  1. I also have another question...

Is it necessary to write down 2nd and 3rd most recent total income, if I am not sure the exact amount?

    THANK YOU GUYS!!

So, all other income is from W-2?

    Is it correct?

So worried because this is second time...:(

    Thanks,

Hi, all. First of all thank you for reading this.

As my wife and her dad(joint sponsor) are filling I-864, we do not really know what to put under my income and adjusted gross income.

the form says put the number as it shows on tax return.

However, we filed this years tax jointly and so do her parents.

So, her dad income is little less than what they filed for (her dad+her mom's income)

Please help me on this one.

I dont know really know what to put...

    Thank you,

Line 22 from Form 1040 (as adjusted)

  4. Hi, all.

I've come to this close with your help. Thanks you all.

but I have a quick question regarding income in the form I-864.

My wife does not make enough money, so my father-in-law will fill out the form too.

So, does my wife need to list income in last three years?

He makes enough, so he can put only the latest income, but how about her?

my guess is, since we are going to use her dad's income, there is no need for her to put incomes from all three years.

    Thanks,

  5. Ok.. so you need a co-sponsor (as you already figured) - but did you submit tax return (and supporting documents) with your original I-864?

we summit W-2 only for the most recent tax year. However, we put down all three tax years without accompanying W-2s for the two years.

is co-sponsor same as joint sponsor?

by the way, Thank you for your help!!

Make sure you do/redo your I-864 as well - you did not submit complete documentation with your I-864 (which is what the first statement in your RFE is referring to). You must submit your tax return and any/all supporting documents (such as w-2s). Not just w-2's.

Each I-864 (whether Sponsor, or Co-sponsor) must submit the correct supporting documentation.

I will ask them to re-file I-864s with all supporting documents.

I guess it's very obvious that we did I-864s last.

I am a bit confused on one thing. so, he is a joint sponsor. correct?

    Thank you for your time!!!!!!!

    Have a good one

  6. Hello,

I recently received RFE and in process of re-doing I-864.

Since I would prefer not to go through this for third time, I need your advice!

"my father in law files I-864 as a joint sponsor."Correct

"he makes about $100,000 of income with house hold size of 3"

"use of Asset is not required" Correct

"the most recent tax information is sufficient." Usually true - unless self-employed in which case more tax returns would help.

    Are those all correct?

I'd like to hear some advice from you all.

    Thank you,

What did your RFE say exactly?

Am I correct in assuming you (the USC) completed an I864 as well?

In addition, it says under #2, "In order to process your application further, obtain a joint sponsor or submit evidence of assts that meet the federal poverty line"

I think I have solution for this; my father in law checked A for first question, which my wife selected too: the petitioner.

He need to check for "a joint sponsor." correct?

It says, 1) in order to process your application further, the petitioner/sponsor on Form I-864, Affidavit of Support must submit all Fed income tax documentation submitted to the IRS for the most recent tax year.

    2) Based on the documents submitted with Form I-864 for the petitioner/sponsor, the income did not meet 125% of the fed poverty line for the petitioner/sponsor's household size.

I am adjusting my status, and my wife did file I-864.

  8. By popular demand, I am beginning a thread to share everyone's eventual cross border tax issues so it can be kept in one central place and can be continually used as a resource in this and coming years. So feel free to post and share the love and information.

because, he filed this originally as the petitioner... and RFE says income requirement was not met...

Im so confused.... since he is my joint sponsor, on another I-846 of my wife's, can she put the most recent tax year, as well?

    Thank you,

  10. Hi, guys.

I was able to summit all documents with your help.

But, I recently received a letter from them, requesting for EVIDENCE.

I guess, my problem was from Form I-864.

I had my father in law, who does not live with us, to file I-846.

And, my wife filed I-864 as well.

I know as a fact that he makes enough money for me, wife, his wife, and himself.

But, it says income did not meet the poverty line....

Do I need to have him file I-864A?? I don't understand...

The other thing is, I did not summit all tax info for the recent 3 years.

    Does it matter?

it says, the doc did not obtain all Fed tax doc.

    HELP ME GUYS!!

    Thanks for reading,

  11. Thank you!

If no supporting docs are included with a return, you may as well not include the return. Anyone can fill out a 1040 with favorable numbers, but if no (W2/1099) is included then the 1040 is not considered valid.

The I-864 suggests getting simple IRS transcripts.

  12. Thank you for your opinion! That's what I thought at the first time. Now im feeling better. =D

    Thanks again.

Hi, everyone! It's me Accty again!

So sorry for posting so many questions in short period time.

    But it's urgent!

My question is this time, does it really matter for a U.S. passport style photo if height of eyes is 0.1 inch off of what is required?

    Thank you!

I don't think that'll be a problem, I got my photographs from Walgreens and the guy that took them didn't even measured anything. However, don't take my word for granted that's just my opinion.

  13. Thank you so much for the help, but is it what I need? becuse what I have is just regular birth certification from Korea.

    Thanks again!!!

Thank you so much for answering.

But, Do I need both translated and original birth certification?

And on I-485, Do I need to get the foreign birth certificate from my country?

Yes, USCIS needs the original birth certificate. I was even asked for it during my interview, even though I sent an certified copy in the package. Even my USC wife had to show her birth certificate and her US passport.

Can I use my visa or passport instead?

You need the birth certificate as well.

also, can I used white-out on these documents?

Not sure, but I would advise on not doing it, you dont want to give them any reasons to return your paperwork, and this is a really stupid reason but still sometimes they are really picky depending on the officer that is processing your application.

  14. Hi, everyone. Im currently on F-1 visa and have been married for 2 months. YEAH!!

Anyway, I have some questions on I-131 and I-485.

    1) I was told that I should file and send out all of forms at once. But, on I-131 it says I need a copy of USCIS receipt as evidence that you filed the adjustment application. What should I do?

    2) On I-131, it also says an explanation or other evidence showing the circumstances that warrant issuance of an advance parole document. What do I need to do here? just attaching a copy of marriage liecense?

    3) What do I need to put on part 2 application type of I-485. I'm not on K-1 or 2 visa... but I got married to US citizen... I dont know...

Please help me out once again!

Thank you all for your time.

    Love
