    That's awesome that you can drag you butt out of bed and go to the gym everyday. Once you do it for a few weeks it will become routine for you and you won't miss sleeping that extra hour anyway! :-) I agree Missy......wayyy too quiet! I'm home today....day off for me, not much going on. I'll probably be researching the flights from Nigeria to see what sort of deal I can get for my husband. Really isn't the best time to be traveling, but.......hope everyone has a great day!!

  2. If you have the chance to get the IR1... it is the BEST visa as you get the GC when you enter for 10 YEARS!!! That means you get the SS#, can get the Drivers Licence and work when you enter and NOP ADJUSTMENT OF STATUS... Don't worry bout the other $$$ as the K3 would cost you $1010 plus the filing fees!!!! For 1 month (since your interview is the 22nd of January) without a moment of hesitation I would trade that wait for the IR1... No questions!!!

    someone said that I could risk being put back into AP again for the IR1 and that by going to the interview regardless of the outcome it could cancel out the K3 visa. Does anyone know if this is true or not?? Please remember I am also dealing with the Nigerian embassy......

This is my situation: Filed for a K3 visa had interview on the I129 in April got put into AP got called back into the embassy yesterday for another interview on the I129, which got approved....YIPPPEE!! However, while we were waiting to be out of AP (8 months) we went ahead and paid the additional fee of 470.00 for the I130, which turns it into the IR1. The NVC approved the I130 and scheduled an interview date for January 22 at 7am. I was hoping when Ademola went for his interview yesterday they would just do the IR1, but the NVC hadn't forwarded on the documents needed to complete the case which is why they did the K3. I'm not sure if we should wait and go to the interview and just do the IR1 or we should just forget it (lose the 470) and do the adjustment of status here. This would also mean he wouldn't be able to get a job until the EAD is approved, which you have to have an active AOS filed. I worry that there is a risk that they might not approve the IR1 even though the K3 got approved. Has anyone heard of this happening? Does anyone have any words of wisdom or advice for me......it would be greatly appreciated!! Thanks

    Thanks Missy......just learning as I go along. Its all sooo confusing and everytime I call I get different information. One person will say they are two seperate cases and then someone else will say they go together. They must both be in their system though right? That would only make sense to me, but this is Nigeria after all and as we all know they don't exactly do things the way they should....lol. I'm going to email the two receipts I got from the NVC for the two fees I paid so he can print them out to bring with him along with the appointment letter they sent him for the I130 interview in January. He is going to come online this weekend so I can quiz him and ask him the questions I think he will need to know. He should be fine, but I just want to make sure he's prepared........so much STRESS!!

  5. Asking him to come in is in responce to the AP. You do not actually get a seperate interview, because you filed a different petition. Technically they will schedule one going through the mostions, but he is the sam eperson so the same responce will happen. They will just adjust it when the give him his Visa. Make sure he has proof that you paid the fees at the NVC.

    You visibly were put in AP because of medicals not being finished. You knew that going into the interview, but now you know the AP consisted of more. He was going to be put in AP whether he had his medicals or not. Has he ever applied for a student or visiting visa??? If you answer yes, call me on that one. So did my ex.

    Comming in sooner could be good or bad. There is not justification either way. The home visit and neighbor interviews went well and he got the Visa or they went bad and he is denied.

    You can't get confused with the 2nd interview. Even if he made it to the interview for the CR1 in Janurary without being out of AP, he could still remain in AP.

    Your situation is very unique so it is difficult for people to give you advice.

    Thanks Missy. He is soooo freakin out right now and its making me crazy. The home visit with my father in law went well so I think this is good. I'm just concerned they won't realize the I130 is completed, since the NVC still has the paperwork and hasn't sent it out yet. I want him to be able to work once he gets here and not have to wait the 6 months it takes to file the EAD and you have to have an AOS (code for more money) in process in order to file for the EAD, which I did not know. No, as far as I know he's never applied for any other type of visa than the one we have filed.

  6. Sorry, you asked if this has happend to anyone else and I cannot say I have seen a case like this... Have you tried looking through the threads and doing a search to see if there are similar cases...

    Now at first glance I would say to go to the earlier interview and let them know then that you have the interview for the IR1 in January. Best case scenario is that they can switch you from the K3 to the IR1 and save you the troble of AOS... I have seen other cases where the consulate did this, meaning they went to the K3 interview but since the I130 was approved and at the consulate they issued the IR1/CR visa... Hope that is the case with you...

