  1. Alright guys, as you can see on my timeline, I mailed my package for I-751 on August 14, 2008.

    It arrived in Laguna Niguel, California post office on August 16, 2008. I mailed it by priority mail

    and with delivery confirmation.

    I checked that delivery confirmation number online and on the phone. It still says that it has arrived on

    the post office in California on August 16, 2008 and is still scheduled for delivery.

    It's been 8 days already but still the USCIS in California still havent got it yet.

    What the heck is taking it so long. My greencard expires on Sept. 12, 2008.

    I already called the toll free number for the usps. They said someone will call me back but they never did.

    Does anyone here knows the number of the post office in Laguna Niguel in California?

    Im worried that the post office might lost or misplaced my documents. My greencard expiration date

    is really fast approaching.

    Help guys!

  2. Don't worry....not until you really have to.

    I sent my Priority Mail/Certified. The last (and only) time it was scanned was when I dropped it off at my post office.

    After over a week I started to freak. I called my local post office service center and they contacted Nebraska for me. The woman I talked to actually gave me a number for a woman down there (in Nebraska) who I eventually talked to. This woman told me that because of the number of packages they get for the USCIS they also log the information in by hand.

    Mine was not there. She said she had two different people check the handwritten lists. She said my package could be almost anywhere and my only option was to file a "missing package" report with my local post office and just hope it showed up. <<By the way, the post office does nothing with the "missing package" report -- they just put it in a file>> I had to wait (I believe) 10 days before I could do that. In the meantime.....my check got cashed.

    Well i checked the tracking confirmation online on the usps website.

    Label/Receipt Number: xxxx xxxx xxxx xxxx 6819

    Status: Arrival at Unit

    Your item arrived at 9:56 AM on August 16, 2008 in LAGUNA NIGUEL, CA 92607. Information, if available, is updated every evening. Please check again later.

    It's been a week now. I am freaking out you guys.

  3. It looks like the application was REJECTED (that's to say NOT ACCEPTED) because you sent a check with a wrong fee.

    It was NOT DENIED. They are telling you to re-file with the right fee. So do it ASAP!

    FYI, applications are rejected when the forms are incomplete or the fee paid is wrong. The process does not even start.

    Once the forms are complete, the fee is correct and evidence is sent, the application is ACCEPTED and the process will begin. It'll be pending for a few months. If they need more evidence they will send you a letter Requesting Further Evidence and/or they may also send you an appointment for interview. After all this the application will be APPROVED or DENIED.

    I think the right word is "REJECTED" and not denied.

    The problem is, i am currently unemployed for 4 months now because I am pregnant.

    My husband is on SSI, so basically he only get checks from the government which is not too much. Actually just enough to pay our bills every month.

    Does anyone here knows if there is some kind of a fee waiver thing?

  4. hey m0306, I just noticed that you BIO appointment was on August 1st.. did you go to that appointment??

    NO I wasnt able to show up on my biometrics appoinment because my husband was hospitalized on the same day!

    They sent you an NOA1 and a biometrics appointment despite the fact that you haven't actually paid for the petition yet? That's a bloody mess!

    Anyhow, don't worry too much, you still have time. First of all, prepare a check for the correct amount and make sure you have enough money to cover it. I wouldn't rely on USCIS to have kept everything, so send everything in again (hope you know what you sent the first time and you at least can re-produce it even if you don't have a second copy of everything).

    I'm still a little confused though. It sounds like they said for you to send in the correct fee. They haven't actually denied your removal of conditions, they're just not accepting the application due to incorrect fee. However, they've already sent you an NOA1 and set up a biometrics appointment? Strange.

    YEP, they sent me an NOA1 and a biometrics appointment despite the fact that there was a problem with the check.

    So now, I have to pay that one and pay another $545 to refile another application.

    I'm just wondering if the NOA1 for that rejected application is still valid?

  5. Ok here I go again. Our case is denied. My husband didnt tell me that there was a problem with the check that I sent to the USCIS together with the application. I just found out that they sent us a letter about the fee and that we should send in the correct fee on August 6, 2008. My husband didnt say anything about this. I just figured it out when I received the letter of rejection for our case.

    So, we still owe the USCIS with the correct fee eventhough they rejected our application. The letter says that we can refile again with the correct fee.

    Here is my questions:

    --I'm just wondering if the extension letter from our case that is denied is still valid?

    --Or do I have to refile before my greencard expires on Sept. 12?

    --Are they going to send back the papers I sent them?

  6. Hey guys, i need some help.

    Supposedly my ASC Appointment was on August 1st. But we missed it because my husband was sent to ER on July 31st at 10:00 in the morning. And he was transferred to the ICU about 3:00 in the morning. And was out of he hospital th next day. So I really didnt have time to call the USCIS in Portland Oregon to tell them what happened.

    Now Im wondering what will happen with my application? Am I going to get denied?

