  1. On July 30, 2009, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days from July 30, 2009, please call customer service at 1-800-375-5283 for further assistance.

    Now I did file for a CR1 this was on my K1. I can think of 3 things this might say. 1. The petition has expired I can refile again. 2. The petition is invalid since I am now married and filed for a CR1. 3. We upheld the consulate denial your wife is banned for life 212.

    Has anybody ever gotten this what should I expect? The wait of 15 days is a killer.

    I receive the same notice , same day, ( July 31st 2009 ) I also dont know what to do with this

    Dear Mr.

    After a thorough review of the facts of this case, the petition was returned to the U.S. Citizenship and Immigration Service (USCIS) where the petition was filed on April 17 for review and possible revocation. The visa applicant was informed of this decision directly by our office, and all personal items submitted in support of the application were returned to the beneficiary at that time. This case is now closed in our office.

    how did you find out your case was returned? my case was also returned according to DOS on 05/14/2009 I am trying to find out why?
  3. Just wonder any one had case return to USCIS in US and win/ or have visa appoved/ pink slip ? My case has return to state on April 17 2009 from HCM, I do not know when it will be here to USCIS, I really dont know what to do now, any one please give advice. Thanks

    Q3: confusing, just show the bills/phone records, in an order that easy for them to sort it out. Yes, they can dig up information on you, they are the FREAKING US Government and the VN government has little to nothing interest in protecting your fiance's privacy since VN doesn't really have that privacy/personal concept, it's a commie/police state after all... So they can give up your vital information just as easy as it collect it. Your answers look OK!

    Q2: I'm gonna try to think like a C.O. on this one (please don't hate :) just want to give you some crazy thinking they could have had during the process of reviewing your case) Key here is: Think like a CO when it comes to preparing for an interview...

    "I think you and her sister could be something more than just socially acquaintances, know each other 9 years and never mentions to you she has a hot sister that potentially could be introduced to you as a wife?

    Who asks if you two were lovers therefore you shouldn't be expected to remember the date/time you two first met?

    I have much doubt about your relationship and the beni's sister, I'm not feeling all good about this...

    Beni didn't answer the questions in a way that convinced me She knows you well!

    Beni could have said "8 or 9 years ago, then became friends in the past 3 years, then my sister introduce him to me", give me something in chronological order would be helpful!

    So I just gonna deny it and let them sort it out, rather risk granting a Visa then later find out something else!

    Oh well, I need to move on to the next case or else my case-load will be overloaded. DENIED!"

    For this thought, I can say this:

    The question from CO is , they want to know DATE and TIME . When my fiance she really dont know what date and timem may be 9 years, they do not accept that answer.

    1- Year 2000 - I was married at the time I know my fiance 's sister, 2003 then my wife divorced and moved to Texas, and I divorced 2 years before I introduced to my fiance in 2005.

    2- Her sister is dating an American, and her sister is have a baby boy with that American.

    So if the CO think like your way, is this wrong or right?

  5. My fiance received the white page, There are 3 things they said in that paper:

    1- Beneficiary is unaware of basic facts of Petitioner's living arrangements and who petitioner resides with. Beneficiary claimed petitioner lived alone in his current residence. However, public records indicate otherwise.

    2- Beneficiary's account of how Petitioner and Beneficiary were introduced is not credible. Beneficiary claims beneficiary's sister in the US introduced Petitioner to Beneficiary. However, beneficiary does not know how petitioner and beneficiary's sister first met.

    3- Submitted evidence of correspondence is not credible. Petitioner submitted phone records from Petitioner’s two supposed cell phone numbers as evidence of correspondence for the claimed relationship. While the cell phone number used by Petitioner from before Sept 2007 traces to petitioner, the cell phone number claimed to have been used by Petitioner from after Sept 2007 does not trace to Petitioner.

    3 reasons that US consulate use to denied visa was wrong. I can proof that they totally wrong.

    1- Beneficiary is unaware of basic facts of Petitioner's living arrangements and who petitioner resides with. Beneficiary claimed petitioner lived alone in his current residence. However, public records indicate otherwise.

    On the date of the interview, the CO asked my fiancé: “Who’s your fiancé living with?” My fiancé answered that: “he lived alone"

    It is truth that by the time of interviewed, I lived by myself. 7 months ago - before the interview- my cousin and her husband stayed couple months temporary when my cousin first came to Minnesota, after that they found apartment and moved out, They was moved out about 3 months before the interview date . They are now have a baby 1 year old, is there any help if I can provided proof that people who temporary resided at my house now lived at other location and have baby? Or I can have them write a letter said that they did live there temporary only, they can also photocopy their ID at their own address if need.

    My fiancé said, the interpreter for interview translated the question like this: " when did the date and time your fiancé met your sister?” 9 years ago, I knew her sister just social only, and we became friend 3 years later, there was no love story, how we remember date and time like couple who is in love? This is very silly, my fiancé cannot make up date and time and also there was no way to know when is date and time me and her sister first met. If my fiancé could not get the visa because this reason, it’s really ridiculer reason!!!! Its not make sense at all!!!

