  1. Well everyone....I'm a wimp. I spoke with 4 diferent people at USCIS about our RFE. I got a diferent story from each person. The last person told me that they have Margarita's paperwork but nothing for Daniela. He thinks it got lost when it was transfered from Missouri to California. I'm too scared to standup for what's fair and right. I'd rather pay the extra $145 for another exam and play it safe. We went for Daniela's exam Wednesday, and I can pickup the paperwork on Monday. I just don't want to take any chances.

    Damn John, sometimes i do wonder what the people at immigration are thinking. Why should you be the one to pay for their mistakes for losing the documents? That's similar to when they took the fingerprints for my wife, we had to go after a month because they said the prints were not taken accurately. But hopefully everything works out for you.

    I'm also informing that my wife received her green card on Friday. Surprisingly, we never got an e-mail saying card production ordered or anything like that like we did in the past for the EAD. I guess since she had gotten the passport stamped, they assumed we already knew that the card was coming. Well this makes us USCIS free for a year and 9 months. Thanks for everything guys.

    I need some help with my wife's adjustment of status for the residency. She has all her vaccinations (she submitted them with the K-1 Visa application), but I saw on this website that she will need to submit an I-693A supplementary form that is basically a transcription of her vaccination record from a "civil surgeon." Is this information correct? I have a hard time understanding why should would need to submit her vaccination information again if we already submitted it.     Yes Ben, she does need to submit the I693A supplementary even though she already had a medical overseas. You have to find a civil surgeon in your area who could put all the information on the form and sign it so that you can submit it to USCIS. In our case, she needed to get a couple of new vaccinations, including the 2nd papilloma virus shot, which was not required but is very important for women. So yeah that cost us 150 with the paperwork being filled out and the administration of some vaccines she needed.

  3. Ok guys so i am officially reporting back,

    The interview went really well, the guy was nice and spoke slowly for my wife. The only questions he asked her were the yes or no questions in the I-485 and one about her name, about why her name has an H in Nhora instead of being Nora lol. Other than that he asked for 2008 taxes for the sponsor and ours, which was a joint return. He told us that it could be approved the same day if we were willing to wait. So of course we waited and after about 30 minutes, her name was called and she got her passport stamped with the I-7551 and we were told that she would receive the 2 year passport in the mail in about a month. So YESSS!! I am so glad this part is over. Thanks for all the help, and OskaryAndrea i really hope you guys get the card quickly and that email confirming everything went well. Once again, thank you guys for all the help. See you around since we will be USCIS free until January of 2011.

  4. Ok guys,

    So the interview is tomorrow. At this stage we are just going over questions they might ask, making photocopies, printing pictures. As far as translator, it is ridiculous how much they charge for something like going to the uscis office, so we are just going to go by ourselves, and demonstrate what my wife has learned in English. She understands a lot and i hope the nervousness doesn't get a hold of her. We just hope that this is over with some good news tomorrow. We will be keeping everyone posted. Any last minute tips appreciated. Thanks

    So as far as the interview is concerned.. I was under the impression that I was going to be able to translate for my wife, but then again that would be biased because if I am the petitioner I could just say something else right>? So with this in mind, do you guys think that we need to bring a translator for the interview? this would be a real hassle since because of the time frame and cost. You guys think we could bring someone else that is not a certified translator or if my wife's english is good enough, should she try to answer the questions themselves, and that would also show she is learning by going to school? HELP IS GREATLY APPRECIATED.

    Congratulations Juan Carlos on getting past that stage in the whole process, and we aim to successfully join you soon.

    So we are getting ready mentally and physically for the interview next Wednesday the 22nd. What do you guys think is good evidence to show to the interviewer? I heard that if we are going to bring pictures, they should be since my wife arrived here to the US, is this true? I mean we have albums that we prepared for the interview at the embassy last time and it wouldn't hurt to use them right? I mean the embassy didn't even ask for them.

    So far we have been collecting everything else they ask for and as far as evidence showing that we have things together we have a joint bank account and a joint tax return for this year. Thanks ahead for the tips guys.

  8. That was my exact reaction to when i saw the letter. But it looks like the people who sent the AOS packets around late 2008, early 2009 are getting interviews really really quick. Now i gotta start preparing all those papers that they tell us to bring in the letter.

    The school stuff is going, still waiting to see what my financial aid packages will look like since i just recently submitted all the paperwork.

