  1. Good luck, n00b. Some attitude adjustment may be needed, such as recognizing that your crimes were serious and that you can't play the role of victim here. Sooner or later in this process, your attitude (repentant or not) will come into play and be a factor in the immigration/AOS process.

    Im not on trial here, it was not that serious then, and isn't now. Do you want me to type " im such a terrible person have mercy" sorry I can't , i don't feel im a terrible person and sadly the state doesn't allow you to use not knowing the age as a defense (nice huh!) The point of this thread was to have others follow it, i posted what happened because most of the walsh cases you never see the person post what actually happened. And yes, it does make a difference

    Someone who actually raped a person is going to have a tougher time than those that had consensual sex, i know its tough for you guys to see a difference, but their is a difference. Thats why they have different degrees and different classifications and names.

    I posted this in hopes of helping others to start with, but, im just going to remove myself from this forum . Most posts i read regardless of what it is about, its always someone starting problems and not offering much help anyways, I see no reason to willingly help you guys with the details of my case

For all you negative ones out there, yeah you guys are right I should not post about immigration topics in the forum so im gone, #### this forum its just full of old #### men who couldn't get laid in the us and went over seas to get a 20 something year old that probably had no choice but to be with you because of the country they lived in

    When I was about 19 I had consensual sex with my girlfriend of 6 months, unaware that she was underage. She lives in Florida and I live in Alabama. Being that we had sex in both states I was charged as a sex offender in both states (Alabama its RAPE II consensual sex with a minor, in Florida its Lewd and lascivious acts with someone under 16) I served no jail time, 3 months adult bootcamp, 3 years probation 5 year suspended sentence.

    I completed probation, and all the hoops that came with it.

    Now I'm 27 almost 28 years old, I married my wife in the philippines (we are the same age) and she has no kids.

    I have decided to go with an immigration lawyer whom I have confided in over the past year or so. , Please no negative comments, thanks, and wish me luck, as i wish all of you luck

    If you did not know your "girl-friend of 6 months" age, that is one thing. But, today to imply a minor could consent to sexual activities is unacceptable and you should try to rephrase this part in your application. It shows little regret if you suggest that the ignorance of age was the cause for your two serious convinctions.

    IN THE STATE I LIVE IN CONSENSUAL SEX WITH A MINOR IS CALLED RAPE II , I didn't label it consensual sex with a minor my state did, if you dont like how they describe it you might want to contact my state rep and explain to them that you have a problem with how my state names laws

    I refuse to let this thread be a discussion about what is right or wrong or your opinions , this about immigration and my case if you dont like it, dont follow it, dont post here.

  5. Update on our case,

    Our NOID evidence was received by USCIS on April 3, 2009. We sent in polygraph results letters from our pastor and my wife of her knowledge of my past conviction from 12 years ago. I also sent in evidence i do not register as a predatory offender or any risk to the community.

    I have also prepared an organized letter about what happened pertained to my past conviction and the remorse I have had about my past with this conviction. I also sent in old treatment files and my updated Polygraph test pertaining there has been no other victims since completing my probation. This test came out very strong and on high scores of no deception indicated on the results.

    all my letters from pastors, my wife and the Polygraph results were all letter headed attention to USCIS and Homeland security. The documents were made out to look as if they were prepared for them. this was what was advised to my by legal council.

    Now we wait to see what the ending result may be. ADAM WALSH filers’ take a deep breath and wait for the results on my case. If there is anyone that can pass this new LAW it would be a example as a person like my case. I have full court order of my two boys, if this is not enough for them just seeing that nothing is. But I do feel strongly this will be enough with everything I sent. Keep us in your prayers and have faith. As for Treatment evidence this is helpful of course. But really the result is do you pose a risk to your wife? No test or sex offender treatment provider is going to say you do not pose a risk, because they do not really know if you do. All you can do is prove you have no violent past or any violence involved in your convictions.

    Do you mind telling me what you were charged with 12 years ago? And if you no longer have to register can't you get the case closed? I'm just curious im in the same situation. I had consensual sex with an under age girl (unknowingly) I fall just outside of the romeo and juliette law (which we dont have where i live)

    My issue is my wife and I are both adults, and have no children, I dont see how i can prove i'm not a threat, i don't see how they would even consider me a threat, to whom? We are both adults with no kids

  6. A bit of a personal question if you dont mind me asking , im in the same boat. What was the original charge that fell under the adam walsh act>? it seems as if you are really making progress and it gives me hope that I might be able to as well.

  7. Its because of the possibility of this law (and im sure our over zealous justice system would love to pass it!) that i suggest everyone that needs to travel do it now. Soon the usa will trap you in your own Country.

    After all, if the usa calls the country you are going to and says bad things about you, Do you think they will ask what the charge is and compare it to their laws? Nope, they will just take it at face value and deny you

    So the usa wants sex offenders to stay on your street, your neighborhood , by keeping them locked into living in the usa.

  8. The issue for me is, I have no job, and of course, the economy is terrible in the usa. My wife in the philippines has a good job, owns her own house and land. She has no desire to stay here (neither do I but nothing i can do about it for now)

    One of her co workers recently got a tourist visa approved (first try) but she isn't married to an american.

