  1. For others who's cases have been transferred, my hubby's medical exam for his K1 visa is coming up on one year. Aren't those medical exams only good for a year? Sigh..I'm not looking forward to an RFE for that. Especially since he will be gone the whole month of November so that will delay it more! :unsure: Maybe I'm worrying too much(again :innocent: )

    We've had to redo the whole medical and were well within one year. Our best theory at this point, besides immigration being inconsistent, is that the chest xray he took for TB is only good for 90 days and that 90 days was up by the time we sent in our AOS package. My best advice, just redo the medical. The CS may charge you just as much to transpose the records as to do the whole thing anyway.

  2. Got our secodn RFE - again with the medical. Apparently, they think my husband needs to retake the whole medical exam even though he just had the medical back in Feb. Has anyone else had this problem and what did you do? Give in and cough up the money? Thanks.

    Did they give you a reason why? If they lost it, you can try contacting the embassy where he got the visa. Or you can try to contact a congressman and maybe they can find them. If they just request a total new one, I have no idea. Sorry.

    But that sux. I was close to that too even though I have had it done in February too. But the embassy in Germany could send it in time.

    Our current theory, after he saw the doctor today, is that the chest x-ray is only good for 3 months. So by the time we sent the AOS package, he needed to be retested anyway. Oh well, we're just redoing it.

  3. Hi, we are May filers. I was wondering if any of you had problems with getting multiple RFEs. We just got a second one and I am concerned it's about the validity of our marriage certificate (one of the things requested in last RFE). I realize that I am dealing with morons and no matter how much I spell it out for them, I may still have a fight on my hands explaining I have given them what they need. Thanks for any insight you can provide. I'm just curious about how things go with a second RFE.

  4. I have completely underestimated the morons at USCIS. It seems we are being punished for having a legitimate marriage and for my husband coming from a country known for being on good relations with the U.S. and not having a history of terrorism or marriage fraud. The Morons have sent a second RFE and I am positive it is about the marriage certificate. Perhaps they will surprise me and it will be about something legitimate.

  5. So its been a while since I have posted anything on here....kinda getting worried as to why we are still waiting on a green card. We did biometrics back in june and it was transfered the same day as we had the biometrics. We have had one touch since then (look at our timeline....) but its been quiet since we have started this whole process.

    Should we call them at all???

    I mean we started back in end of May and I really think we are the last ones left in May without a green card yet. :/

    Any suggestions as we have been waiting for 4 months now (and yes I know 6 is the norm but I've seen everyone else in May get their green cards)

    No, you're not the only ones without GC. We finally got an RFE. Part of it was really stupid (see my previous posts re: morons who don't know what a marriage certificate is). We send our evidence back and it arrived yesterday. Keeping our fingers crossed.

    do I have to bring all copy of files(submitted 485,325a,130... Ect...)

    to the interview??

    I took everything they asked for in the interview letter. If you feel that taking a copy of the form you submitted will help you feel prepared for any eventuallity, take it, but they should have that on their file. Make sure that you take everything they list on the interview letter in case they ask to see anything and I also took a photocopy of everything (even got some photos duplicated to leave with them) so if they need them you have one to hand.

    Heather TR: They need a Certified copy of your marriage certificate. I am not sure how it works in your State, but here in PA, we had to take our wedding certificate that the we were given when we married back to the courthouse where we got the marriage licence and paid to get a 'certified copy', which was printed while we waited. This has the Courthouse seal and is a verified copy that you did actually get married. I can't remember the cost accurately, but I think it was about $20, not too much.

    That is actually what I gave they them. It doesn't have a title that says "Certified Copy" but where the judge signed clearly says it is a certified copy. Maybe they didn't read it very thoroughly.

    Did you pay for an official marriage license or did you use the one they gave you the day of your wedding ? Maybe a stupid question but in Vegas they gave me the day of my wedding a "fake" one that I can put on a wall as decoration you know. And for the official one I had to send a mail with a check.

    Not a stupid question at all. No, this is the one that is actually recorded.

    I believe that there are 2 separate documents: marriage license, which allows you to get married, and marriage certificate which confirms you actually got married. Different states have various regulations about marriage, and generally before getting married people have to register. This, however, does not confirm that the actual wedding took place, so, I think that what you need is a "marriage certificate" or "certificate of marriage registration", which in our case was given to us as we got married at city hall and was issued by the office of the city clerk - marriage license bureau.

    In Alabama, the one you get is both the license and the certificate, signed and certified by the judge of probate. What I sent is the actual copy that is recorded with the state, signed by the judge after the wedding. Maybe they think it should say what book and page number it's recorded in but that's not how it's done here. But I know other people from Alabama who had no problem with this. I think I'll just have to quote the law to them and try to explain in great detail

    Well, I don't know what I left out because I was very thorough, but we got an RFE. Of course, I don't understand why they can email and tell me it's an RFE but can't email and tell me what the heck they need!

    sorry to hear this. Hope they will let you know very soon what the RFE is for, so you can send it back asap. I have read on vj of other folks who received RFE's and once returned, they are approved pretty quickly!! :thumbs:
