  1. Hello I am new in this forum and wonder if you folks can help us. I am currently living with my bf for aprox 6 months.

    We are planning to get married in the summer, could we file taxes together using his ITIN number?? I am wondering if the IO will ask for his tax returns even if he has not been working.

    BTW he came on a tourist visa and overstayed without the intention of getting married

    You said you are planning to get married this summer. Which means that are not married now, nor were you married during any part of 2009. Therefore, to the best of my knowledge, you cannot file taxes as "married filing jointly", for 2009. If you are referring to tax year 2010, there is a long time yet in which to file for Adjustment of Status after you are married this summer, and then obtain your Social Security card and number.

    Maybe I'm missing something in your question here.

    I'm in the process of filling out all the forms for my wife's AOS. she's a F1 holder and currently living in the US.

    We got the marriage certificate and she has changed her last name.

    In section " C. Information about your alien relative.." on from I-130, should I use my wife's new name? YES

    Also, should I use her new name on all of other AOS forms as well if they're not asking for her maiden name? YES

  3. I very seldom advise people to ignore another poster but I am saying with the authority of my experience and years on VJ to ignore Mustafa1232.

    I will have to second Kathryn41's advice on this one. Never have I read a more confusing and incoherent (not to mention, incorrect) post here then these:

    We have now gone through almost the entire AOS from B1/B2 process (with the exception of removal of conditions). Successfully, I might add. Nevertheless, in spite of that, I often restrain myself from providing an answer to somebody's question here, for fear I might not have it "quite right", and that there is perhaps somebody on this forum better qualified to answer. I do this simply because I would never want to be responsible for giving somebody wrong information. I practice this conservative restraint from any impulse I might have to post my "two cents" worth, because peoples' futures and lives are at stake here.

    So, why am I posting this now? Simple. PEOPLE!! These "answers" are read by and acted upon by people here. And they make decisions and take actions based on the answers they read here, decisions that very well could and probably will affect the rest of their lives. Please keep that in mind and be very careful when providing answers here. Otherwise you could find yourself responsible for affecting somebody else's life in a very adverse way. Please be responsible to the community.

    P.S. It was not my intent to offend anybody. But this just needed to be said as a reminder of what we are doing here.

  4. Wow i'm so happy for you guys. Just got home... Bryan (my hubby) and I went for dinner after work this evening, at a gorgeous restaurant on Lake Tahoe - it was so lovely. Also got my first pay check today and my new CA driver license in my married name complete with a cuter pic than I was expecting... a good day for all of us I think :thumbs:

    WOW! First pay check, new CA driver's license, AND dinner. I'd call that a triple-header. :thumbs::dance:

  5. We received the following e-mail notifications today at 3:46 CST from the USCIS site. One set for Maddy and one for the kiddo.

    On January 26, 2010, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN.

    On January 26, 2010, we mailed you a notice that we had registered this customer's new permanent resident status.

  6. I had considered filing my 2009 tax returns and taking a copy of that along for the interview. The reason I did not is kind of a circular problem. I had no problem providing Maddy's social security number on the tax return, since she's received her EAD card and we were able to get her ss card based on that. However, we will not be able to get the social security card for our daughter until we receive her green card. So obviously, I wasn't able to include a ss number for her on the returns. My only option was to not list her as a dependent. I thought it would be better to wait until after we get her green card and then her ss card, so that we could then provide her ss number on our tax return, not for any financial benefit in filing, but merely to be complete and precise. Now if it's decided by USCIS that they want to see our 2009 tax returns, we will have to go ahead and file the return without including her as a dependent, so that we can provide a copy of that to USCIS.

  7. Interview Day: Interviews were scheduled for 9:30 a.m. (Maddy), and 10:00 a.m. (daughter). We arrived at about 9:00 a.m. to the Milwaukee, Wisconsin USCIS office. We arrived upstairs in the large waiting/seating area, and dropped our interview letters into the slot outside the door into the offices, per instructed, then waited. At approximately 9:15 a.m., an interview officer of what I think was Indonesian descent, opened the office door and called our names. All three of us followed him in to his office, , where he swore in Maddy and myself. We then all sat down.

    He first asked us for our indentifications which we provided. He then began asking me a bunch of questions, i.e. "is your birthday ......."?, is your address........."?, "is your phone number......."?, "is this your signature"? I found it interesting that he wasn't actually asking me the questions, but merely whether or not the answers he already had in his file, were correct. Then he began asking Maddy the same series of questions, with some additional questions pertaining to her only. He then asked Maddy the customary "have you ever...."? questions. When he finished with her, he then began flipping through the pages of his file on us, which was about 2 inches thick, and asking various additional questions. My perception was that he was merely verifying some of the information he had on us in his file.

    He then asked our daughter if she was off school today, and a short conversation with her about school, her friends missing her today, did she like school, etc., which lasted about one minute.

    He then asked me if we had filed our 2009 income taxes returns yet. I told him we had not yet filed, though they were completed. He said that was okay, and only if he needed a copy of that, would he contact us and request them. Then he flipped through the pages of his file a bit more, verifying a couple more items. Then he asked us if we brought any other papers for proof of bonafide marriage, at which time we gave him a copy of our joint bank accounts, life insurance policy, joint lease, and copy of a joint membership card at Sam's Club. He stapled all of that together after very briefly looking them over, and put them into his file. I also informed him that we had a picture album and asked if he would like to see that. He answered that he didn't need to look at that..

    All this time he was asking us questions or looking at things, he was checking off items, or circling items, or making small notations on various papers in his file. After about 20 minutes of this, he indicated that that was all he needed, and he would review everything and let us know. I got the impression that he merely wanted to go over our case to make sure he had all the necessary information. I got no "bad vibe" or anything like that from him. There were no questions of "how we met" or anything pertaining to "intent to immigrate", or anything like that.

    All in all, I would describe it as a pleasant and professional interview. Certainly we would have liked to know right then and there what our approval status was, but I didn't think it wise to push the issue. Perhaps that isn't how he operates. But, I'm pretty comfortable that after he reviews everything, we will be notified, and I'm mostly confident that there will be no problem and we will be approved. I base this merely on my own speculation and the flow of the interview, etc. The fact that no conversation regarding intent to immigrate, and not even questions about how and when we met, indicates to me that there were no issues there. I'm also assuming from the fact he didn't even need to look at any of the pictures we had brought, that he has no real issues with whether or not we have a bonafide marriage. I think he just wants to review everything to cover his own #######. I'm sure they operate with some sort of accountability to somebody for making sure they've done their job properly.

    So, now we'll just wait to hear back, and I'm guessing that we should hear something within the next couple of weeks

    That's about all I can think of right now.

  8. We are in Wisconsin, very far south, just north of the Wisconsin/Illinois border. We went to Concentra - Occupational Medical Center - 358 Junction Road, Madison, WI 53717, 608-829-1888 for our medical exams. The cost for the exams is approximately $150/person (we needed 2 medical exams) depending on whether or not your immunizations are up to date and you have a record of that. In the event that you have no proof of required immunizations or you need immunizations, Concentra suggested we go to the county health department where we live to get those up to date and provide necessary documentation. Once that was taken care of, when we returned to Concentra the second time to check the TB screen, we took those new records with us, which fulfilled the documentation requirement for Concentra enabling them to complete the paperwork. The county health department provided the necessary immunizations and documentation for far less money then Concentra would have charged us. They charge $15/immunization/person for adults, and they are free for children.

    The interview and biometric processing is done at the USCIS office in Milwaukee, Wisconsin, which is located at 310 East Knapp St.

  9. Maddy's EAD card arrived in the mail today. So we'll be off to the Social Security office tomorrow or Monday to get her Social Security card, and then off to the Department of Motor Vehicles early next week also for her driver's license. I'm curious about one thing however. I know the Social Security office will issue her an SS card without any problem based on her EAD card. What I'm not so sure about is how or even IF they will issue her daughter a social security card.

  11. Kinda strange and not quite sure what to make of this: Today at 8:01 a.m. CST, I received another e-mail from USCIS, stating that production of EAD card has been ordered as of 12-31-09. Bare in mind that I had already previously received this exact same e-mail notification (with the exception of the date of production ordered being different) on 12-28-09, where it stated production of the EAD card had been ordered on 12-28-09.

    With this in mind, I signed onto my account at USCIS website to check the status. The USCIS website shows a "Last Updated" (touch) of 01-10-2010 now for EAD (previously it had shown a date of 12-28-2009). The site also shows a Last Update (touch) of 12-31-2009 for the AP (travel document). I am assuming that this can be interpreted as meaning the AP travel document has now been approved also? (though I am really not certain about this).

    I'm just kinda curious as to why I received a second "production ordered of card" notification with a new date on it. How can something that has already been ordered, be ordered once again? LOL. I guess the only thing I can deduce from this, is that (once again) USCIS has demonstrated that they really have no definable consistent system of processing AOS's. :P

  12. Went out to check our mailbox today (Christmas morning) as we hadn't checked it for a couple days. Found a nice unexpected Christmas present in there waiting for us from yesterday (Christmas Eve) most likely. Our interview letters had arrived, with interview dates of 1/26/2010 (notification date of 12/18/09). Nothing has shown up on the USCIS site since the last touches on November 17th even though we did our biometrics on December 14th. Nor have there been any e-mail notifications since then. In spite of no notifications or touches, we received our interview letters. I'm not complaining, but rather just trying to figure out the rhyme or reason to USCIS procedures. I'm just a bit surprised that we received our interview letters before any touches or notifications, and even more surprised to have received them before any EAD or AP notifications or updates. I guess they really have no consistent rhyme or reason. LOL :wow:

    That is correct, IstanBulls. Biometrics DONE! We were in and out of USCIS in about 15 minutes. And that was for TWO biometrics, Maddy's and the kiddo. 3 hours of driving for 15 minutes. LOL Anyway, the people there were relatively pleasant and efficient. And it gives us more of an idea where to go and the procedures when we go back for the interview.
