  1. Hi,

This may be a question for an accountant, but I’m hoping someone here may have been in a similar situation.

I'm filling out the I-864 and have copies of my tax returns for the past three years; however, for half of 2007 and all of 2006 and 2005 I lived and worked in the UK (where I met my future husband!). I filed my US returns the entire time I lived in UK as required.

Here's the question, my US tax returns show only a nominal amount earned last year as I returned to US in August and started to work in November 2007. My salary in UK for the months I lived there in 2007, plus the month and half I worked in US in 2007 was more than enough to illustrate as a sponsor I can meet the financial obligations that are part of this process. However, if you look at adjusted gross income on the tax form for US it is a fairly modest number, as are the amounts for 2006 and 2005 because I was not living in US. My Foreign Earned Income forms are all part of my tax returns for these years so the back up is there, I’m just unsure how to fill in the blanks on the I-864.

The I-864 simply asks for adjusted gross income. Should I simply add together my adjusted gross income with my foreign earned income and list this as adjusted gross income (even though I don’t think it is technically)? Should I put in the adjusted gross income from the 1040 and then explain the situation in the cover letter? Should I just leave this information blank and include the photocopies of the tax returns? Will the application be rejected if I leave it blank? Can I count on USCIS to read my tax returns which shows I was resident in another country?

My current salary is enough to meet the income requirements and I have a letter from my employer confirming the information, along with bank letter and current pay stubs.

    Any thoughts would be appreciated.

    Thanks,

    Mary

  2. Hi,

My fiance has his interview next week and naturally the second guessing has kicked in.

Although we filed in January 2008, we did not get petition approved until April making our approval notice go until August 2nd.

I called the department of state before the expiration date and they said as long as he was notified about interview before August 2nd, then we're all set.

Has anyone else had a similar experience or can advise what to do?

Is it too late to get an extension as the time frame has passed, should I simply stop worrying about this?

    thanks,

    MD

Yes you are fine. this happens a lot.

Thanks for quick reply. I'll move on to another worry no doubt!

  4. now THERE'S a reply! ;)

Hahaaaa!!!!!!! And then some!!!!!!! Seriously, I think I'm right in what I say about the insurance, but I'm quite happy to be corrected - I don't profess to be an expert on insurance.

"I love it and I need it

    I seed it

    Eight cylinders all mine

    Alright hold on tight

    Im a highway star...!!!!"

Thanks everyone - I did have a hard time finding insurance topics and found the other posts useful. You'd think travel insurance would cover it, so I suppose the best thing is to look into their exceptions, and good point about the AOS.

Everything has dragged on longer than I thought!

  5. Hi,

My fiance are getting closer. After filing in VT in early January, finally an appointment for an interview on August 21st in London.

I have searched the forums, but cannot find the answer to my question about health insurance.

Will the purchase of UK travel insurance cover him in the US until he can go on my work health insurance (after we marry)?

If not, does anyone have similar experience in figuring out what to do about health insurance and some advice?

    Thanks

  6. No... because you had your interview....

I have a similar question. In my case, we have submitted information to US Embassy in London, but are still waiting for interview. The expiration date on the approval notice is August 2, 2008.

I called Department of State and got two different answers on two days - one person said, they will renew automatically and another said, you better check back with us once a week as the application could expire if you haven't sent anything in. Once again, confused.

My fiance mailed application early June. He sent it registered delivery, but has lost the receipt so we unfortunately have no proof of mailing. Should we resend the application before the approval notice expires?

Also someone mentioned here recently an email address at embassy to enquire about your case, if you can point me in right direction, I'd appreciate it.

Any help would be much appreciated.

  7. Hi,

Apologies if this has been asked before (quite sure it has!), but I'm trying to figure out what should be a simple thing and have received conflicting advice.

My fiance, in UK, has gone for a medical and has assembled all his documents with the exception of affidavit of support. I have filled out form I-134 and have supporting documentation and just need to get it notarized. At the bottom of the form, it says send this to USCIS. Should I also send a copy to my fiance so he can bring to his interview? Does he need original?

His information packet just says sponsors should use Form I-134 or provide affidavit of support. I don't know which one is better to submit and can't find any indication that if I send the I-134 to USCIS that they notify the embassy.

When I called USCIS to get more information, they said unless they requested it (of me), then my dealings are solely with National Visa Processing Center and US Embassy in London and they told me not to send them the form. I have not received anything from USCIS since receiving petition approval notice. I cannot get through to the NVC on their helpline and the USCIS website and Embassy sites are not clear.

Like everyone else here, I just want to do the right thing.

Any help/advice/tips would be greatly appreciated.

    Thanks,

No, USCIS has absolutely NOTHING to do with your case anymore right now. So no, you don't send ANYTHING to USCIS. You give the original I-134 to your fiance and they bring it to the embassy for the interview, among other things.

The I-134 is the affidavit your fiance brings to the interview.

You don't need to call NVC, you don't need to call USCIS, you don't deal with ANYONE but the embassy.

I recommend reading the guides so you have a better understanding of the process.

Further, there is absolutely nothing on the I-134 telling you to send it anywhere, much less to USCIS. Where did you get that wild idea?

I see. Those instructions would only apply if USCIS is requesting the form, which is rare but you said this was on the bottom of the form. It is not.

    Hi,

You are correct; it is not on the form, but the instructions on web that accompany the form. I used the wrong noun when posting. Throughout the process I've tried to double check everything before I mail it off as things (at least in my experience) don't match up all the time and who wants to risk adding undefined time to the process.

Since the embassy referred to it in their communication to my fiancé, I went to USCIS site to download the form. Hence my confusion about where I needed to send it or if I needed to send it (i.e., does the embassy prefer the official form or something original?).

It could make a sentence or two in a guide here, but perhaps I over thought it and it is of limited interest or I just haven't looked hard enough to find the reference!

Your precision much appreciated, your help even more.

I hope to notarize the form tomorrow.

Thanks to everyone who replied. I did read the guides (and they are very useful) but didn't find any thing specific on this front. In any event I really wanted to see what others had to say as the instructions on USCIS website says send it to us.

    Thanks very much
