  1. so you are saying that your sister did a consular processing and ended up getting her green card 2 months before you?

    You got that right. She got an interview date (June) after she submitted all the documents needed (given of course that the priority date became current)... After approval of visa she came to the US a month. Then when she got here in the US, after 3 weeks she got her greencard. Meanwhile I filed for AOS in May, got my interview date only in Oct 7 and just got my greencard! Pls be reminded too though that she came here as soon as she got the approval/visa...

    I have been waiting almost 7+ years

    does any kind souls know of any way to check the status of one's green card application?

    I read on the web that it is not a good idea to call USCIS to check as it might jepidize the application

    is this true?

    Are there any other ways to check on the status online?

    7+ years is a very long time

    I am wondering if my application is where it should be

    i am a beneficiary of a petition from my LPR mother as well.. I actually just received my green card today!!! :star: I have waited more than 11 years! I dont mean to scare you, :blush: but yes Ive waited more than 11 years to be able to adjust status.. SO, to answer your question, Im assuming you are asking when you can adjust status??? It depends if your priority date is current, thus, if there is a visa# available for you.... What is your category? F2A or F2B and are you from a country w/ visa issuance limit?

    I am originally a malaysian

    but now I got singaporean citizenship

    were there any way you checked your application to see if it is progressing properly?

    If you are unmarried below 21 you are under F2A category.. If you are UNMARRIED above 21 you are F2B category.. Check the visa bulletin for the Priority date...

    My LPR mom partitioned for my Green Card sometime in 2001

    if everything goes well, my priority date should be current in 2009

    and I can apply for my Green Card

    Singapore has a visa waiver agreement with the USA meaning that I dont need a USA Visa to enter the country

    but if I am not wrong, if I enter the country of USA via this visa waiver program, I cannot do an adjustment of status

    does this means that I will have to apply for my green card through the singaporean consulate?

    is there no way where I can enter the country to apply for my green card legally?

    I understand that if I were to apply in the USA, the process is much shorter

    The Visa Waiver Program (VWP) permits permits nationals of certain countries to travel to the US without a visa for tourist or business travel for up to 90 days. If you are traveling to the US with the intent to adjust your status (get a green card), then you do not qualify for the VWP. Of course you could enter the US without a visa and without telling the US authority upon entering, but you will be committing fraud and putting your green card at risk.

    DO NOT RISK YOUR GREEN CARD! You are so close to getting it, why risk it? Wait and do it the right way.

    You can enter the US with a tourist visa if you have one.. HOWEVER, make sure you remain in status after your tourist (B1/B2) visa expires like getting an H1 or working visa until your priority date become available then you can adjust status.. Im saying these process because this is my case.. I was petitioned in 1997 by my LPR mother... came to the US w/ a tourist visa in 2001 and remained in status with an H1 for 6 years until I was able to adjust status this year only!! !may 2008 and just received my green card!!! :dance: My sister actually remained in the Philippines until the priority date became available.. in other words, she did the consular processing and i did the adjustment of status and she actually got her greencard 3 weeks after she got here in the US.. SO she actually got her greencard 2 months before me.... So, i hope that helped... :blink:

THANK YOU THANK YOU EVERYONE!! it feels surreal that after 11 freaking years Im finally gonna have this little green/white card that could or is actually going to change my life :dance: I actually decided to go home (booked my ticket a month ago) for a vacation w/ my Advance Parole even if I havent received my GC bec I was dying to see my friends and my homeland... =)

    Hi ASB2.. I am a beneficiary of a petition by my mother who is a permanent resident... I have posted something before about my experience... But the gist of my timeline before the AOS is.. it took me 11 yrs to be able to adjust status... I am from a country w/ a quota and child of a US citizen would take longer thats why my mother cannot apply for citizenship and remained a permanent resident til we (my sister and I) get our greencards...

    Any idea on how long will take now for AOS?