    I have proof that I'm the one who own that cell phone number, I do have bill from AT&T shown that phone number and address, I will provide copy of my phone bill if need and the consulate can call AT&T and verify the phone number and account holder. I dont know how they can say this, and who is the one did the back ground check ? I think they make up just to denided .

    Im working with Mr Marc Ellis now, he was my lawyer before interview , any thing new , I will update.

  6. wew, after 8 months waiting for decision from US consulate in HCM, this is what I got in my email today:

    After a thorough review of the facts of this case, the petition has been returned to the U.S. Citizenship and Immigration Service (USCIS) where the petition was filed for review and possible revocation. It can take several months for the petition to be received by USCIS. We will inform the beneficiary and return all personal items submitted in support of the application to the beneficiary at the appropriate time. This case is now closed in our office.

    I'm working with Mr Marc Ellis, is there any one in this forum success after case rejected and send back? I will update if anything new to my case , rught now we both very sad like a funeral.... :cry: :-(

  7. it looks like you are not well prepared. I think ME doesn't work on this personally, otherwise you wouldn't have this problem. ME helped me out before and those things you mentioned above were well prepared by me because ME told me to do so .

    I think he doent remember our case or bother about our case although he is acting on behafl of us, I did email him about my case , he said he will ask US Consulant, but I havent heard any thing from him since. All paper submit since August 4 , till now still not any response from consulate .Still praying... and still waiting for Mr ME response and from consulate .

  8. I still hope that one day Mr ME will open his heart and do me favor by help us to complete this case. I think I did fullfill my responsibility about listen from him and paid fee in full as requested by his staff, try to patient, try to follow his's order, now its my lawyer's action that I try to see whats going on. I will update to forum if any thing better or any good new happen.

Mr ME is not God, he can not get every one out of all mess, its depend on the case, if its simple and easy, then it will OK, if its complicate, then all you will heard from mr ME is: "wait " or "we should refiling the case" . He will not go to US consulate and fight for you. I email him said that if I refiling the case, then I will let him help me with that, so I will not get blame later for what I did that may give him a suggestion that I gone wrong way. He promise me to ask the embassy about my case, but untill now, I still not heard any thing from him yet, Im not sure if he still remember his promissed. Im tired of try to keep in touch with my paid lawyer for my case , I thought my lawyer should representative us in following the case. i still hope that one day Mr ME will open his heart and do me favor by help us to complete this case.

  10. I have Mr Mc Ellis handle the case. My fiance and me met him in person once when we come to sign paper and pay lawyer fee. After that my fiance allow to see him once more time before the interview , he help my fiance preinterview. After interview then green slip asking for more documents. And since then , still can not see him, even requested but his assistant alway said "he busy or he not here" before submit additional documents, my fiance ask his assistant if she can hand all the papers before submit to Mr Mc Ellis so he can recheck all paper work before turn it in- she want to make sure every thing right because only lawyer can point out the wrong point- we want to avoid that, still, his assistant refuse that request and said "I can look at that documents, it no need to be him" then he quickly look and return all documents to my fiance . My fiance submit in and receive another green said "wait" despite of the fact that my fiance 's difficult direct contact to Mr Mc Ellis, I have to email and call him by myself to ask for case's status, Mc Ellis told me to "wait, US consulant is a mess right now, and he advice me to refilling file , thats mean start over again" I dont feel the respect to client we should deserve here, some time I wonder who are the real one we deal with, he or his assistant, but if I'm not wrong, Mr Mc Ellis is the one who we want to take care the case, I have email him with my case number and state he is our client, but then he replied my email and ask if he was hired be my lawyer!!! Its sound to me like he dont know who I'm !!! I guess he had too many case come to him that make him forgot, but if his assistant more organize with case numbers, just a few click on computer, then it will show whats case belong to who and how's it go.....I'm still in middle of everything and it make me keep wonder and wonder about this , I will wait like he advice , and I will follow his instruction ( I have to remind him, ask him because Mc Mc Ellis will not automatic find me or contact me about my case, Mc Mc Ellis will not automatic keep in touch with me if he have any idea, any suggestion...... when I ask, then he will asnwer, if not , then just wait.....) I will be patient in my case, I will follow his instruction, I will not do my own way because I dont want later if some thing happen make my case go wrong, then he my blame on me. I will update my case that handling by Mr McEllis when ever I find out any news. I hope there will be light at the end of dark tunel. At this moment I the only thing I can do is praying for all thing will be ok.

  11. So, are you going to hit him up for child support? You know, sort of a "I don't have feelings for you anymore, but I still have feelings for your money" kind of thing?

    I think whomever has custody should pay. If you don't want custody, you shouldn't pay. If you are forced to pay, then you should get half custody - and yes, even if that means the child moves to the other side of the planet for 6 months at a time.

    If party A doesn't want custody and doesn't want to pay, and party B thinks he/she can't afford it on his/her own, then party B should give the child up for adoption to someone who CAN pay.

    These people who want custody AND want someone else to pay are just about as unreasonable as it gets.

