  1. May 6th is the 90 day mark for sending in my wifes paperwork for removing the conditions on her green card. Well we found out today that her father is very sick. We are also in the process of getting her daughters visas. As I understand it we file the paperwork, they send us a notice saying they got the papers. Then they send us a notice for the interview, but that second notice is also a 1 year extension on her existing conditons.

    Is it possible for her to file the paperwork then travel to see her fanily, finish up the visas for the kids and then schedule the interview for when she gets back

  2. Sorry for the Noobish questions...I did my wifes Visa thru DCF, now we just got her daughters petitions approved. So I just got the 797 saying they forwarded the case to the NVC. Whats next in the process...How will I know when the Consulate in the Philippines has the case?

  3. Im getting ready to send off my petitions for my step daughters and Im in NM. So I look at the processing dates for texas and it doesn't show I-130's... California is the only one that shows any dates for I-130's...

    If california is the only one doing I-130's do it still have to send mine to texas and wait for them to transfer or can i send it straight to california?

  4. If the children were not 18 at the time you got married, you may petition them as a stepchild. you would file a I-130 for each one.

    if the children were illegitimate, they would be in the sole custody of the mother. the father's name not being on their birth certificates will not be a problem. you will not need his permission. some may disagree with this, but it's in the Family Code of the Philippines.

    I know from personal experience.

    obtaining tourist visas for them could be very difficult.

    Im military, I was stationed in Korea, where I met and Married my Wife. We filed her I-130 at the embassy in Korea. It wasn't approved by the time I had to leave. I came back to the US, she went to the Philippines. They approved her petition and I had it transferred to the embassy in the Philippines where they finaly issued her CR-1 Visa. My stepchildren are 7 and 9, and were as you say illegitimate. Their is no father listed on their Birth Certificates.

    Now, Im looking for the fastest possible way to get them here. I was reading about the K-4 Visa...is that an option since my wife came over on a CR-1? Is there any other options other than filing the I-130, waiting the 6 months or so for it to be approved then waiting another 4 or so months for their visa to be issued in Philippines?

    Everywhere I look for help I keep reading something along these lines:

    If your child or son or daughter is legally in the U.S. when an immigrant visa number becomes available (or if one is not required), he or she may apply to adjust status to that of a lawful permanent resident using the Form I-485.

    How can I get the here Legally while we wait for the process?

  5. Well me and my wife were just dealt a devistating blow. After misunderstanding the instructions on the US Embassy web page about how to bring over our children, we found out that it only applied to K visa and not Immigrant Visas.

    So right now my wife is on her CR-1 Visa. I take it I need to file a I-130 on there behalf. Whats the fastest way we can get them over here? Also there fathers name isn't on their Birth Certificates...Will that cause any problems. And Would it be possible to get the over here on a tourist visa, while there Immigrant Visa is Processing? Obviously not to stay and wait till its done, but maybe have them here for a month or so then we can send them back to finish waiting?

  6. I filed for my wifes visa at the embassy in Korea while I was stationed there. We are both now here in the United states and I'm trying to get our daughters over here. They were listed on her petition but we didn't file seperate petitions for them. According to the US Embassy Website where I got the following:

    The spouse and children of a principal applicant are entitled to derive immigration benefits from their principal’s approved visa petition and may travel to the United States at a later date. Under no circumstance will the derivative spouse or child be allowed to travel to the U.S. ahead of the principal applicant.

    Following-to-join applicants may derive immigration benefits only if:

    a) the spouse or children were acquired before the principal applicant’s admission into the United States; and

    B) the principal applicant gained lawful permanent resident (LPR) status or was issued an immigrant visa under the family-preference (F) or employment-based (E) visa categories or was issued a nonimmigrant K or V visa. Foreign nationals who immigrated to the U.S. under an immediate relative (IR) visa category need to file a separate Form I-130 visa petition on behalf of their spouses and children.

    c) the principal applicant has not naturalized. Once the principal applicant becomes a U.S. citizen, a separate visa petition would need to be filed on behalf of the spouse and /or children to qualify for immigration benefits again.

    She is on a CR-1 Visa...Does that mean we need to file seperate I-130 petitions here in the states and wait forever to get them here?