    If they want you to come in and it seems like the AP is done, then I would say go ahead and come in earlier... If there are any issues then you still have the January interview to fall back on...

    Thanks Christeen for at least giving me your opinion. This process is soooo difficult and I'm so freaked out right now by all of this. Anyway, the problem is that the NVC has not sent the documents onto the embassy. Our plan is to go to the interview and for my husband to explain to them that we have a date already scheduled in January and that we want the IR1 visa instead of the K3, since we already paid the money and can save ourselves a few steps by doing that. I sent an email to the embassy today requesting they contact the nvc to expedite the documents to the embassy, but not sure that will do any good. I guess its just another waiting game again......Thanks again for ur answer to my post! :-)

We were only notifed of the interview date 20 days prior to the interview so he was unable to go back for his second appt to finish his medical so because of that we were put in Administrative Processing. The case was just sitting there for months and nothing was being done (or so it seemed to me). We decided to go ahead and pay the fee and file the I130 with the NVC since we were waiting anyway. The NVC has finished the I130 as of November 24 and we just got an appointment for an interiview scheduled in January. However, since that happened the embassy did a home visit for the I129 and just called my husband this morning to come into the embassy much sooner for an interview. He did explain to them that he has an interview already scheduled in January, but the woman was insistant that he come in. I am just wondering if anything like this has happened to anyone else? Will the embassy realize he already has the I130 interview scheduled and let him interview for that? My husband is planning on bringing the letter we recieved from the NVC stating the I130 case is finished and the date of the interview for that case. I'm just so anxious and confused about what to do. I don't want it to get all screwed up?? Our goal is to obtain the IR1 so he doesn't have to apply for adjustment of status and pay an additional 1000.00 once he gets here since we already paid the fees with the NVC. Any suggestions would be greatly appreciated!!!

I called NVC on Tuesday and the man I spoke to says "I've got good news your case is complete as of today with the NVC"!!! :dance::dance: Yippeeeee............of course we missed the December interviews, but at least its a step in the right direction. I guess we will be waiting until January of February for an interview depending on the capacity of the Lagos Embassy. I just hate all this waiting. I just want to know the date.......I'm very very happy that the case is complete tho!!

He said they dont normally give our identity for security reasons but since I am an old man,he idetified himself as simply Paul.

    Your welcome about the questions.....I was thinking it might help someone else through this horrible process. It has been FOREVER, at least it feels that way to me. We have been married for over 2 years and we're still living 6000 miles apart. I hate this whole visa process!!

  14. Baby that is great news. I think our AP was over about a month after the home vist. It does feel good to know that part.

    Yes it sure does, but the problem is the I130 is at the NVC (almost complete). Do you know if he can use the same medical exam he did for the I129 interview or does he have to complete it again? It has only been since April, but I'm just not sure if its a different exam or not. I paid the extra 470 to go ahead with the IR1, but now that the I129 is almost complete I just don't know what to do. I really don't want to lose that money and have to adjust status here and him not be able to work for at least 6 months. I'm sorry.....I'm rambling just so much is going through my head right now.

  15. Good Morning all.......day off today....yippee!! Making lasagna for dinner tonight so need to get to the at some point so I can make the sauce.......its early yet though still drinking my coffee....lol.

    A little update on our case: the embassy visited my father in law yesterday at his home and asked a lot of questions about Ademola and myself. They also wanted to see pictures of us, which they have plenty....our wedding pictures are even hanging on the wall. I'm just excited to know they are still processing our case and being stuck in AP may soon be over.

  16. My father-in-law called me yesterday to inform me that someone had come to his home (from the embassy) to inquire about my husband and I. They asked him quite a few questions and wanted to see any pictured they had of us, which he had plenty. My father composed an e-mail to me in question answer form so I would know exactly what was said. I'm very happy to know that they are still working on the case. We interviewed back in April and I haven't heard anything since. I'd gladly share the questions if anyone is interested and might think it would be helpful to them.

  17. Does anyone know how long it takes to get an interview for the IR1 once the nvc is done with the case?? Our case is almost complete as of yesterday and I was told they will be putting the case in the "QUEUE" for an interview, but I'm not sure how long that takes. I tried to get some information from the NVC, but it was quite general and am hoping someone might know better on here. Please let me know. Thanks

    We're playing at the saco memorial field I think over by the middle school behind thorton?? That would be cool though. I'd love to catch up with you.......if not there I'll definately call you after the game so we can meet up and have a girls night....maybe some wine, a movie, sound good??
