  1. Hi, This is my first time here. So I am a little nervous about all of this, but I am also thankful that there is someplace to turn to with questions and concerns. I am getting ready to file my I-129F. I have a question concerning my fiancee's address. Now I understand that on the I-129F we can use her postal box address and on the G-325A we should provide her place of physical residence. However this seems to be a sticking point. She is currently living with her parents in Liuzhou, so her son may attend a better school. But she tells me that her true home is in a different city(Guilin)and that her household registry is in that city also. She has given me the addresses to both places but I feel that I should put down the Liuzhou address since that is where she is really living. Will it make a differance? It seems that the Chinese govenment sees her as living in Guilin. Any kind of direction in this matter would be greatly appreciated. Thanks!

    I'd choose the address where she can most reliably receive mail. It does not need to be her houshold book's registered address.

You'll be fine.. some of us had monetary problems as to when to file for AOS...since it cost a whopping $1010 or something.. to file for AOS most of us end up using the entire 3 months and then some... There is no timeframe to file for AOS as the only requirement is to get married on K1 visa within 90 days of arrival in the US..

    my friend i have a important question about my i 94 expire this sep 23 but i filed AOS and EAD this sep 26,im just worried if not oky...but we done get married sep 7...can you give me advice....!!!!tnx joy

  3. Yes, that is because the 90 day EAD is not intended as a viable work permit. It is included so that K1s can get an SSN, which some states require to obtain a marriage license. Without it K1s in certain jurisdictions would be in a situation where they were required to marry in 90 days but unable to obtain a marriage license until they married and adjusted staus.

    The intent is obviously not for K1s to all find <90 day employment then have to quit. Yes, they must have documentary evidence. So if you go and get a job with a 90 day authorization the employer should correctly ask what documentation will you be able to show me in 90 days? Will you have work authorization documents beyond then? The above law makes it clear to employers that unless they are hiring for under 90 days their employee will be illegal at that time and they will have no documentation and you'll both be in violation of the law.

    If you've found a great 89 day job in the US, more power to you. I'm not knockin' it. A K1 visa is documentary evidence that by law you are work authorized for 90 days because by law, you are work authorized. It can therefore be presented at SS office to obtain SSN.

    I'm not a lawyer but I've seen these discussed extensively here and on candleforlove.com and the relevant laws seem to back this up. That is why POEs stopped routinely giving the stamp.

    Having a stamped I-94 has nothing to do with getting a social security number. K1 holders are work authorized so they can get a job. USCIS is responsible for an individual's work status, and the Social Security Agency is responsible for issuing an individual with a number. They are separate areas covered by separate laws.

    I think you're making a few leaps in the interpretation of the Code of Federal Requirements and the I-9 rules. It's illegal for an employer to disregard an application or refuse to hire an applicant based on the future expiration date of a document. The fact that you have a 90 day EAD does not mean that in 90 days you'll necessarily be ineligible to work, it just means that specific document expires. The status may still be valid. It just happens that in the case with K1 holders they do become ineligible unless they have obtained their [c][9] EAD before the [a][6] stamp expires.

    A K1 visa is not documentary proof of work authorization. I'd like to see which law says it is, when I've shown you the law that says a K1 holder must apply for documentary proof of authorization. A K1 doesn't prove the work authorization, just the status.

    But if you can show me some immigration law that backs up your claim, I'll happily read it. Until I see otherwise, I'll go with the law in Title 8 CFR §274a.(12).(a)

    No, you must wait for EAD.

    so how long does EAD usually approved??? am i right 2-3 months??? so i have to stay home for that...

    If you have the internet at home there are many opportunities to earn money online while you wait for your EAD..

  6. I am kinda getting nervous as to her AOS not being approved but everything else was.

    Don't worry, this is normal. Everybody's EAD and AP gets approved before the AOS. Those are temporary work and travel documents until they issue the green card which is the permanent work and travel document.

    If they approved the AOS at the same time, there would be no need for EAD and AP.

    Actually I had read on the "May '08 AOS filers" that most of the K-1 filers had had their AOS approved before or concurrently with their EAD and AP. That, more than anything, is what has me worried. Apparently most K-1 filers get their AOS approved without the need for an interview. I don't mind having to go through an interview, but I would love to avoid it if at all possible.