    I dont like this guy sound. To me, you play you pay. It does not have to be you or me who pay, custody or not. The mean thing is, you must responsible to your own child- even your ex remarriage or not- you still responsible till the child 18 years old. I hate these dead beat fathers - or mothers who run away from child support , act silly and no responsible for past act. These people should put in hell forever and let all the tank run over them nody 1000000 times until their's body crurse to 100000 piece and their soul should live down hell forever. Share 50/50 is fair.

Very easy, no need to call them mail statement.

  13. Vietnamese ladies just like any other ladies. If you treat them with respect and full of love, there is no way they turn away from you. They have a heart too. My friend auntie married an American , she is Vietnamese, married and live with that Arche until he died at age 78, their married was last for 42 years. My cousin now married to an American and they still live together its been 8 years still no trouble. I guess your purpose in this forum is just want to place HATEFUL comments about them. I'm careful read your words, all you want is You talk, you talk and you talk, is that how you treat your love's one ? You married some one just because you want to have some to listen to you ? See how demand you are, the way you talk, the way you think, I think you deserve what ever you 've done. I guess not even Vietnamese ladies, any ladies who live with you will be endup the same way, you will be kick ### even harder.

    This question should be directed to the VNese ladies. Majority cases of marriages (with either VNese or American) involving the ladies from this country result in divorces AFTER they qualify for the "Green card".

    First couple years after their arrival in the US...........You talk, they listen...............

    Third year (after they receive their 10-year Green card), you talk, you listen to yourself.........then she talks, you be quiet, trying to respond with little effect.

    A few years afterward, especially, after having the first-born, you're on your knee, begging her to be easy on your VISA/MC, whatever, charge accounts.............

    A decade later, you look like a bum, trying to work 3 jobs to make the "MINIMUM" payments on your CC bills, covering her trips back to VN once every 3 months to visit her "NEW" boyfriend. You're HISTORY dude! with child-support payments on your mind!

  14. I can not wait any longer, I have to direct contact Mr ME, I just called ME. He said that I should wait about 2-3 month , because I need to let the CO have time to review and make some investigates information which we submitted. After that time, if we dont have any answer from consulate, then we can call him again, what he can do now is help us to submit again if we want, other wise, he can not do any thing at this time, we have to wait 2-3 months. I told him that he is current our attorney and he is take care of our case now, I ask if he can use his power of attorney to ask direct consulate about the going on of the case, he said he can not do any thing at this time, I have to wait for the CO finished the investigation. :unsure:

  15. How do you know for sure if M.E.'s assistant is correct in his decision? Is this person, Truong, trained in US Immigration laws and dealing directly with HCMC? Remember, you're paying for this service, ask for the M.E.

    But, that's just me!

    I dont know what to say, but my fiance try several times to make a direct contact with Mr ME and failed, Truong- Mr ME 's assistant always said: "I couln't contact Mr ME, he 's not pick up the phone " It's not like here in US, when we have an issue and need to contact lawyer, then we can set up an appointment so easy. About Mr Truong education, I really hestitate to ask, just simple use the term "assistant" for him.

    This afternoon, my fiance submitted all doccument which the consulater office required ( 5 counts) After 4 hours long waiting in exshauted , my fiance receive another green slip. In this slip, it says that your case requires additional processing in our office, you dont need to submit futher documents. We will contact you when we have finished processing your case. I really dont know what to do any more, any one have similar thing like this happened? I guess I have to call Mr ME direct from here talk to him instead for talk to Mr Truong.

  16. Mr ME's assistant name Truong met my fiance this morning, after check all documents , he said its good enough "and advice my fiance submit all. My fiance still dont have the chance to meet Mr ME , hopefuly this will be o.k . My fiance will submit all document this afternoon, I will post more by tomorrow, I'm praying , praying now.....

  17. Note, this case is NOT denied! Rather delayed! Don't confuse by it, if your case were denied, it would have been sent back to USCIS already!

    you are right, but when they ask for more things, its make us so worry and pop the feeling of being denied again,its happened in the past when they told us to submit paper work, after that they said case send back to us, now this is the second round.... :unsure:

  18. Sorry to hear about not getting a pink slip.

    I have a question for the divorced posters with the blue slips. Did you include the requested informaton in your I-129f? In the case of Vietnamese Americans, there are many red flags that come up that unless addressed early. ie in the I-129f, seem to case blue and green slips and in some cases, being sent back to the US.

    The Good News is you'll be together, the question is when. In some cases, submitting the requested informations results in a pink slip right away. In others, it takes a while.

    Having Marc Ellis seems to help so you'll be taken care of.

    I answer all the questions ask in petition form, the thing is , the CO never ask for those, the blue slip have been ready before the interview, when my fiance got there, the blue slip already there, they not take any look at papers that she had with. My fiance got the Fedex on Friday, she have been try several times to contact ME because she want him to go over all the paper before she submit to consulate, but we still no luck of get in touch with him. he is current our lawyer, but seem like he very busy, even his assistant can not contact him. 'We are living in fire every day, hopefully this will be resolve soon. :unsure:
