Residence and Physical Presence

An applicant is eligible to file if, immediately preceding the filing of the application, he or she:

has been lawfully admitted for permanent residence (see preceding section);

has resided continuously as a lawful permanent resident in the U.S. for at least 5 years prior to filing with no single absence from the United States of more than one year;

has been physically present in the United States for at least 30 months out of the previous five years (absences of more than six months but less than one year shall disrupt the applicant's continuity of residence unless the applicant can establish that he or she did not abandon his or her residence during such period)

has resided within a state or district for at least three months

Alex received his 10 year green card in the mail on Saturday. I think I was more excited than he was.

We just wanted to say a big THANK YOU to everyone on VJ. We have asked many questions and everyone has always been willing to give their advise. I am very glad that we had this site to help get us to this point. Our journey has been long and although we are done at this time we will be back when Alex learns more english and wants to apply for citizenship. Again THANK YOU from the bottom of our hearts.

Our interview yesterday (Wednesday) was a success as well. We did get a stamp in the passport. You can read the details on our other post.

CONGRATULATIONS. I love approvals.

Interview Experience (Louisville, KY)

Our appointment was scheduled for 1pm, so we told our translator to meet us there at 12:30pm. When she was not there at 12:30 I called her home and got her machine. I was starting to worry and she finally called my cell and said that the gas company was at her house and they said if she left she would not get her gas put back on for 3 days. She said that she had done a phone translation before with the office and they could call her and she would be able to translate. (Yeah right).

So we go inside put our letter in the box and pretty soon our lawyer comes in. We tell him about the translator and he freaks out. He said he has NEVER heard about them doing a translation over the phone. He calls his office and tells one of his staff (a certified translator) to come down. He then goes to talk to one of the interview officers. Comes back and tells us that there are 5 officers in this office, that 2 speak Spanish and that we will be interviewing with one of them so we do not need a translator. He cancels the one from his office. (Whew).

OK next surprise—he tells us that they do not interview couples together here in Louisville. They always interview separately. Now I start thinking it was going to be like a Stokes interview—he said/she said. But actually none of the questions they asked were the same.

They called me (USC) first. They had me take the oath.

How long we had been married?

Do we have any children?

He asked for a copy of our daughter’s birth certificate.

What did you and your husband do this weekend? I about died, I could not remember anything. Finally I remembered that we went to the park on Saturday with Emily.

He asked if I cooked? I thought he wanted to know what I cooked on Saturday. I told him that I could hardly remember what we did let alone what I cooked. He said NO, do you cook or does your husband cook? Well most of the time I cook.

Asked for my ID.

Said I was finished, I asked what information he was going to need from my husband since I was the one that prepared all the documents. He said just his passport. Our lawyer said to leave the photos.

Alex. They had him take the oath.

Asked all the regular questions, are you a terrorist, etc.

How long have you been married?

When is your anniversary?

How long have you been in the US?

When were you last in Mexico?

How old is your daughter?

When is the new baby due?

Why is this important to you? Alex said because of me and the children. He would be devastated if he had to go back to Mexico and leave us here.

OK….you are approved. He took the I-94, his EAD and stamped his passport. He told Alex, you should get your green card in about 3 weeks. Congratulations.

We were out of there right before 2pm.

I want to thank all you VJer’s for your help in this process. Alex will get the 10 year card since we have been married for more than 2 years. Good luck to all of you still waiting for your interviews.

I am so sorry...I was hoping that you just had the date wrong on your timeline. Everything will be OK, these guys out here on VJ are very wise. Follow their lead and you will be fine.

Our interview is tomorrow at 1pm.....I am so nervous. I even went out to the car to pull the interview letter to make sure that I had not screwed up the date. I am sure that something is going to go wrong, whether it be car problems, traffic or our interpreter not showing up.

I wish Rox and everyone else the best at their interviews. Make sure you post to let us know how everything goes.

They are not going to want to look at them on your camera and I am sure they do not have the equipment to read your memory card. I would print them out, it also gives them something to copy if they want.

Our interview is on July 27th. Plus I know people who are not on this forum also have interview dates next week. I guess next week is the mass interview week

Someone posted on the website that the sponsor's income should be above the poverty line for all three years. I was a student in 2003 and my income was below the poverty line in that year. Should I get a co-sponsor now. My interview is next thursday. I am suddenly become worried.

They may look at 3 years, I am not sure, but as long as you are currently making what they say you need to support your family then you should be fine.

Our receipt date for the AOS was 3/2/06 and our interview is scheduled for 7/26/06. Our district office says it is processing for Nov 2005.

Guess we are finally ready for our interview next week (July 26th in Louisville, KY). We went to Indianapolis to get my husbands new passport, his current one had expired. I made copies of the new passport, put in our recent vacation pictures and now I guess there is nothing else to do except wait. I am sure we are taking a ton more than needed, but as everyone on VJ says it is better to be over prepared than under prepared.

I myself weigh more than my husband and I am also almost 3 inches taller than he is. On another note, I can and have had him pinned to the floor before, although in our case it was an enjoyable time for both of us.

Just remember that not every couple comes in that perfect package.

Here is the latest. Alex received his SS card on June 30th.

Alex broke his hand playing soccer, he went down on his hand and his face. Busted his lip and broke his hand in 2 places. He kept telling me the swelling would go down and that he did not think it was broken. So we did not go to the Doctor for about 10 days. It is doing fine now, hopefully when he gets the cast off everything will be healed well.

Finally heard from Social Security. They said he should receive his card in about 2 weeks. So he should have his cast off and be ready to get to work. That is if his hand is not stiff from being in the cast.

We really have been so busy and July is not looking any better. U/S on the 10th, cast off on the 11th, we have to go to Indy to get his passport renewed before the interview on the 26th. And these are the things we already know about not the ones that may just pop up.

Hope everyone has a great 4th of July holiday. Party hard, but responsibly.

That means drink a few for the pregnant woman, but stay where you drink----just sleep on someone's sofa.

Sorry that I have not been out here much either. Seems like life just gets busier, can't imagine what it will be like when we add the new baby to the mix. We are going to Florida to visit with my mom, we are leaving tomorrow morning and I will be back in the office on the 5th. Just wanted to try to get some more time with them before they leave for Paraguay for a year. They leave on August 1st, they have decided to become missionaries....at least for a year, then they will be back.

Alex broke a few bones in his right hand (lucky for him he is ambidextrous). He got a cast on his hand and will not be able to enjoy the beach as much as normal. I bought his a plastic cover for it, so that he can take showers without getting it wet. We are going to take it when we go to the beach to keep out the sand and maybe let him get in the ocean just a bit. He gets it taken off on the 11th.

Everything else is going ok. We go for the second u/s on the 10th, still not going to find out the sex of the baby. Hope everyone else is doing ok.