    My wife finally got her employment authorization and advance parole approved. However, for some reason the adjustment of status (I485) has still not been approved. Her I-94 is long ago expired. Is there anyway that I can get her a California ID or driver's license? Or maybe even an Social Security Card.

    Any help would really help me out. I want her to have more independence, but it is really hard when I have to drive her around everywhere or she has to take the bus.

  9. So Im sure people on this thread are ready fly or in the near future... Question! anyone know about bringing X-RAYS? Cause the people at the airlport in Cebu were about to make my Fiancee miss her flight just cause she did not have her X-RAYS. I see some threads saying you need them for the POE and other say the POE are only interested in the BROWN ENVELOPE. Any thoughts on this?

    Also dont forget along with the 750 tereminal fee they also ask for something around 1650PHP taxes or something before you can fly out from Manila to wherever your heading in the US of A. So dont have your Fiancee purge al her pesos thinking she wont need it. If anything he/she can always get it exchanged at the airport in the U.S. Yeah learned the hard way...

  10. Her flight is for tuesday night... Im kinda worried cause its now Saturday night there in Phili and Monday morning she has to go to the CFO. I hope the Delbros will be there by Sunday cause its now the 3rd day and they said the next two days. Its going to be too late by Sunday to change her flight. So Im just banking on that its there soon! :(

  12. So going crazy! I did more research and came along a old post on how to check the case status in Manila after the interview... It appeared that the number did not work...

    Anywho, im sure everyone knows this but if not and your like me in the dark... this is what I found.

    So I took the number from the USEM web page 011-632-301-2000 and ext.5185 from the old post.

    worked perfect. Grace answered the phone and was so kind and helpful!

    She told me the counselor was finished with the review and the papers were verified. She told me our visa was not printed and that's what they were waiting on. She then asked when my Fiancee was flying out. I told her I hoped by June 23 next week. She then told me she apologized and that she had an update and our visa was printed today. If we liked we could call back by Thursday to verify its being shipped out and we should expect a text form DELBROS... she even wished us a happy new life together... :P

    Just a heads up! I've been using a service called startec.com for a year now... works awesome! and it beats having your Fiancee call the USEM at a rate of 53PHP a minute... not to mention having to have her go out in the heat. I'm sure she had enough of that going to the CFO, NSO, and everywhere in between. Best thing it only cost me .18US cents compared to wiring her money for a 1.26USD a minute call.

    People who interviewed in April, May, and June... did you receive a 221(g)? My fiancee interviewed May 29th and we are guessing passed since the counselor said congrats you'll have a good future California. She then received this white paper stating "wait till you here from us" and the pink slip. Many of the people she met that day got the same 221(g) paper... is this just standard now?

    Wondering about the 221(g), I called the USEM, the one where you have to pay 18 U.S. dollars for a pin. I hate to say it.... but the lady was really rude. She seems like she hates her job and does not like to answer questions. She said the visa was sent back to the counselor June 4 and to wait for 6 weeks max, if nothing from that time is received to call back. She pretty much blew me off....

    I thought she was being rude since I am American or at least FIL-AM, so I did a three way call and had my Fiancee talk, the lady was just as rude to her if not worse. My fiance asked about the procedures and wondered about the NSO verification. The lady made a smirking laugh and said who told you that they verify in NSO only the counselor can verify not the NSO! To me I felt like I just wasted another 18 dollars on the process... worthless.

    Anywho my Fiancee called delbros, spoke to Robbie, very nice person, said it was still not released from the USEM but the payment was received on April 30 and sent May 12 for verification. He assured my Fiancee it was a normal procedure and not to worry.

    now just playing waiting game... 17 days and counting... 25 days to go... hope the 221(g) is just a standard thing... just venting.

    COngratulations! Finally you got your visa! I was praying for the two of you (the only ones left with an interview date of April 22) to have your visa soon, at least sooner than I am cos I know the feeling of the long wait and you waited for almost 2 months! Im so happy for you guys! I hope the other has gotten hers or will get hers soon. :thumbs:
