Have a close friend who has over stayed her tourist visa. She ended up getting married near the end of her tourist visa. But her new husband was slow to get papers filed. Now they are looking to get her papers in order.

What steps need to be taken from this point on?

  3. Hello Everyone,

Another January Submitter Story. A bit long.

My interview was today for 9:35 in NY.

My husband and i got there at 8:00 very early but the officer said we were too early and to come back at 9:00 lol.

We didn't walk around, i didn't want too so we sat at on a bench facing the building until 8:45 lol then we went in.

We were sent to the eight floor to sign in. I handed in my interview letter, the lady checked my A# and told me i'm early because they had me down for a 10:30 appointment. She looked at my interview time and realised that THEY were wrong said its ok gave me back the letter and sent us down to the fourth floor. I gave the the interview letter at the window and the guy took it and stamped it or something.

The room was crowded we managed to get the last two seats in the back. I noticed some people had lawyers and some didn't. My husband and I didn't. I wasn't as nervous as i thought i would be. We didn't sit there to long, we were called in pretty quickly even before some people we noticed were sitting there before us.

Our interview officer was a lady. She swore us in and then the questions started.

Our full names, date of birth. She then turned to my husband and ask him how we met, what did we do on our first date, where did we get married, on what date.

She turned to me and ask me, what is my husbands parents names, where do they live? City and State, what are there jobs, what's his brothers and sisters name and where do they live. She ask me where was my husband born, which was Hong Kong, how long did he live there? She was surprised i even knew what city.

It got tense when she turned to my husband and said.

You guys have been married a year Mr Zavelle, why didn't you open a bank account with your wife sooner? How was she getting money? Why wasn't i on his work benefits? I tried to answer that and she put her hand up to silence me.

My poor husband got nervous right there and he stuttered an answer. I don't think she was satisfied with the answer so i asked her if i can answer it. She let me, so i explained to her that we did try to get me on his account but his bank didn't accept me because i didn't have a SSN. I told her on get on his insurance i need a SSN. She was satisfied, turning back to him she asked him how long we've been living together. My husband blurted 2yrs, which was wrong, i turned to tell him this but she put her hands up to silence me again.

She sat back and ask him if he was sure, he nervously replied a year and a half. She turned to me again, the answer was at the tip of my tongue, she smiled and turned and ask my husband why didn't he know how long we've been living together.

He told her he was feeling very nervous and then he answered correctly. She asked me if i know how much tax return we got back or something like that and i told her i couldn't remember.

She ask my husband about our wedding. Why wasn't our parents there? She asked him if his parents didn't attend because we were an interracial couple *wow* he explained we just wanted something simple. I was going to say something but she turned to me and said if i interrupted again she would end the interview. *wow* i apologized and looked off into space lol. I listened to her grill him some more about unnecessary stuff. She had to call me by name for me to answer another question lol. I knew she could tell i was annoyed with her questions. She then ask to see our proof of marriage. I gave her a big smile and pulled out everything putting our large album on top.

She looked through everything, lease, bank statement, marriage certificate, letters from family, she even opened up a card and read it twice lol. I was anxious to know why she read it twice. It was a card from my father-in-law, hoping that i was able to travel and visit them in New Mexico this year, that he had so much to show me in the marvelous South West lol. 100 points for that card. She took 3 of our pictures, with us together. One from our Wedding, our Honeymoon and Christmas 2008..

She gave us everything back then started to ask me question that i kept saying NO to. Stuff about crime and Terrorist and all that.

She then wrote something in my passport PENDING I-485, Section 245 Interview, the date, A#, (ISO) and her name and state. She told us they would contact us in 60 days when they come to a decision *WHAT?* I was hearth broken, i smiled and thanked her and she asked for my work permit because she needed a copy. We waited in the room with the other interviewers for about a minute, she came back, handed me my card and i gave her a big smile and told her thank you, while i shook her hand. She smiled back and gave me a firm hand shake.

