  1. We got an RFE for more evidence of our relationship. I'm a bit surprised we did honestly considering I sent them pretty much everything they are now requesting previously.

We don't have kids so I cant send birth certificates and we don't own a house or have any debt that I can show mutual loans. So I guess I just resend them everything I sent before. *shrug*

Anyone else get an RFE like this? I honestly don't know what else to send them that they don't already have except a bank account with a years more savings.

  2. Hmm.. I'm beginning to wonder if we should worry about our application. We filed 2/16 and have received the EAD/AP but have had no sign of an interview letter yet. Seeing how nearly everyone in Feb already has their interview date or GC/transfer and we have heard nothing is a bit concerning. I'm especially concerned because the Biometrics interview letter had that bit about "failing to show up to the interview will result in the app being considered abandoned". I'd hate to lose the application and the $1000! I'm worried our interview letter got lost in the mail somehow. My case for all three applications still shows as "pending" online, which is amusing because we already have the EAD/AP.

Anyway, does anyone know if there is a number you can call and find out if an interview has been scheduled?

  3. :crying: I havent received an interview date yet either ... they received and signed for the Pack 3 package on the 2nd and its now the 11th ... at this rate I dont think we're going to be able to get married on the 2nd of May like we had hoped ... Well the mailmans been already soo todays out, gawd I hope I get it by Friday!

Whats the best way to contact them? the only number I found is the one they charge $3 minute seriously cant afford that! all the cashola is going into things like UMMM airline tickets and getting ready for the move...

Have the US Citizen call the State Department. They will be able to tell you if an interview has been entered into the system.

  4. If you call them, maybe you can get them to send you a copy as I am sure I needed one for Adjustment of Status (AOS) and I had taken photo copies so I didnt have to have another medical.

    Good Luck

I got a response from the consulate this morning regarding my medical results:

    "Thank you for your inquiry.

Please leave the medical documents sealed in the envelope they came in.

You can bring this envelope with you on the day of interview."

So I guess I have to wait until my interview to find out if I passed.

I find it SO bizzare that neither the doctor nor clinic indicated to me in any way if I passed or not. Especially since

a lot of you who had your exams done (albeit in different states) were told your results. This is just making me more panicky and thinking perhaps I didn't pass it after all.

    Not happy, Jan.

They gave us extra copies of the medical at the interview. (They give you a bunch of stuff back) I wouldnt worry too much about passing or not (unless you know you have one of the diseases they list on the chart). I'm pretty sure if you did, they would tell you at the medical and recommend a doctor or schedule an appointment to have it be treated. I'd assume no news = good news. They didnt tell my husband whether he passed or not, but they did point out certain ailments he may want to have treated.

  5. Woohoo ... I just rang the post office and my pack 3 pack arrived at the embassy and was signed for on Monday 2nd... I wonder how long it will take before I get an interview? arrgh yesterday was to long

You could always pretend you don't know that it's been signed for and send the Consulate a polite email saying that you mailed it on a certain day and was wanting to make sure it got there safely.

That's what I did and they were very kind in & responded quickly to say they had received it and that it was currently taking them x number of days to process & review them

Sneaky but it works.. and it kept me from going crazy wondering when my interview notice would come :lol:

You can be even sneakier and have the US citizen call The department of state number. They will be able to tell you when an interview has been scheduled so you can circumvent the mail that way. However you may get your appointment (p4) via email. That is how my husband received his.

  6. Well we got the appointment letter for biometrics today. It's scheduled for 3/14 which is a Saturday. While I'm not complaining, Saturday is a perfect time, it just strikes me as odd. Did anyone else get a weekend time for their biometric? I'm worried its a typo and were going to end up showing up on the wrong day and having our submission get entered as abandoned.

We received two separate biometrics letters (AOS & EAD) - one was for today and the other was on the following Saturday.

When we went to the first appointment (today) we took a look at the hours written on the door, it did indicate that they were open on Saturdays. At first I didn't believe it. They were nice enough to take care of both notices for us today though.

    whew! good to know.

