  1. My employers used the words: "and conditional on his green card being approved, will continue to be employed as a valuable member of our team for the forseeable future". The secretary came up with that and USCIS seemed to be happy with it.

    I dont know how to say he will keep his employment. Sounds kinda weird tho. I mean who can say that in todays world? Mabye Im just gonna take that off.

    Yeah, I know. Actually IIRC the thing about "future employment" is only necessary if you're using the Green Card applicant's wages to meet the poverty limit.

    HI!

    This is perfect timing for this topic! I'm using my income toward household guidelines and need help with this too!

    Does anyone have any ideas on how to word "future employment" portion of the letter? I'm meeting with my supervisor tomorrow and he has no problem with the letter, he just wants to word it so its acceptable for the USCIS.

    Any experience would be appreciated!

  3. If it's already filed, send the 2006 tax return. I filed mine a few days after sending our AOS in (wasn't planning on it, got a huge unexpected bill and needed it) and am expecting to get an RFE as people who hadn't filed taxes yet have gotten RFE's for it.

    I don't know what a TN visa is, but make sure your income is allowed to be used toward the 125% of the poverty line figure.

    but since we filed jointly as married, does she file the 1040 with her I-864 or with my I-864A or both? Did you file as a couple or individually?

    Oh, by the way, A TN visa is under NAFTA for Canadian and Mexican citizens who qualify under the guidelines to accept work in the US.

    I just read another thread regarding 2006 taxes. We had our taxes done early and have our refund. We were only going to send in 2003, 2004, 2005 taxes because we read on VJ somewhere that if it's before April 15th, the prior year taxes aren't required. The only reason we were going to exclude 2006 is that we filed as married (she's a USC and I'm here on a TN visa) and we're not sure if the 1040 should go with her I-864 or my I-864A or both? (we're also using my income toward the poverty line amount... she's EXACTLY $387 SHORT!!!)... or both?!?!

    We are filing "The Works" on March 15th!

    Any advice or feedback on this would be appreciated!

  5. I just paid 165 dollars for another MMR, Tetnus and the first Chicken Pox vaccine. The chicken pox one was 90 dollars alone. And, the 165 dollars was through my health department on an unemployed discount. Ide say 252's pretty good.

    We have our physicals scheduled for 03/07/07. Mine will be $160 and my 2 sons (under 14) will be $120 each. This includes the blood tests and return visit for TB. I was having a problem getting my old vaccination records from Canada due to my Dr. retiring and all files being in a storage warehouse somewhere. I just went to my health unit and paid $7 each for the MMR & tetanus ($14 total!!) This saved us over $90 from having it done at my family practioner or the civil surgeon.

  6. You are the primary sponsor. You need to show what you earn, no matter what it is, even if it's not enough to support your fiance. Both you and your parents will fill out a separate I-864, you will check the part that says you are the sponsor, your parents will check the part that says joint sponsor (sorry, I don't know the exact wording, but it's something like that). You need to attach your W2s and taxes (I would recommend you send tax transcripts since they sometimes will send an RFE for taxes, even if you send in W2s and returns). Your parents also need to attach their W2s and tax records (again, it's easier to have them order free tax transcripts so you don't have to worry about missing some of the information they want from you). You and your parents also should attach employment letters, etc as in the instructions on the I-864. If you can't send an employer letter, for instance, address this in a cover letter. Also explain in the cover letter that you are the primary sponsor and your parents are joint sponsors.

    A final note, I would recommend you attach 2006 taxes as well since so many people got RFEs last year who filed at this time, we thought the RFEs were likely for 2006 taxes even though we filed well before April 15th.

    I resubmitted my question from a few moments ago...typos

    I have a question for the I-765. I'm a TN-1 Visa holder. This gives me an I-94 with "TN" stamped on it which allows me to work in the US and "Multiple Entry". On question 11 on the I-765 it asks... "Have you ever applied for employment authorization from the USCIS?" Now my question is... are they asking if I have applied for an EAD (I-765) or ANY type of work authorization? Better yet, do I answer "YES" or "NO"?!