    And if my application is denied, are they going to send back my I-751 package? or should I refile a new one?

    Please help....

  7. Hello guys,

    My husband and I been together for 2 years and 3 months now. I am almost 3 months pregnant with our first baby. We filed for my removal of conditions jointly. We already got an NOA1 and just recently we received my ASC Appointment which will be on August 1st. But I am afraid that my husband and I will no longer be together by the time I will have an interview (if ever there will be an interview). I've been planning to leave my husband since before my 2 year conditional greencard expires. But we decided to give our relationship another chance. So we did. But still things didnt seem right until now. And even though I am pregnant, I am still willing to leave my husband. He dont want me to leave him because I am pregnant and he wants to see his child when I give birth but I dont think it is fair on my side because I am no longer happy with our relationship and I dont want to stay just because of the baby.

    So here are my questions:

    :unsure: What will happen to our joint petition to remove the condition of my greencard?

    :unsure: If ever there will be an interview, and I will show up alone, are they going to deny my case eventhough they will see that I am pregnant? or maybe I will have my baby by then?

    If ever there will be an interview, either I am approved or denied, or let say if I am denied, its okay with me to go back to my home country as Ive been wanting to move back there anyway. But still I want my baby to be born here in the US, so she/he will still have something to do with her/his daddy.

    What should I do? :unsure:

  8. It only took about 10 days from the approval of our I-751 to getting the 10-year green card in the mail today.

    As of August 3, which is 90 days before the 3-year anniversary of getting the green card, I'm eligible to file for US citizenship. The worst part about the N-400 is the $675 fee, so I may wait until September to file.

    when did you file your I-751?

    did you have an interview or not?

    We already got the Notice of Action/ the receipt and recently we just got my ASC Appoinment which will be

    on August 1st, next friday. Here are my concerns.

    I am 3 months pregnant and I am planning to leave my husband due to personal reasons. Well actually, we've been trying to save our relationship because I am pregnant. And thats the reason why he filed for my removal of conditions. But I still dont think that our relationship will work out just because I am pregnant. But he said that I should just wait until I will have my biometrics done, then decide if I still want to leave him. My questions are:

    1. Is there any interview before they can release the greencard? (because I am afraid my husband and I will no longer be together by that time).

    2. If there will be an interview, what will happen if I go by myself without my husband? (are they still going to approved my greencard just the fact that I am pregnant?)

    Honestly, I don't care about my green card because Ive been wanting to move back to my home country. I just dont like it here in the US. But on the other hand, I am thinking about my baby's future. I know for sure that she/he will have a bright future here in the US. But one thing for sure is that I am leaving my husband.

    Sorry for your misfortune that you want to separate (or divorce) from your current husband. Anyways, you shouldn't have a problem filing for your green card on your own regardless if you are still married to him or not. Under the I-864 which he signed, it contains a clause that he, by law, has to support you until you get your green card or you get a job. I'm hoping you can support yourself without him so that UCSIS sees that even though you are going to divorce your husband, you can make it on your two feet. You have to show proof in the interview that you got married without strings attached and that at the time you got married it was out of love. If you can prove with evidences( like photos together, bank account that had both names on the accounts, life insurance beneficiary's, car insurance on both of your names, etc ) that the relationship was real and not some personal gain just to go here to the US, then you will mostly will get the 10yr green card even if now you have differences.     Thank for the reply. Our marriage is genuine. We were such a happy couple before but as time goes by somethings changed. I am not happy with my husband anymore. Ive been wanting to leave him before but decided to give our relationship another try. But still things are just the same until I got pregnant. And now he wants me to stay because I am pregnant. And I dont think its fair on my part. I think I can raise my baby without him either here in the US or in the Philippines were I came from. I worked before but only part time because my husband is under SSI and Social Sec, and because of that I am not allowed to work full time. Right now I am no longer working since I got pregnant. But still I am going to leave him and he knows that. I just hope that there will be no problems with my papers.

    Thanks! I just thought why the heck they are asking us to send those documents again because we already did. That confused me a little bit. The date on our NOA1 is July 10, and we received it on July 18. So I guess we'll just wait for the ASC appointment to come. Hopefully soooner...Thanks everyone for the inputs!

    Okay, we got a letter from the USCIS, I-797C Notice of Action and here's what it says:

    ***The Above Receipt Number Must Accompany All Inquiries***

    Your conditional resident status is extended for a period of one year. During the one year extension you are authorized employment and travel.

    In order to further process your petition, you will be receiving an Application Support Center (ASC) appointment notice with a specific time, date and location to capture your fingerprints, photo and signature. You must wait for your ASC appointment notice before going to the ASC for biometric processing.

    NOTE: Conditional resident applicants, including conditional resident dependents residing overseas pursuant to military or government orders, WILL NOT RECEIVE an ASC appointment notice. To complete biometric processing, these applicants must submit the required items listed on the I-751 form instructions.

    If you have bot already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence.