    Since the beneficiary is above 21, that person is considered under F2B Category.. THe bulletin says priority date of 15DEC99 .. Id say 8 yrs? Hopefully less...

    oh! it toooook forever! :wacko: LOL My mom filed the petition in 1997 here in the US but I was in the Philippines and the I-130 got approved in a month.... the real wait starts after the approval and waiting for priority date to become current... I was under 21 (17 at that time) when the petiton got approved (F2A) but my priority date only came out this May 2008.. Basically my category already fell under F2B (unmarried child above 21) category! SO in other words, i still dont have my greencard... :bonk: ... total wait before I was able to adjust status - 11 years!!! Im telling you it was soooo surreal filing the application to adjust status... :star: See the thing is Philippines' visa availability has quota and bizzare as this may sound but the Priority date for F2 category (unmarried child of an LPR) moves quicker than children of naturalized parents... So im still waiting for my greencard but now the burden is not as much as before when the wait seems not to end.. :yes:

    Oh I see, you were still in the Philippines. I thought you were here throughout the whole process and were able to adjust status without a problem. The reason I assumed that was because the OP said her sister is already in the US so in her case, the sister will have to go back to her home country and wait at least 11 years like you did.

    I came here in 2001 but was lucky to get an employer that spnsored me on H1 so I remained is status... However if I overstayed here after my B1 visa expired I could still have taken advantage of the 245i and just pay the $1000 penalty for being here "illegally" ...

  9. Thats not true! i am a living example and many others out there who is a beneficiary of an approved petition filed by a parent (in my case my mother) who is a lawful permanent resident of the US... Please do not post something that can mislead people. Thank you... :blush:

    I am so happy today i got notice from CRIS that my green card has been ordered! Praise the lord indeed!

    I have not heard of my EAD and my AP yet though...

    My timeline:

    May 10 - church wedding

    May 21 - filed EAD,AP and AOS

    May 23- receipt date of USCIS

    June 25- Biometrics

    July 1 - AOS transferred to CSC

    July 28- AOs card ordered .......Hallelujah!!!!!

    WOW!!! Congratulations! Thats sooo fast! Thats just like 1 month after Biometrics! :wow: Im jealous! :star: But at least we all know we will get our greencard someday! :yes:

    Neither you or your parents can petition your sister, since there is no visa category for LPRs and their siblings. Only your brother can do it since he is a US citizen. However the wait now is over 10 years for a visa number for siblings so all this time your sister will be out of status if she stays in the US.

    She has to go home...and Im assuming shes not married, then the fastest way is for your mother to petition her... She will be under F2B category.. If you are neither from China, India or Philippines the current (aug2008) priority date for F2B beneficiaries is Nov1, 1999.... That means approx 10yrs of wait... I am a beneficiary of an approved petition through my mother.. My mother filed the petition when I was 17, thus I was under Category F2A... However, I fell under category F2B by the time my priority date became current and eligible to adjust status... Its a lot of patience...Luckily i was able to get a US employer that sponsored me to work here on H1B visa... So, I was on H1B visa while waiting for my priority date to become current.... So my wait was eleven long years! Yup! 11 years :wacko: before i got to adjust status to become a permanent resident! So, its a choice your family has to make.. your mother can file the petition now or maybe your sister can find a US employer that will petition her... Good luck! :)

    History: AOS based on an approved I-130- daughter of a lawful permanent resident - Petitioned under 21 and aged out before my priority became available and eligible for adjsutment of status... From F2A to F2B category- Luckily, on my vacation in 2001 i was sponsored and able to work in the US with an H1B Visa for 6 years... I waited 11 years to be able to adjust status!! Yup! 11 yrs!!!

    Anyway, good luck everyone! Remember: Patience is a Virtue!! :thumbs:

    4/30/08-FEDEXed (priority) forms I-485, I-765- & I-131

    5/01/08 (Thurs.)-Forms recvd for/by Chyba

    5/08/08 -Check deposited

    5/09/08 (Fri.)-Check cleared bank (7th bus. day fr rcpt of forms)

    5/09/08 (Fri.)- NOA for each form

    5/12/08 (Mon.)- Apptment Letter-Biometrics for I-764 & I-485

    5/29/07-Biometrics Apptmt (21st bus. day)@ 3pm-(got there 2pm-DONE by 2:15pm)

    6/02/08- Registered for automatic update

    7/11/08-Rcvd email from Chris: 1765-Card Prod Ordered; I-131 Approval letter sent

    7/16/08 -2nd Email from Chris: 1765-Card Prod Ordered

    7/18/08- Cris: EAD Approval Notice Sent

    7/19/08-Rcvd Form I-512L-Advance Parole

    7/21/08-Rcvd EAD- Picture Horrible!! :lol: By the way, envelope didnt have USCIS letterhead so be careful.
