My application was submitted last October, and it was transferred to CSC in December. And I just received an approval letter so,
dont worry!

I mailed USCIS California office a letter; basically asking what's going on with my application, it has been 10 months!
And today, my case status changed to production of green card! It was worth pushing them a little bit. Finally..!! It's been almost 2 years since
K-1 application to getting a green card

I called USCIS and asked about infopass. The lady told me that because I have a notice that my case was transferred to California office,
I cannot go to Philadelphia office (where I live) for infopass. She told me that the only thing I can do is to write a letter
to California office to inquire about my case.
I did it... now it's the same waiting game.

Thank you all for your comments. Do you know how to make info pass appointment ?

I received my biometrics appointment letter in 2 months after I submitted my application. I think it is normal to wait for a couple of months for biometrics.

My case was transferred to California Service center 6 months ago, but havent heard from USCIS since.
Case status on line is still "initial review", It's been 9months total since I submitted my application.
Is this normal?

me too! I got a notice that my case was transferred to California, and nothing since. Hope they'll process our cases!

Hi,
I filed AOS last Oct in 2009.
My case status is still initial review and I am starting to get anxious
why it has not progressed at all. It has been 8 months. I did not include
vaccination information so I should receive a request for it.
Also if my work permit expires during AOS, do I have to pay the fee for
extension?
Thank you for your help.

It sounds like your husband has sex addicton. It is not for fun anymore, isnt it?
Hope he will listen to your advise to get outside help. Even if you are from another country,
you have all the rights to live safely and healthy. Dont let him do whatever he wants.

Hello
I applied for AOS last October, and did my biometrics done in November, and
received EAD in December.
However, I have not heard anything from USCIS since then, and my on-line status
report says "initial review".
It's been almost 6 months.
Is it usual?

I filed my AOS a month after I-94 expired, there was no problem. I got finger printing done a month after I submitted AOS.

Ok Thank you very much everyone

Hello
I have a question,
Can my husband (US citizen) claim a wife whose legal status is AOS (with EAD) as a dependent on his tax form?
It makes a big different in the amount of return.
-
I experienced the same thing. I went to change my name, but I was unable to without a EAD or Greencard. After I received EAD, I could change my name.

Hi there, well my wife's biometrics appointment is tomorrow afternoon. Is there anything that we should be taking with us besides the appointment letter & her passport? Should we bring a copy of anything else? Such as marriage certificate confirming her name(since her passport says maiden name but the appointment letter says married name)?
Anyways, just making sure I'm all set for it. don't want any surprised. Also just wondering. My wife's getting quite anxious to start working...after the biometrics is it likely that she will be getting her EAD quickly? Hope its not to much longer! Well, thank ya guys! God bless
I brought my passport, appointment letter, and marriage certificate.
I received my EAD within 2 weeks after.

Hi
You may have seen my other post about a battle to get a driver's license.
Now I have got my license, but it was a tough experience. I dont want anybody else to be stressed about DMV
during AOS so I will share my experience.
I tried to get my driver's license right after I got married. In PA, their website says that K-1 visa holders are eligible
for driver's license or ID, with expired I-94 and lack of evidence, I was turned down pretty quickly.
I returned with NOA1s, again, I was turned down because SAVE system (government system that they look up
your immigration status) was not updated. They told me to come back with EAD.
I returned again with EAD. I presented my passport, marriage certificate, my husband's birth certificate and proof of
residence, EAD, NOAs, SSN. I was issued a driver's license for one year.
A week later, I received a letter saying they will cancel my license because I commited a fraud to obtain the license.
The letter was scary, prosecution, judge...etc. Another letter indicated that they have a proof that I was not lawfully
staying here. How could it be? I was very upset, and my family advised me to go to a congressman's office.
They reviewed my evidence and called DMV, they told to return a call, and they never did.
I tried to call customer service. I was told that they had to run some research. A few days later, when I called
they told me that 'fraud' was that I presented a SSN card with my maiden name on it. I thought that they switched
thier story somehow..from immigration issue to just a SSN.
I changed my name on SSN and returned to DMV. I was invited to an office by a supervisor. He reviewed all my evidence,
made a few phone calls, and took my cancellation off. He explained that my cancellation was a mistake that
they made by believing unupdated SAVE system. I was angry with DMV but now I know that SAVE system
was the problem. They can only run things by what is on their computer screen.
I advise you
to wait to apply for a license until you have SSN with your married name on,
and also EAD. If you can wait, just wait until you get a greencard.
If something like I experienced happens to you, try to contact
USCIS to update SAVE record.
If we have rights to be here, we need to keep fighting for the rights.