  7. According to that Site and this quote "the principal applicant gained lawful permanent resident (LPR) status," does she fall under that category with a CR-1 Visa? And If so, what does all that mean. I can just fax them the info they request and they will pretty much just issue instructions on how to apply for a visa? No petition required?

  8. I've already been there and read it over. But like I said, Im not familiar with filing over here in the states. I filed in Korea with my wife.

    But let me give this a go. And correct me where I am wrong.

    I file the I-130 at the Texas Service Center.

    Then wait the year or more for them to approve it.

    The Packet 3 or whatever is sent to them in PI.

    They wait another 6 months for an appointment date in PI to get there Visa's.

    I miss anything?

  9. Guess I should have put more info. They are 8 and 10 right now. They were put on her petition that we filed at the consulates office in korea, but we didn't file seperate petitions for them. Now that we are back here in the states I need to know the process.

    Also, when you guys are talking about putting them on her original petition do you guys mean Section C Line 17? Cuz thats where I put them

  10. Well we finally got my wifes visa and got here over here :)

    Now we need to get her 2 daughters here. Since We did a DCF for her visa Im gonna have to read the guides on here to get them over here, I take it I need to file file 130s for both of them and send them off to texas ( I live in New Mexico). And go from there.

    Anybody have any idea of the wait we are going to have to deal with?

    If anyone has any other tips or info, it would be greatly appreciated.

    What forms will she pick up from the hospital? I already have to DS-230 and I-864 done, she has her supporting paperwork ie birth certificate, tax records ect ect.

    Also as far as the Police certificates, she doesn't have one from korea...and on the us website that list how to get the certificates, it states on there that there is no way to get a certificate for people out of the country. Will this be a problem?

  12. Has anyone transferred their case from Seoul to Manila after the 130 was aprroved? How long did you wait? Im trying to figure out my options. My wife called the korean embassy in PI to get info on a visa back to korea, they told her she needed a letter from me, a letter from the embassy in Korea and a bank account with a good mount of money.

    So I am trying to figure out the fastest way to get her visa done and issued because there is a good chance I will be getting deployed in September for 4 months.

    Any advice you guys can give would be great.

  13. What should I do, I filed my wifes petition in Korea and it just got approved. Now I have been looking at appointment dates at both embassies and it seems that they are both filled up till the end of june / beginning of july. Due to financial issues, im trying to figure out whats best. Have my wife wait for a Korean tourist visa and fly to korea, have her do the interview there then fly over. Or have the case transferred to manila and then have her do the interview in manila then fly over.

    Any thoughts or inputs?

    Smart move keeping the case in Korea. Manila is so backed up it's not even funny.

    Make sure she has some proof of your valid, ongoing marital relationship, current sufficient financials from you and clears her medical. Make sure she's got the right custody/clearance to bring the kidlet with her. Think positive thoughts. :)

    Congrats again on the good news. Isn't it annoying that you'll never know *what* exactly got them moving on it? :lol:

    So by that list, if i was married to a person like that, I SHOULD be deported lol.

    Pretty much all the paperwork is done, already has her medical done, ect ect. She just needs to get a korean background check, and I need to send her my 05 tax return.

    AS far as what got them going who knows? Since April, I have had a senator and congressman's office talk to them, and about 2 weeks ago I seent off three more letters, 1 to a congressman and senator here in New Mexico and one to the Director of CIS. LOL, who knows maybe the director's office did something. At least it looks like i'll get to see them before i goto the desert

    I dont trust having the case transferred and her waiting 8 months longer in PI

    Now when she goes to korea to file her packet 3 and do the interview, what reasons could they deny her for, since the 130 as already been approved. Im just trying to prepare for the worst case scenario.

  17. Did you ever re-try Seoul? You need to find out which office physically has your I-130. I think it is Seoul. They may be able to get some action out of Manila if they're waiting on Manila (find out *who* in Manila they are waiting on--could be a phils gov't office, not the USCIS office).

    kelly: errors in your visa would be from the Dept of State IV folks, not USCIS? I know, two flavors of the same dish. :)

    I have called Seoul many times, only thing I can get out of them is they are waiting on Document Verification from the CIS Office in Seoul. They aren't very helpful when you ask them anything beyond that. I will call Seoul again and have them put an American on the phone so I can see if they will do some type of inquiry.