  7. Another thing that is worrying me is the evidence of an ongoing relationship ... We have daily contact via phone and have keep records ... Usually we talk about 1.5- 2hours a day when his working and 3-4 hours a day on his days off .... Because we spend so much time on the phone we've never really had a need to send each other emails or letters .... I have a stack of birthday, valantine and christmas cards ... Obviously we have a lot of picture from when he came to Oz for 5.5 weeks and Im planning to burn those to disc to take with me alone with half a dozen or so developed ones ... Is this going to be enough evidence?

I'm sure that's fine-- My husband and I mostly spoke via MSN, we had little phone records and several trips. They didnt even look at the evidence in Sydney, never even asked for it. Sydney is a very easy going consulate.

I had a strong dislike for most of the food while there in Oz, but I do have to give it to you guys when it comes to chocolate! Top deck and the hazelnut flavored, swirlie one are a tie. Oh, and Tim Tams. When I go back again, I plan on bringing an extra suit case for those and bottles of Bundy!!

You can actually buy Tim Tams from cost plus world market in the US.

  8. Just wondering if anyone has ever posted all the required documentation back with Packet 3 before? eg. medical, police checks etc.... If doing this, does the Consulate in Sydney schedule your Interview any quicker, like within a couple of weeks instead of what seems to be the norm of about a months wait for your interview. I see people often wait and take thier medical after posting Pack 3 back, is that why they schedule Interviews a month later? Can anyone shed any light on the subject? I have everything ready to go and am just waiting on my Packet from the Consulate which I should recieve in the next few days. Thanks.

You can send everything back all at once. People do their medicals later because the results are usually mailed direct to the consulate from the doctor and they may be in a rush to submit the rest of the packet to get an earlier date. Also if you are looking for an earlier interview, write a cover letter and state the desired dates you want and why. When picking dates, be aware the consulate only does interviews on Tuesdays.

  9. Not sure if this is relevant or not, but he already has a SSN from living in the U.S. as a kid (his dad worked on an H1B visa).

As already said a K1 visa holder is employment authorized for the 90 days from the date they enter the US, BUT for a employer to employ him he will need to complete form I-9 and he will not have an EAD to show he is able to work. There is a revised I-9 form (02/02/09) and it states.

    4. Employment Authorization Document, That contains a photograph (Form I-766)

So the EAD stamp from JFK is no longer valid.

And in 5. it now says that a I-94 has to say a specific employer.

    http://www.uscis.gov/files/form/I-9_IFR_02-02-09.pdf

Reading that, I don't think you do need it. You can use one item from list B and one from list C. If what the guy at the social security office said was true, my finance will be receiving an authorized to work card. That would fulfill requirement C (C 1) for identity from list B, you could show a local residency ID (B 2). In San Francisco, you can get one by showing a local utility bill or marriage license.

  10. Thanks for the information all. We are now back in that all-too-familiar holding pattern.

we went to the Social Security Office today, and filed for the number. The guy processing our application said my finace was eligible to work till the k-1 expired. I guess we'll see what happens when the card shows. The supporting documents clearly state k-1s are eligible to work with out any additional work authorizations. The official said that his card would be stamped with something like "eligible for work only" (indicating that he wouldnt be eligible for social benefits)

  11. Okie, so literally, besides the fee receipt, passport, and the envelope, what else did you bring in hand to the interview? I pretty much got the gist of what needs to be mailed in to them, just not sure what's left to bring in to the interview with you, as it seems almost everything is mailed back?

    Let me clarify my confusion...

The info for packet three says:

*Applicant's Statement of Readiness to be Interviewed complete with all forms and supporting documents (i.e. birth certificate, military records, etc). Make sure to make copies of supporting documents.

and then has the information to bring with you to the interview:

    .....

    3. Two completed aplications forms DS-156

    4. One completed copy form DS-156k - supplement to form DS-156

    5. Long form birth certificate showing both parents names (with engish translation if applicable)

So, unless I'm reading this incorrectly, you're mailing forms into them, then also bringing the same forms along with you to the interview? Or is this info outdated?

We didn't bring anything extra to the interview, we submitted it all in advance. Once you submit all the items they ask you on the checklist, they will go through them and send you a letter with your interview time that also lists anything you may have forgotten. This letter will tell you if you've forgotten to include anything and will request you bring those items (if necessary) to the interview.