Great, thanks for the quick replies and the useful links to further my understanding of our options.
My fiance is currently out of work and I did worried about suspicion at the border since he is coming for a sizeable amount of time. He might not be able to provide evidence of strong ties to home due to being unemployed, etc.
My solution to this was for him come over first in January and then submit the application. I figured whats a few weeks difference if it means he can securely come for a nice long visit. Am I allowed to submit the fiance visa while he's in the US and is it alright for him to stay up to the maximum amount of time the tourist visa permits? Plus would it be easier/less suspicious for him to enter the US as just a tourist?
Thanks again for everyone's support with these queries!
That sounds safer to submit the application after he entered the U.S to visit. I had no problem to visit the U.S while my K-1 was being processed,
but it was costly to have all ducuments translated into English, and I was nervous on the plane. Hope everything goes smooth to you. K-1 to AOS is a long process but if you will get it. Good luck
-
You need to bring whatever that might help you, BUT, better not to say anything about the K-1 visa until you are asked. When I did the same things as you did, I just said I am visiting someone. No further question was asked.

I sent my AOS about a month after I-94 expired. There has not been any problem, and within 2 months, I already got EAD, SSN.
-
I hope you two will find a way to resolve this, because one missing evidence shouldnt have you guys apart. I had one missing evidence but I honestly wrote that I lost it. I havent received RFE yet. I went to H&R block for my part time job and I was told I did not have to file tax for the low income. Isnt there any family member that can sign the paper ? good luck

Yes. It seems that they are making irrational accusation that I am an ilegal alien who obtained a license with false documents. Can you believe it?
Now congressman's office is trying to talk sense with them. They are on my side. The worst case senario, I might have to apeal my case to the judge, and the judge will order DMV to restore my right to have a license. I cannot belive that they can make such a mistake like this...arent they afraid of being sued for mistreating legal resident? After following all legal steps to be with my husband...it has been two years since I had to leave him for K-1. Now we are finally legally together, trying to settle down... how could the government treat us like this? This is such a disappointment.

Hello all,
My current wife entered the country on a K Visa with her maiden name. After the marriage, she took my last name. Does any one else have a similar experience. We went to the DMV as soon as we got her EAD card and the DMV folks told us that the SAVE system shows a different name than what her EAD card. Turns out, it was the maiden name. We have applied for her SSN, EAD, GC all in her married name.
We then went to a DMV office abt 50 miles from where we live and filed the application for SAVE validation. A couple of weeks later we got a letter stating that there are no issues w/ the name. We wanted to wait till we get the permanent card and went to the DMV office after that...this time w/ the permanent card. This time around, the DMV folks raised the same objection...however, since we had the previous letter, they allowed us to get learners permit.
Now, has someone else faced this issue w/ SAVE and name change after marriage?
Will this create a problem, if we leave the country and at the POE immigration w/ her permanent card?
How do we actually get it fixed in the "system," whatever system means?
Thanks.
SAVE records her entrance in her name as in her passport. You should bring a copy of your marriage license and EAD to the DMV and asked for tranined employee. Has anyone else experienced what happens when they encounter untrained employees in government offices? YES
If SAVE records my entrance as my immigration status, I am definately out of visa on their record because my K-1 expired
a long time ago. I hope it will be fixed...
DMV is

I hear you. DMV is ordering me to surrender my license (which once issued) and accusing me of providing faulse documents. I guess that I now only have EAD, they only see me as what my maiden name's immigration status. I dont know how to fight with the SYSTEM. They dont even give me a chance show my evidence...they only trust what they call the SYSTEM. Now, I have my congressman reviewed my proof that I am lawfully waiting for my greencard and trying to convince DMV that they should restore my right. This is so stressfull, being accused of something that I did not do.
I will update if my problem resolves, hopefully yours too.

The "system" that they were talking about is the homeland security. Eventhough the GC that has been issued to her has her married last name on it, her name in homeland security system has not been changed yet. DMV, SSN, and homeland security are all connected to each other, they can verify with each other if the person applying is legally staying here.
Same thing that happened to me, I had my SSN, EAD and GC but they they didn't issue me at first, they showed me a print out of my file in DHS still with my maiden name on it. They let me take the test after 2 visits to DMV, and after I insisted that what is the use of all these identification cards DHS has given if they will not honor it.
Do not worry about traveling abroad, just bring your card along with you and better yet the letter that came with it and the welcome letter to the US as well
We can't fix the system, only the DHS people are the ones that can update our names.
God bless you guys!
I am having the same problem with DMV right now, that they want to cancel my license because they claim that they found evidence that I am not lawfully staying here. All my evidence came from DHS, but they keep telling that their SYSTEM does not show I am lawful. I am running out of an option to fight with them. How did you convince DMV? Now I am fighting against head quater, have our congressman involved...waiting for how their negotiation goes.
question about medical for AOS
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

I didnt even include my vaccination information, but my AOS was approved without RFE. I guess they had everything they needed in the envelope
I submitted at POE.