  9. Hello everyone, and Hi n00b. I am in the same boat as you. My wife lives in the Philippines also, and we were a little hesitant in starting the whole K3 process until I finished in Iraq. We tried for a B2 tourist visa and it was denied. I will tell you what was told to me since. Dont even waste your time with a tourist visa for your wife. When ours was denied, i called everyone from the consolate in Manila, to the state dept. visa dept, to my congressman. Everyone said that B2 visas are not issued to spouses because there is too much temptation to overstay the visa. I know, It's not fair, and we should all be held to our rational and best intentions, but it just wont happen. I even talked to the customs border officers at the airport when I returned from my last trip. They stated that B2 tourist visas are NOT issued to spouses, and if they find one that slipped through the cracks of the system, they are required to deny entry and deport.

    I know it's not fair, but save yourself the time, four months for us, and just start the K3 process. Sorry to burst the bubble, but this is what I have found out.

  10. So my wife lives in the philippines and I live in the usa. We thought about doing the papers for a k3 , but have yet to decide where we want to live.

    Is it possible that she could just get a tourist visa and come to the usa for a while and then return to the philippines? She has a good job there , but would like to visit me here.

    Some of her friends have got tourist visas from there to come to the usa, so i know its possible.

    But, will being married to me, an american have any effect on that?

  11. So I came back to the usa, soon i will go with the lawyer and file the papers and see what happens. They claim they would not take my case if they think I did not have a chance.

    So i will post more here as time goes on, I do not intend to put up with the usa for very long. If it drags out more than a year, i will just leave, and start my live overseas, at least i could live in peace with normal people and normal laws

  12. What all is checked? will bad credit hurt me? Im in the process of going through a bankrupacy, but i believe filing with my co sponser should meet the 125% requirement.

    Will they see my debts? what do they go by? I have no assets in my name, luckly, which might help/harm me.

  13. I need some advice on what i should do. I will explain my case, pleas refrain from all the negative comments. When i was a teen i had sex with my girlfriend i guess i was 19? and she was 15 (which i did not know at the time) but its all water under the bridge now , as you could say. And i am a "sex offender" for Consensual sex with a minor (in the usa)

    Moving forward i am now 27 yrs old, (and so is my new wife) i fell in love with a filipina some years ago , this is my 2nd trip to the philippines. We both got married , reading online it seems almost impossible that i will be able to get her to the usa

    Ive spoke with a lawyer who claims he can get a waiver for the adam walsh act, and he has had success with a case similar to mine (although i see no information to back this up) And his fees are quite high, it could be a scam, or them knowing it will never go through but giving me hope so i will give them money.

    On to other things, while in the philippines i filed for a visa extension, i actually got a BI clearence , saying i have no known problems or on any blacklists , plus what happened to me in the usa, is not a crime here (or anywhere mostly)

    If i dont go back to the usa, they say that i am "failing to register as a sex offender" im sure they will put out some type of warrant on me (just to make my life a living hell ) On top of that, the usa is fairly nuts, they might would even waste your tax dollars to come get me and return me:? lets hope not , but they are known to do that

    My wife might be pregnant , i dont want to return to the usa if i have no hope of getting her there. Id like to stay here legally but not even sure how i can do that, plus i have no job or income here

    Once again i ask to please refrain from the negative comments, ive really heard enough of it , i only wish to have a normal life with my soon to be wife and child .

  14. I dont think you guys are reading correctly, i said, i was a teen, so was she , and yes it was consent, she was my girlfriend, we both had sex, because we wanted to.

    Now, past that , i dont much care about "visa fraud" if she came over on tourist to start with and married, im sure it would be fine, people do it often, whatever gets you there.

    Ive spoke with an immigration lawyer who claims they get the adam walsh act waived since the case was consensual and we were both teens at the time. But i dont know if i believe them or not, i have not see any documented cases

    So, you say my choice is to stay here, which, would be fine, but then, if i dont register as a sex offender in the usa, they will say failure to register and try to charge me if i ever return. Im not sure how i can provide for her here , or how i can stay here legally , any ideas?

    my wife and I are both 27 , she might be pregnant , does she have any chance to get to the usa? if not, then i need to skip my plane ticket home, but i have no idea what happens if i do that

  15. Here is the deal, i flew to the philippines and got married, i also extended my visa while i am here (currently here).

    When i get back to the usa, the plan was to pay an immigration lawyer for k3 processing, sadly, as a teen i got convicted of having consensual sex with my girlfriend who was 15. The Adam walsh act is going to #### up my life

    So i was thinking, since we just married, can my wife here just apply for a tourist visa, (which im sure she would get, she has a good job here) and come to the usa, and just not leave, since we are in fact legally married and i am a usa citizen?

