  1. I know you want to reunite with your wife as soon as possible but if she is in a high risk pregnancy isn't it better for her to stay in Australia to deliver the baby where she will have access to the necessary doctors & medical treatment?

Hopefully you have a job with medical insurance which allows you to add her (and your child) as dependents to the policy but since she is already pregnant I'm not sure if it's seen as a pre-existing condition, and if they will even cover it.

No, I'm the Australian. We were married in Aus' in january and now she's back in Boston.

  2. We have applied for IR-1/CR-1 and were just told that my Wife is at a very high risk of losing the baby, we have a Dr's letter and are hoping to expedite, though haven't received NOA1 yet.

Anyone had experience with something similar to this? I'm wondering how long we should expect it to take if expedited and whether or not a high risk pregnancy will be seen as an eligible reason to expedite? Also, is there an additional fee charged to expedite?

    Baby is due early October.

    Sam.

You dont have NOA 1 yet???? You need to find out where NOA 1 is at, do you know what service center your case is at?

All you can do is try for expedite, there is no additional charge to request a expedite, but most expedites are life and death situations, unsually not pregnancies normal or high risk, or if military and petioner is about to deploy out. All you can do is try for expedite, you call and request a expedite, and the service center will contact you for info. if they think its a reasonable request for expedite. Good luck.

Yeah, it's been 29 days since we sent the I-130. I keep hassling my Wife to call them again.

  4. Other countries which have been left out are-- Nigeria, West Indies, Columbia.

Basically any country whose per capita income is way less than USA and also the countries US see as potential terrorist threats. That's why a lot of background check goes for people coming from Islamic countries.

Age difference, previous divorce, financial position won't matter if the couple belongs to alliance countries :P

    Hi Trinket,

You wrote "financial position won't matter if the couple belongs to alliance countries" I'm just curious as to how you know this? My Wife and I have no money saved and i'm worried about it. I'm Australian and we are U.S allies.

    Sam.

Financial position of USC always matter, because he/she has to provide with i-864 or else get a joint sponsor. What I meant was financial position of Beneficiary won't really matter..........say someone from Australia itself living in a very poor condition won't be asked that many questions compared to someone from India with almost the same kind of poverty ridden background.

Also money saved isn't the base out here, but the question is does your wife earn 125% of poverty line in her household.

    Thanks for clarifying.

  6. hey let me know if they approve your expedite cause they declined mines and i ended up losing the baby and then i showed them proof the my baby only lasted one week they still declined it then thry transferred it to csc office and said wait 6 months and i been waiting now 8 months and still havent heard nothing

Sorry to hear that. That's horrible. What was the reason for denying you?

  7. USCIS lost our Case in March this year, we were given two options, wait around and see if they find it, or refile with an expedite, the officer we have been dealing with told us that honestly it would be quicker to go the way we have.

Just wondering did they let tell you how long they expect the process to take with it being expedited? My Wife (sponsor) has just been told her pregnancy is high risk so we will hopefully be able to expedite and im hoping it will be very quick, we filed on April 16 but have not got an NOA1 yet. She's due in October.

    Sam.

  8. Hi People,

I would love to know if anyone out there who has filed an I-130 in April has received an NOA1 yet??? We filed on April 16 but haven't heard yet. My Wife will be contacting the USCIS in the morning as she has a high risk pregnancy and we are trying to expedite.

Can anyone tell me if there will be a fee for expediting and how much faster the process is likely to be? She's due at the beginning of October.

Also, the Dr has now told her she cannot work or she is likely to lose the baby. Will her not working/earning $$$ make her ineligible to sponsor me even if we have a Doctors letter stating a life or death situation?

    Thanks for any info'

    Sam.