    I am in incredible disbelief right now... We just got an I-797C notice of action telling us to appear for an initial interview on Wednesday April 22, 2009!!. My main concern is the wording of the letter, could this be the letter to get the AOS approved? so soon!? If so that would be awesome. We received an email on March 10th, saying that the EA card production was ordered and it has not arrived yet. We applied early because we would think that it would take even longer and we might get the 10 year green card if the AOS was approved after August 18, the date of our 2nd year anniversary. Instead we get this lightning fast interview date. The letter says:

    You are hereby notified to appear for the interview appointment as scheduled below, for the completion of your Application to Register Permanent Residence or Adjust Status (Form-I485) and any supporting applications or petitions. and on the top it says REQUEST FOR APPLICANT TO APPEAR FOR INITIAL INTERVIEW.

    If anyone can please confirm that this is indeed the AOS regular interview I would greatly appreciate it.

    P.D. I guess the FBI finally processed the fingerprints after a second try.

  10. Yeah i've done that and you would be surprised. NYU med doesnt even offer incoming married students any housing (!!??) and as far as the people in charge yeah I've spoken to the head of the financial aid department and that's basically what they have told me. Messed up thing is that I do the hardest thing, which is actually getting into a top med school, just to find out that the housing is not even guaranteed for married students.

  11. Charles, so my wife is eligible for a SSN as of now? We are waiting to get the EAD which will come in around mid april. I was under the notion that we needed the EAD to get the SSN since the K3 is a little different to the K1 in that regard. As far as speaking to the people in the IRS and Social Security, you are definitely right, they do not know much and I have yet to speak to the one that does lol. The only thing is that like you, we need the refund as well as the taxes filed ASAP because the financial aid packages and housing and all that stuff for medical students is basically first come first serve so have to be done with that quickly. Thanks a lot for the information.

    So i am having some trouble when trying to do my taxes. The IRS people are telling me that since my wife is eligible to get a SSN, then she cannot get an ITIN or anything like that. They are telling me to wait until i get the SSN for her and then file. The thing is i cannot do that because i need to file ASAP for medical school financial aid package and all that. DO you guys know how long it takes to get the SSN? or do you guys know from previous experience if she can file this year with an ITIN and then the year after with her SSN? My wife is on the K3 visa and all that. The first time that they took the fingerprints (Feb3) they told her that the EAD would come in 2 months. But by that time it would be too late to do my taxes to send to the med school. What do you guys think or know about this whole mess?

    What i was thinking was that she can get the ITIN number for this year and then the next year she could file with me with her social.

    well we had the first biometrics appointment on February 3rd, and then got a notice in the mail a week later, the 11th saying that we had to go back to get the biometrics taken again because the FBI was unable to process the fingerprint card. So we went March 4th and are hoping that everything goes well. I just don't understand what's so hard about taking some fingerprints and making sure they do it correctly!!??

    So i got the NOAs on the I485, 765 and the appointment for biometrics on feb 2 2009. The messed up thing is that i told them just how i had done on a previous application to send the mail to a PO BOX, because we might be moving soon. Sure enough, they sent it to the regular home address. Thank God we were still here and got the paperwork. Do you guys know if the change of address by calling them on the customer service line is good enough? Does it take long for them to send correspondence to the new address? It's pretty weird because last time i told them they did send mail to the PO BOX but this time i guess they didn't feel like reading my important notes blah. One last question, the case status online page it says that the application is at the National Benefits Center right now, and i tried checking for processing times but it only gives the processing times for the EAD. Do you guys know where the actual I485 will be processed? Does it get sent to a Service Center or local office? I'm pretty confused about that because on the notice it said something like if you want to check processing times at your local office do it online or something like that. Thanks for the help guys.

  15. Well on the form says that the previous year's taxes are required and that the previous three years are optional. As for myself, I only have taxes from the last two years and my sister (co-sponsor) does not have a copy of her 3rd year. So i was wondering if it was wise to just send last year's taxes for both of us, since neither of us have the full 3 years (as mentioned we only have two). OR do you guy think it's better to send those two years? Thanks for the help.

    I am going to be sending the AOS packet either tomorrow or monday. I wanted to know if i need to send like a joint bank account proof or anything of that sort with the packet. So far i got everything listed on the step by step guide and will be sending a personal check. Also, I am sending only last year's taxes for the co-sponsor and a letter from her current employer (even tho it says its optional). Do you guys think i need to send anything else in? thanks.

  17. Hey guys we just spent our first thanksgiving together and it was great! I got a quick question, when i file for the AOS i file to the chicago lockbox and then it gets sent to the local office right? Well is this local office necessarily the office closest to home or can the case be sent to another office which is not so far behind in the processing times? I am really concerned because the new york city office is behind a year and 2 months so i would really hate it if my case gets sent there. Thanks