    So we can bypass all the bullshit? thanks to anyone that knows , she hasnt changed her passport or id to my last name as of yet

  16. Here is what happened to me. I met a girl at a party, her boyfriend (who at the time was about 24 years old) had just broken up with her and she was crying. She was about 5'11 , and from puerto rico, her ex boyfriend cursed at her and left the party. She crying drinking a beer, i sat down beside her , introduced myself, we had a few beers, talked, exchanged phone #'s

    A few days go by she calls me, i go to her house introduce myself to her parents (mom and step dad) i tell them my name and how old i am , her step father says " isn't he still just a little old for you?" and she responds " he is way younger than my last boyfriend " and takes me to her room, at that point i ask " how old are you?" she responds saying she is 17 at the time i was 19, almost 20 (or maybe i was 18, almost 19, i honestly dont remember, i knew it was near my birthday) but anyways.

    So for a while we see eachother , mostly its her inviting me over to her house, she would cook dinner , and watch her brother and sister, her mom was never there, and when she was there, she seemed a little "out of it" but that part comes in later into the story.

    We dated about 6 months , probably had sex a total of 10 times between florida and alabama ( i live on the state line and so does she). Mostly i was always working , and she was always watching her brother/sister and we didn't have sex at her house with them around, our relationship was not all about sex.

    One day she gets a friend to take her to my house and drops her off, (i was living with my mom who had met her several times) my mom left for work, and we ended up having sex in my bed room. Later that day her friend came over to pick her up and parked in my yard. (here is where the story gets crazy)

    Her ex boy friend (the 24 year old guy) rides by my house sees her with her friend and me talking outside, and takes off really quick down the road. She leaves and goes home, and some hours later the police show up at my house, explaining that i was under arrest for having sex with a minor, i had no idea what was going on

    While in jail waiting for trial, she wrote a letter and explained that her ex boyfriend had been selling her mother drugs, and once he found out she was seeing me, he quit selling them to her , until she "did something about me" when she got home that day, the police were at her house, and took her to the doctor for a "rape kit" to check for dna, or something like that

    So i get to trial , she stands up in court and says " i had sex with him, its something i wanted to do, no one forced me, i did it on my own" thinking that it would make it ok , she didn't know it was against a "state" law and she had no say so

    My lawyer says to me that we could fight and win, but if we lost, they would give me the max sentence, but if i take a plea bargin, i could go to bootcamp for 3 months (adult boot camp) , and 3 years probation and serve no jail time. He tells me i should not risk it, and i should take this option (not being told i would have to register as a sex offender)

    I almost complete bootcamp when i am arrested and sent to florida, (i had no idea why)

    Apparently she had wrote a letter to friends about how we had sex in alabama and in florida, so i get charged in florida with the same thing (alabama its RAPE II, in florida its "LEWD AND LECIVIOUS ACTS with someone under 16)

    When time to set bail (after a few days) i explain to the judge what happened, she actually gave me a bail and i went home , a few days later i call my probation officer and explain i made bail, he become furious and says i have to return to jail in alabama until they send out "sex offender " noctices and i can't go home. (the bail was a waste) So i return to jail 30 more days

    I get out go to trial in florida, i explain what happened, she isn't at this trial or anything. Its the state vs me, they tell me they will give me the same deal i got in alabama and run my probation "concurrent" which was fine, except im now a sex offender in florida as well

    The girl ran away from home to california , she met a guy ( he was about 18 ) got preg and had a baby, married, and they have a home /life etc (this was many years ago)

    So here i am , and thats the story , i can't afford a good lawyer to fight both cases again, the last i spoke with her (even though im not supposed to) she said she would tell the court anything needed to help me.

    And thats the long story

    The lawyer claims to be an ex district attorney , but i want to be smart and explore options so please, if you have any recommendations please do ( i hope its not against the rules to ask, but i would like to know, thanks)

  20. In the usa its strange, in some states girls at 15 can legally marry, but can't legally have sex with someone more than 2 or 3 years apart . So if the girl is 15 and the guy is 18, he can go to jail, even if the girl says she wanted to do it, it breaks a state law, (they dont care if she wanted to or not). Its amazing really the rules we have in the usa , by most countries standards this is stupid.

  21. Oh and another growing problem " International megans law" Being that sex offenders are a hot topic for politicians , because its like a which hunt but check this out. Its not a law yet, but they are working on it.

    Meaning once passed, a sex offender will have to give notice before going over seas, and then our country will contact the country you are going to , and tell them you are a sex offender based on the usa laws, and its up to them to "accept you" or not.

    Ha!! soon we will be trapped in the usa, you would think the usa would want the sex offenders gone? but of course not its all part of the game.

    Take my case, i had consensual sex with someone underage (based on my state) by most other countries standards what i did it not against their laws , only ours. But, i can bet when this goes in effect , that the country you go to wont check your case and based it on their laws, they will probably just go with whatever the usa says and deny you entry.

    My advice is do what you need to do now, the window of freedom is closing and you may one day be trapped , in the usa.

  22. Have you spoke with an immigration lawyer? they only gave me a 50/50 chance of getting the k1 cleared. But gave me a 90% shot if i went there and married.

    But im really sick of the rules in the usa, so im ready to just fly there, and live and say forget this place. I don't care to play the law games in the usa anymore
