  1. My wife has a K3 visa here in the US which is good for 2 years (she's been here ~3 months). I have to travel to France in October for a week for my job and I want to take her with me. I know she will need a Schengen Visa to let her into France. But it it OK that she travels out of the US and back on her K3 visa? I know it says on VJ that with a K3 you can leave and re-enter the US for 2 years multiple times, but the guide for filing Adjustment of Status here on VJ also has an optional form " I-131, Application for Travel Document". We have filed her AOS but did not file this I-131. Do we need it to travel to France? If she can leave and re=enter the US for 2 years, why is there even an I-131 option with the AOS?

    I-131 is mostly for K-1 visa which is a one time visa. K-3 visa is a multiple entry visa so you can safely travel to France and come back.

  2. Well....I'm one week away from the interview and I'm starting to feel anxious. I'm going to collect the police certificates today and the only thing I have left to get is the medical report (called the doc's office and they said it's not ready as yet). I've put my documents together and also all the "evidence" of martial union that I have that's portable :lol:.

    Just got the phone call that the visa is ready for pick up, so we are leaving Kiev to get Natasha's things at her house, and 27th flying home to Michigan.

    Glad to hear it. How many days did it take for the visa to arrive?

    It took them 48 hours to print it and we picked it up at the FedEx at the consulate. I guess it would have been delivered the next business day which would be tuesday, because Monday is a holiday.

  4. I did not have any income in 2005-2006, and did not file a tax return.

    In 2007 I earned $51,000, this year my salary + bonus is expected to be $71000.

    I have $65,000 in cash accounts and also own a two-bedroom coop apartment.

    Is this 100% safe? Or should I use my mother as co-support? I-134 does not specify where and how to involve a co-support. I didn't see anywhere on the form where I can fill this in.

    For I-134 you are only required to have last year's tax return and W-2.

    Why would the agency (and what kind of agency?) need a new birth certificate from her? How do they explain that? I don't see why they would request a new one... Is hers incomplte or smth?

    We are so far ahead of the game and already getting Packet 3 filled out and ready. Svetlana has all vaccination papers, is in process of going to Ukraine Police to get police records from Russia and Ukraine and this will be valid for ONE year as stated. I wanted her whole packet 3 filled out so when I arrive Sept 5th, we can check for errors together and make sure all is ready to go.

    She already has a passport from 2005 when she traveled to Turkey from Ukraine, and is supposed to have this translated per agency advice, and back then , she showed her birth certificate and did a minor police check at that time and received it, but the agency is telling her now that she must apply for NEW Birth certifificate from Belomorsk where she was born in 1967. She sent letter over a month ago and two weeks ago, got reply that they sent it to local town office in Ukraine, but nobody can find it or can say it was EVER received, so she is still waiting for this, as she feels she NEEDS this to get police background check in the works, as some say it takes 3-4 weeks to come back from Russia??

    My question is, Does she eveen NEED this new birth certificate (whats wrong with old?) and shouldn't she be able to get the police check going NOW, even if she doesn't have a NEW birth certificate

    She is afraid she will never get this and i am wondering if she even needs it? What does one do if born in USSR and some Boris who doesn't like Ukraine requests NEVER sends you this certificate for ANY reason. I am thinking we could use old and attach letter from Belomorsk saying they sent it and then explain that it never came???

    Any help would be appreciated

    A couple of things: 1. Her original birth certificate should be fine ( it is a 2page green book which was issued by USSR). 2. The police certificate in Ukraine is only good for 6 months, it states so on the certificate. So make sure you get it at the time so it does not expire at the time of the interview.

HAS ANYONE EVER FILED AN IMMIGRANT VISA PETITION ON YOUR BEHALF? YES or NO...hmmmm i just wanna make sure that my answer is correct coz i choose YES since my husband filed I-130 and im under K3 now...PLease reply guys!!! Thanks alot!!!

    You answer truthfully, since you have been filed a petition for you have to say YES

  7. Has anyone ever filed a K1 from outside the US? And if so was it more difficult. I am an American who lives in Russia. The mail service is very unreliable so I would have to use UPS, FedEx etc. If I only have to use them intially that would be OK but if there is a lot of mail correspondance back and forth it would be hard.

    I just received some very sad new from a fellow VJ'er.

    She and her fiance had there interview in Kingston in June and were approved. She and her fiance returned to the U.S. last month and also got married the later part of July.

    Unfortunately, they found out this morning that her Husband's mother passed away, today. They have not yet filed their AOS or AP.

    Does anyone know if there is ANYWAY that he can return to JA to attend his Mother's funeral and come back to the States without having to file a K3 or IR/CR and going through the entire initial process again?

    Any pertainent information that you can offer at this time will be truly appreciated.

    Unfortunately, she is not able to post this question herself because she is not near a computer currently.

  9. I've been doing some reading and it seems that people are getting green cards but they are only for 10yrs.

    Do you have to renew it at that point or by then do they figure you'll become a citizen, or is there another status that you can have that give you permanent residency but not citizenship?

    There is no other status. People have two choices either apply for citizenship after 5 years they had their green card (3 years if married to US citizen) or renew their green card at the end of 10 years.

  10. Probably not the right place for this, but you guys are all so helpful and knowledgeable :).

    I got a new job and get to fill out a W-2 next week. I never understand what to put though, what to claim I guess. It's just me and my husband and he has his own job. No kids. I want them to take out enough taxes so that we don't have to pay come tax time. A huge refund isn't ideal either though, because then you are lending the government money interest free.

    A W-2 is what your employer gives you at the end of the year. I think what you give your employer is a W-3. It is accompanied by a very clear worksheet that walks you through what to claim but it sounds like, if it is just you and your husband, you would put "married" and "2"

    Actually it is a W-4 you have to fill out. What you put down depends if you will have any deductions at the end of the year that will cause you to have a big refund. For example if you will claim a lot of interest on your house, you could add 1 more to the total number, or if you will drive a lot of miles for your job (not to and from work) then you could add 1. If you will not have many deductions then just put down 2.

    I just got engaged to my fiance , I am a US citizen and she is a citizen from Russian Federation, we have been dating for about a year. She was here in US. for about 5 month from Dec 07 - May 08 on a B2 visa. and then she went back home to Russia. She just came back a few days ago from Russia to US, she has a 2year visa, but when she went through border control they gave her I-94 for 1month and put NO AOS and NO EOS on her form. I was originally planning to propose at the end of August thinking that I would have plenty of time thinking she would get the 6 month stay like she did previously, but the customs thought differently(and were quite rude about the whole situation). So I proposed to her yesterday, and we want to get married.

    My question to the forum which option is better to get married in US and apply for a K-3 visa and file for the I-130 visa petition with I-129f form and then wait for the interview and go back to Russia together? I believe that it is legal to get married and wait in the US while the process is happening and then go back to the consulate in Moscow,Russia?

    Or is it better to apply for the K-1 visa?

    I am really hoping that it is okay for her to stay in US while we wait on the K-3 visa here. I already have planned and booked a vacation to California and Las Vegas at the end of August and really hoping to go there with her, her i-94 expires on august 22nd and the vacation is planned from aug 22-29th(this will teach me to never to assume that coming to us is simple) My original plan was to propose in Grand Canyon but that plan got ruined by the custom officials :(

    I want to do everything LEGALLY and not break any laws just to make sure not too have any issues later on with process.

    As long as she did not enter US with an intent to get married, you can always get married file I-130 and when it is approved file for AOS, then she does not need to return back at all. However you will be subjected to a lot of scrutiny by USCIS.
