's interview, although I can not

    attend her interview....I can help her with medicals and all that.

    So, all of you will get your chance and best wishes to all of you for

    getting your Visa.

    I have been flying to China so much, that NorthWest airlines up graded me to elite status, go figure... :blink:

    In answer to your question: I don't want to get into what they suspect, the people on the other

    forum can give you their suspicions, but as far as getting married before the I-129F is concluded

  3. Hi Binh,

    K1 is only if you are not married, so you can not get married while filing the K1.

    K3 is only if you are married (there is also CR1, but for K3 you are married and you

    file an I-130 and when the I-130 is received (NOA1) than you file I-129F ,and than

    wait.............. :blink:

    Hi All,

    I want to find out from everyone, on what should be the best option for me.

    I am a US Citizen and engaged to my fiance a Canadian citizen and we would like to sign the married pretty soon in Canada.

    What I want to find out is, which method of application should I be file under? K1 or K3. If i am going with K1 application and can I sign the married license before the K1 application finished?

    or should I go with K3 application but assuming K3 I have to provide the married certificate.

  4. Most expedite cases are done for I-129 petitions for workers......as far as getting an expedite for and I-130 and/or I-129f

    it is highly unlikely except for Health reasons or maybe Humanitarian situation.

    the criteria for expedite are

    * Severe financial loss to company or individual

    * Extreme emergent situation

    * Humanitarian situation

    * Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

    * Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

    * USCIS error

    * Compelling interest of USCIS

    I think you will find that if the interview is after the date of expiring that the Consulate has the authority to

    extend the date.

    MY I129F APPROVAL NOTICE SAYS VALID UNTIL 12/08 , WHY DO THEY PUT A TIMEFRAME ON THEM.SO THIS MEANS THAT HE HAS TO HAVE AN INTERVIEW BY DECEMBER I'M ASSUMING.

    All I can tell you is when I called the USCIS at Vermont, the specialist told me that the two

    petitions were in the same file.

    As far as priority date I could not tell you, but it might make sense that they would use the

    priority date of the I-130....but who knows...this is the Federal Government we are talking

    about..... :whistle::innocent:

    I've read many scattered thoughts that once the I129F (k3) petition is recieved

    referencing the I-130... that they are "paired". if so, in what way, is it paired

    "virtually" in their systems/database and they notice once they process. Or is it

    physically paired. If it's physically paired, which NOA1 date do they use to process

    the K3... if they use the K3 noa1 date then they are breaking the law and setting your

    I-130 back however long it took you to send the K3. If vice versa then they are scooting

    your K3 up to the "front of the line" of other I130's to be processed.

    From the recent approvals, it looks like the K3 is processed with the I130's NOA1 date.

    Can anyone confirm or explain exactly what happens.

    Maybe they felt sorry for me and thought I would die before I would be re-united with my wife and boys...... :devil::rofl:

    They approved both petitions ,,,so if you would not mind would you put BOTH in the approved slot???

    Just curious...will I get any e-mails from NCV or will I have to call them

    to find out when they get the approved petitions???

    I know I will have to call them for the GUZ..... number for the I-129F ,but

    will they notify when they arrive??

    by The Vermont Service Center, and in a few days probably they will be on their way

    to the NVC. :whistle::devil::thumbs:

    After the NVC, it will be about 4 months for Guangzhou to schedule an interview, but

    at least I am out of USCIS.....Now I will have to deal with US Embassy in Guangzhou... :innocent:

    But at least Vermont service center seems to be moving. :thumbs:

    All petitioners filing stand-alone Form I-130 must submit their petitions to the Chicago Lockbox instead of a USCIS Service Center. Form I-130 petitions filed with the Chicago Lockbox will be routed to, and adjudicated at, the appropriate USCIS Service Center. This routing will be based on the petitioner’s place of residence in the United States.

    Important: Any Form I-130 filed at an incorrect location will be rejected.

    Petitioners who reside in AL, AR, CT, DL, FL, GA, KY, LA, ME, MD, MA, NH, NJ, NM, NY, NC, OK, PA, Puerto Rico, RI, SC, TN, TX, VT, VA, U.S. Virgin Islands, WV, or District of Columbia must file their stand-alone Form I-130 with the Lockbox using the following address:

    Just follow what is stated in the instructions of the form. USCIS will forward your application to the concerned service center anyway. Don't confuse the flow.

    I just recieved the NOA1 for I130 and the address is in CSC in the notice but has different PO box than the one given in application. I am wondering if I should use the one in NOA1 and if I want to send it by courier does anyone know where can i find the information on that. Thanks

    Hopefully someone here can answer my question. I am mailing the I-130 application out on monday and I want to double check and make sure about the application address. If I am mailing it express service through the US postal service, do I use the courier service address, or the lockbox address for my state? I am pretty sure the answer is the courier address, but I just want to make sure. Thanks and good luck to all!