My husband and i didn't speak till we were out of the building, then he told me he was so sorry for getting a question wrong. I held his hand and told him it was ok because it was, i didn't get a bad feeling about our interview at all. She was just doing her job and she was very good at it lol. I got home called my mom, who wanted to know details down to what the lady was wearing. My mom thinks she's a clairvoyant << don't ask lol she told me they would contact me before 60 days. I smile told her i hope so and told her i'm going to take a nap.

I was so tired from being tense up all morning. I slept the day away. While writing this experience i saw a red light on my black berry saying new mail. I almost dropped it when it said Case Status Information for Receipt Number:*************

I sent this file in January. Never got an update till today, i switched over to Gmail and right there it read.

  4. kcoyclay1 - I am sure you will get your approval letter soon. I wish you all the best and share the good news with us as soon as you receive it :) - Now CHEER UP!!

I am walking into our interview on Friday - May 8th. I am little nervous to be honest with you as my wife entered the country on B1/B2 visa while she was already married to me. Not sure what is coming our way, but I certainly hope for the best.

i-migrate thanks so much and all the best. I received my welcome letter today for permanent residency. It was approved (April 30) the day after my interview and mailed out the day after it was approved (May 1). I am on cloud nine.  :whistle::innocent:

Congrats Kcoylay1. I just read about ur interview in NY. My interview is in NY as well, i hope i don't have that frustration. But congrats again.

  6. Not to frighten you but - are you aware that adjusting this way has no right to appeal? Do you have evidence that you intended to return to your country of origin if it comes up?

Real scary question. But i have been living in the US for the past 7yrs, I married my husband after living together for 3yrs, i have a 4yr old son who is a citizen. If they send me back...damn. I guess i will go if i don't have a choice.

You should be fine, you don't seem to have immigrant intent since you didn't file for adjustment just after arriving. Nice to see another trini!

I disagree, she may very well be fine (who can say that here based on the very few and mosty convoluted facts) - but when filing AOS has no bearing on if they may see this as fraudlant.

If I were in that position - I would be heading straight to an AILA attorney to ensure all my bases are covered.

More scary: I'm not using a lawyer, we are doing it all on our own.

Then good luck to you. Just know that people giving you "advice" here are simply lay people. Even a consultation would be more than wise IMHO.

I appreciate any IMHO i can get LaL. Thanks

Hello Heliosphan, another Trini yeah. As you can see LaL is rocking my whole a little. But I'm standing firm.

  10. The I-130 is not necessary, only the I-485 in your case (which I gather is a K3 adjusting status - not sure about that bit about getting married last month that doesn't seem possible). See this guide: http://www.visajourney.com/forums/index.ph...mp;page=k1k3aos

Yes, file them together if adjusting status from a tourist visa.

Did you have immigrant intent at your last entry to the U.S.?

Ok Got it, now where do i mail it to the Chicago lockbox or something.

  11. Then why would you need a visa? Visas are for entering the country. Are you planning to go back? What visa did you enter on?

No lol not filing for Visa. Ok don't laugh and don't be fustrated with me. I entered on a visitor visa B-2. I really have to change that profile. Sorry for the confusion, i seem to be saying sorry a lot. I'm working on my profile. I was wondering, so we have finished filling out the forms. Do we mail it all together or separately.

  12. Your profile states K1, you are posting in the K3 forum, and are asking about filing AOS stateside? No one can answer your questions without more information.

I'm K-3, the K-1 was a mistake sorry, haven't figured out how to change it just yet. I'm a newbie so i'm still on shaky ground. Yes i'm filing for AOS. We just got married and i'm trying to figure out what to do next. I'm reading around a bit.

I've filled out the necessary forms and such.

  13. Can i mail out the I-130 and the I-485 forms together, same package? I know this won't speed things up but i've just finish up with the forms and i was googling a bit and i saw it mentioned somewhere. Is it possible? And if YES do you mail it in the same place?

Yeah it's probably better to do it together!

Can i get a little more details. So i mail these both forms to the Chicago lockbox right.
