  1. Hello there,

    I applied for AOS in September of 2008 and am still waiting for my first temporary green card. I have traveled and have also received my EAD. I am working and enjoying the married life. My question is whether or not to become a permanent resident? My degree is in elementray teaching and with a temporary green card I can only work for 6 years...if I do not become a permanent citizen within that 6 year period then I can not teach in PA (pennsylvania)after that. I was told this is the case in most states as well. BUT if I become a permanent citizen do I loose my Canadian citizenship? What is the real difference? My original plan was to keep renuing 10 year temp. green cards, but if I want to teach in PA I will have to scratch that plan and becoem permanent.

    PLEASE HELP!

  2. Hello there,

    I was a K-1 visa holder and got married on August 24, of 2009. I got approved to travel and went to Mexico recently with my hubby, but I was told by the flight crew that I needed a stamp in my passport with my new married name. How do I get this stamp. I have a Canadian passport, not and American one and don't want any delays for future flights. Does anyone know where i change my name. I live in PA, USA.

    Any info. will help.

  3. The I9 form states "must present a receipt for the application of documents withing 3 business days and the actual documents within 90 days."

    Does that mean that I can apply for I765 (work authorization) and hopefully get it in 90 days and take a position now.

    I am a k-1 visa holder that was offered 2 jobs pending I have sufficient documents. I do not have EAD as of yet or SSN.

    Please help!

    The part you have quoted is for people who have been approved for EAD but have lost and/or need to replace it. As you have not yet been approved you can not begin employment until you have been approved and have your EAD in your hand as you are not authorized to work without it.

  5. Call the USCIS, but since you have filed for a new I-94 you should wait. You can though add your name to your partners bank account, without SSN and I-94. (JOINT BANK ACCOUNT)

    How long do I have to apply for AOS after I get married? Is it possible to wait for my new card even if that takes a few months?

    SSA office does have access to USCIS SAVE database and should be able to confirm your status that way.

    SSN is NOT required for adjustment of status, only the I-94, do you still have the I-94 with the smudge on it?? I would use it for AOS.

    You NEED EAD in order to take a job in the USA, a state ID is NOT work authorization, only Homeland Security grants work auth, so unless you have EAD stamp on the I-94, OR EAD card, the prospective employer is breaking the law.

    SSN is also NOT work authorization.

    Actually K-1 visa holders don't need any EAD stamps....I'm more worried about my AOS then work though

  6. I entered the US on June 21 on a K-1 visa......I went to the local social security place to try to get a Social Security number....BUT the stamp on my I-94 was smudge and they could not read my enter date...so I h ad to apply for a new I-94 card.

    Without this card I can not get a social security number and therefore can not open a bank account or get an ID card.....I am getting married in less then 3 weeks and need to apply for AOS.

    How can I apply for my AOS without even having that I94 card, and social security number?

    I also just got a job but they wnat me to have MArican ID (social security/state ID card) I might loose this job.

    WHAT CAN I DO?

    This sitiuation sucks!

  7. I was required to get vaccinated with the new Gardasil vaccine before entering the US on a K1 visa. I got my first shot in May and am now due for my second shot. (the vaccine is one shot, then 1 more after 2 months, then another shot in 6 months) There have been reports of people dying from this vaccine and I really don;t want to get my other 2 shots.

    What can I do? Will I have to get them? Is there a way around this? When I apply for AOS will they be checking to see if I had my shots???

  8. So can I work before I apply for AOS? I get married on August 24...so 2 months from now. Is there anyway to work before applying for AOS and I-765? I never got an EAD stamp or anything....the guy at customs knew nothing about employment authorization. All I have is my passport with approved k1 and I-94. I am getting my SS# soon is that all I need to find temporary work to help pay for the wedding?

    I received my approved K1 visa on June 20 and entered the US on June 21, 2008.

    I am now trying to decide what to do now (besides plan the wedding) I was looking thru some information and realized that I should not apply for a SS# for 2 weeks after entering the US. I can not open a bank account or get an ID card without an SS#...so what do I do? Is it possible to find work? Is all I need to work a SS# or my approved k-1? I'm a little confused as to if I can work before applying for my AOS.

    The officer that checked my k-1 at customs did not have any work forms for me. Please help!

  10. I am living in Nova- Scotia and had my k-1 interview in Montreal on Friday the 13th. I got approved and was out the door by 9a.m.

    Does any one have any idea when my visa should arrive. I had a 2 day National Expresspost envelop for them so I was under the impression I should have it by now.

    I am booked on a flight to PA on Saturday morning. What are my options if I do not receive my approved visa by then?

    Can I go to PA anyway and have my parents send me my visa and then just go to the Philedelphia International airport and get the customs people there to activate it or do I have to stay in Canada and change my flight? Please help!

    I got approved!!!! It was no trouble at all. Now I just have to wait for my visa to be sent to me here in Nova-Scotia. I hope it comes soon!!!

    I have my interview in Montreal on Friday June 13, 2008!

    I am very excited, BUT VERY NERVOUS!

    I have a few questions:

    1. I sent my original and my US fiance's original Birth Certificates already....will this be a problem? Will I get them back in Montreal?

    2. I forgot to make a copy of my DS-156K..I sent the original and it is already signed. Will that be a problem?

    3. My criminal record check did not include fingerprints. Are fingerprints necessary? I saw that someone else needed them. Can someone please tell me if I need fingerprints done for my interview?

    4. My letter of Intent is Dated May 4 and my interview is June 13...should I get a more recent one?(May 4 was the last time I saw my US fiance)

    Here is what I am bringing to Montreal....does this sound good?

    ~My passport

    ~2 passport style photographs,

    ~$131 US CASH

    ~Medical, x-rays, and vaccination records

    ~I-134, Affidavit of Support (Notorized), letter from bank, letter from boss, pay stubs, bank statements (US Fiance)

    ~Letter of Intent (from myself and US Fiance)

    ~All letters, NOA1 and 2 etc...

    ~Photocopy of package sent to Vermont and to Montreal

    ~Proof of an ongoing realtionship (photos, receipt of engagement ring, e-mails, facebook chats etc..)

    ~Xpresspost envelop (National)

    is that all I need?