    Any help would be appreciated.

    I'm a TN visa holder and I've been kicking around this site for a few years while my divorce and custody issues were being dealt with. Finally divorced :thumbs: , have custody of both of my sons :bonk: and live in Milwaukee with my new wife :content: . My question... Has anyone one else out there in VJ land had a TN visa, got married and adjusted status? I'd like to hear from you through a reply or through a message to find out about your experiences and/or problems.:(

  11. :help: Hi!

    Capt. Canuck here AGAIN! I was here a few(8) months back and received some help from VJ members. Shortly after my wife (USC) and I (Canadian Citizen TN-NAFTA visa holder) were married, she was downsized and lost her job. She starts a new full time job on March 5th, so we'll file within 2 weeks of that. Here are a few questions before I send my package:

    1- For the I-864, we have my wife's past 3 years taxes and a letter from her new employer outlining her annual salary and we will also be using MY (the intending immigrant) income to meet 125% of poverty guidelines. I have the past 3 years tax returns and a letter from my employer stating their intention to keep me employed after becoming a permanent resident. Will this be acceptable? Has anyone had any problems with this? Any other recommendations?

    1A- Does only ONE I-864 filed by my wife and ONE I-864A from me cover me and my sons?

    2- Do my 2 sons also require a I-693 Medical exam? Am I correct in my understanding that my sons do NOT need to file G-325s.

    3- Am I correct in reviewing the guides that my wife needs to file a I-130 for each of us?

    4- Do we all (my sons and myself) have to file seperate I-485 applications? Do we have to file all 3 of them at the same time or can the boys I-485s be submitted at a later time?

    5- Do we have to file seperate I-131s for our trips to Canada so they can visit their mother?

    6-Do we need to include the court order that outlines custody arrangements or does the fact that they have I-94's for their TD- Nafta status already cover this?

    7- Am I correct that EVERYTHING goes in ONE package with a cover page outlining all of the paper work enclosed?

    8- What is the quickest that anyone has received an EAD? (more curious than concerned!)

    Any verification or advice would be appriciated! I know alot of this has been covered and I know some of the answers, BUT as you ALL know, there's no room for errors!

    I replied without replying!

    We did post on here a few months ago, but I think there was a problem with the forums and I couldn't retrieve the info I had recieved from you all. We really appreciate the feedback! We are going to make an appointment at the Milwaukee district office to get specifics. My TN visa does not expire until the end of September, so I should be OK. We'll post our findings after our appointment in case anyone else is in the same situation. Any more info or input is always appreciated.

  13. The guides on VJ are very accurate and very good outline for what you can be working on ahead of time. I agree with everyone on here that K-3 is not the way to go if you do not want to have to leave your wife for at least six months. It is also unnecessary if you are already in the U.S. and don't plan on going back to Canada. If you should still choose to go that route...... You can apply for work authorization once you enter the U.S. with your K-3 and activate it. You can either let your I-130 ride in the service center and go through the NVC or apply for AOS the same time as your EAD. EAD will take another few months. I've seen you on here before a few months ago so i would think that by the time processing is completely done to where you can work, your TN will have been expired for awhile. Once you are married........ whether or not you have started the immigration process, it is technically not legal to renew the TN because of the whole dual intent thing. We found this out the hardest way possible because we had no idea what we were doing at the time. He was completely banned from the country because they knew he had a wife, a house and a job here. It took six months of stress before we got him back home. I would absolutely hate to see someone else go through the same thing.

    My Fiance (US Citizen) and I (Canadian Citizen here on TN VISA) are getting married next month in Wisconsin. We plan on starting the K-3 Process immediately after and would like to know where to start. Is the K-3 Guide accurate? Is this EVERYTHING required in the I-130 package? When can I file for an I-765 (Application For Employment Authorization)? I will need to continue working while in the US.

    Also, my two sons are in my custody. What type of application will my fiance (soon to be wife!) have to make for them to become Permanent Residents? Do we have to do the I-130 for each of them also?
