  1. We just got devorce and I got my 10 years green card two month ago. I read on internet if I am married with the same woman than I am eligible to apply for the citizenship after 3 years otherwise i have to wait for 5 years. But if I remarry with her again after 2 years am i have to wait for another 3 years or not ?

    what is your"Resident since" date on your greencard?

    It is my understanding that your path to Citizenship solely relates to the length of time you have had your green card. If you got your green card thru marriage you can apply for citizenship in 3 years from the time you got your green card. I assume you were married at the time of AOS where you got your "conditional" status removed?

    but isnt that only if he has remained married to the same women and lived with her the complete three years? i thought that if there was a divorce or separation that he would have to wait until the five years was complete.

    On the 3-year anniversary of our becoming a Permanent Resident - if still married - you will qualify for Naturalization. You may apply for naturalization as soon as 90 days before this anniversary date.

  4. Hi guys: Can any one please tell me what is additional review is that? 4 years wait then 2 intereviews after background checks were completed now they sent me a letter in April 2009 to waint for another six months because of an additional review required.

  5. Latest is the application is on hold by the judicator. I asked to the customer serivces that how long the judicator takes time to make decession and she said she dont know. I just want to know after 4 years if they deny my application then what i do after it ? Can they send me to the immigration court ? I can go with my wife their too.

  6. I dont want to go their. Its 5 hour drive as the office is in atlanta and i live in alabama. Can you please tell me what they can do else as I have been married since over 4 years and a very happy life. I think may be only thing they can do is to hold my file for few more years I am not worried about it as long as i get the new EAD.

    I think you really missed an opportunity at the first (as well as the second) interview. Since you were married for nearly four years, you should have brought tons of evidence of living together and commingling of finances at the AOS interviews. Lack of evidence, after so many years of cohabiting, is in itself a red flag. Also, different ethnicities (my assumption) may also have contributed to extra scrutiny.

    “Background check” is a delay tactic that USCIS uses excessively. The USCIS often delays cases with so called “red flags” to see if the marriage stays put for an extended duration. But if your relationship is for real, you will eventually get it.

    Make an infopass and take your wife with you and let her talk to the officer. I personally believe that it does make a difference when the petitioner shows some interest as well.

    I was called for my first interview on November 23rd 2008 after close to

    four years wait. I married in NY in February 2005 with a American citizen

    and moved to Alabama in 2007. I came on H1B visa in 2002. My H1B was

    expired in August 2005 but I married before it expired. Ok since I moved

    from one state to another I don’t have a lot of documents during first

    interview in Atlanta. I have joint tax returns, my job letter some mails

    and my wife school information in NY, as she is still a student in a

    school in Alabama. He kept the I-95 from my passport in first interview.

    After first interview he said that we don’t have enough evidence but he

    didn’t said any thing about his decision. He called us for the second

    interview on January 9 2009 at 8:00 AM again in Atlanta. Ok this time he

    asked separate questions first from my wife and then from me.

    told to him and question 9 I told the name of the movie, which was

    different from my wife answer. Q 19 has a dollar difference between her

    answer and mine. Rests of all questions have same answers.

    He check my passport again and asked me what was my occupation when I

    entered into the united states and I told him that I am a computer

    programmer. The new evidence, which I showed to him, was the joint bank

    statement of March, April 2006, as he wants the old stuff. He kept the

    statements my job letter evidence of my wife shows about her admission in

    the school in NY, pay stub of the place where she works in NY and other

    stuff, which are the mails in NY and Alabama and the pictures of thanks

    giving in which I am with the whole family include my father in law, my

    brother in law and his kids. Also he asked me about the lease I dont have

    any lease as I have a trailer which is parked on my fater in law property

    and he dont charge any money from me. He told us in the beginning that he

    will not tell the decision. I will get the decision in mail within 2

    weeks or if I don’t receive the decision within 2 weeks than wait for the

    6 months and then come to the uscis office and ask for the status of your

    application.

I called today in the customer services and they told me that the application is on hold in the review department in atlanta office. It could be take another week or 60 more days.     Hi guys: Today i give the interview in atlanta office. I showed my last year tax return, my driving license and my wife US passport but he said that its not enough evidence that you both live together. My wife passport and my driving license both have same address. After that he asked my wife about my date of birth where we lived before as we moved two years ago from NY. And she gives all correct answers. Pictures of wedding we showed it to him. He talked with us like half an hour and in last he said that we will get the decession within a month in a mail. Also he check my passport and take off the I-94 card from it and keep it. Now I dont know what i do as i get this interview after over 3 and half year.

    He talks nice at the end of the interview when i told him all of my previous addrss looks like he is satisfied but he didnt stamped any thing on my passport just take off the i-94 card from it.

  13. Thank You Shakil I try to go for that lawsuit as really it dont looks like easy for me but I think I have to go first the district court to get the civil prosec package. Also I talk on USCIS number and they told me that my name check is completed but they also dont know why the application is still on hold. I remember when i got my second work authorization card which they give it to me after one year of the expiration of my first card. Luckly the third card they sent it to me before the expiration of my second workauthorization card.

    Well, I was able to file a mandamus and got my case approved within 10 days. PM me if you need more details..

    I read laws under which a mandamus can be filed. I registered for PACER (Electronic filed court cases) system online. Searched for prior cases either running or recently ended. Reviewed the points that they made. I was encouraged when I found the fact that not one of the case failed on there.

    Its not the court that does anything. Its the DA. When you send out a summon to USCIS and to the attorney general after filing the case, it pushes them to resolve the case before the court date reaches. It only cost me $350 filing fee.

    I would recommend you start the same way. Also visit immigrationportal.com and visit the citizenship forum and read the posts there by lazycis and others. Alot of previous cases (documents) can also be found there if you want to look at some more cases.

  15. Can I eligible for the student loan I have EAD valid till November 2009. Also I have credit cards playing since 5 years and my car which is also on bank payments.

    Many of us can relate to your frustration Rasheed. you have been waiting VERY long so LaL does have a good point about visiting the office. Maybe with the memo in hand they will actually push for someone to look at your case. On the other hand, wait to see what the Ombudsman says if you don't want to drive to Georgia.

  16. my husband waited 3 years in name check and finally got the green card after they made some agrement to clear out the back log. we still dont know if he was officially cleared or just a part of the agreement.

    I am waiting since june 2005. They call me in 2005 for the interview and then they cancell it without any reason. Send me the same ####### to wait for 6 months and now 6 months is converted into over 3 and a half years and still application is in pending.

  17. Hi guys: I got my third work authorization card without any problem. This is unusuall they give me a lot of hard time in my two cards. Also the uscis customer services told me that my name check is also completed but they dont know why my i-485 is still on hold. Any suggesstion?

    I dont understand these two lines. It says first process all name checks in February 2009 and then it says June 2009 process 98%. Also is their any hope after june 2009 i mean if they still hold my application after june 2009 then what i will do?

    February 2009 Process all name checks pending more than 180 days

    June 2009 Process 98 percent of all name checks within 30 days and process the remaining two percent within 90 days

    These are their benchmarks. As I understand it - their goal is to be on the workflow where all gc applications are to be processed within a certain time frame - by June 09 they hope to process most by 30 days and the remaining within 90 days.

    As an aside - this memo does *not* mean greencards will be approved in 6 months now. I have seen several people posting such. It is a goal at this time, although the majority *are* processed in 6-7 months.

    I really have no idea what the benchmark would be for you as you have that I130 issue.
