  1. Hello everyone,

    I have entered the U.S. as K1 visa sponsored by my husband. Then we got married and filed I-485 form to adjust the status.

    I was told that the process will have an interview. What are questions they used to ask during the interview?

    If you have gone through this situation, please let me know what questions they used to ask. I am a little nervous and want to prepare first.

    Our interview was very simple. The all time the interviewer kept on talking instead of us and then he asked for the documents that he didn't have in his file and then he watched our marriage album....and done!....very simple as other ppl said...they can sense whether the marriage is fraudulent or not.

    You said you took an album to your interview,we have one from when we were dating and one from our wedding.Do you thing we should take both or just the wedding one?Our Interview is Aug 28.

    I would only take the wedding album. They are more interested in a "genuine" relationship so take the wedding album to show the marriage pics. The more pics the better it is :D

  3. Ok so we received the date for our interview and everything is all good. I think I have all the documents but one line concern me on the notice, it says:

    "All documentation establishing your eligibility for Lawful Permanent Resident status"

    I have all the "joint account" documents reflecting our marriage and all but do I need to take any specific documents for the above line? Please help. We are almost there.

    My mom is helping me co sponsor my fiance, and on question 8, it asks about depndents, she is married so iknow i have to write down my father, but is he wholly or partially, i mean, he works also, im so confused

    If your father is working, you will write partially dependent in your mother's I-129F. I filled my case in India so let me know if you need some help.

    yeah my father is, thank you, and hmm for the income, did you write both theirs, cuz their tax is joint?? thanks for your help

    hmm, I wouldn't know the answer to that. Hopefully, someone else can answer that here.

    6 months total from filling to get approved

    ok.. I'm just hoping mine doesn't take too long. Did your case go through delhi embassy? b/c mine will be going through there.. I'm little scared and hoping it doesn't take too long.

    It normally does take around 6 months and that is also if you do everything correct. I got 90% help from here and some from my friend who had filled the same case. Don't be too scared. Delhi embassy usually approves cases. Whenever you in doubt just pop the question here and ppl are friendly here to reply back. Follow the guide exactly and you will have no problem..

  7. Hi everyone,

    I'm still working on filing for fiance visa. answering question number 18 has been little challenge for me. as my marriage has been prearranged by my family. I met my fiance in India last month and we got engaged. now I have to answer question #18 and I'm little confused on how to answer that and I don't want my application to be denied b/c of not enough details. ever since we got engaged we have been talking on the phone and on line via emails and chats.

    so my question is.. will my visa be denied if I say my marriage is prearranged? and it's only been a month since I have known him? I do have the proof of meeting him last month and I also have pictures from our engagement ceremony. would this be good enough proofs?

    No sista you will not rejected just caz ur marriage is prearranged. I went thru the same thing, so you will be ok. Your engagement ceremoney pictures are more than sufficient. Just make sure when you send the pics, you send the pics that have other family members in the pics besides you two. In that section, you will be writing that your engagement was arranged with the approval of your marriages and that you two got together following the advices of your families and liked each other in that meeting and decided to get engaged. This is what I wrote in that section:

    "I and my fiance met in India in January 2008 following the advises of our families. In that meeting, we liked each other and decided to get engaged. "

    There was no problem at all with just writing those two lines.

  8. I just received permanent resident card which expired after 2 years.

    Should I be considered permanent resident now or I have to wait till I remove the conditions within 2 years from now?

    The reason why am asking this question is because

    On one of employment verification form it was asking are you

    1 citizen

    2. permanent resident

    2 alien eligible to work with DHS authorization.

    I know we can't choose US citizen but am confused whether we should we choose permanent resident option or the third option eligible work with DHS authorization.

    I don't think you should be posted this topic in this forum but to answer you, you will be picking "permanent resident". All permanent resident cards are subject to renewal after 2 years.

  9. Qeustion 13 is asking where your last point of entry into the USA was. Since a K1 visa only allows one entry, this will be where you submitted your brown envelope and got your I-94. An example would be if your POE was in O'Hare you would put Chicago, IL

    1) The very first question of this form:

    a) I am the petitioner. I filed or am filing for the immigration of my relative.

    Instruction:

    Check box "a" if you are the petitioner who is filing or whohas already filed Form I-130, Petition for Alien Relative;Form I-600, Petition to Classify Orphan as an ImmediateRelative; or Form I-600A, Application for AdvanceProcessing of Orphan Petition. If you are the petitioner, youmust sponsor each intending immigrant.

    Why K1 and K2, entry as a fiancee/child, are not listed in the instructions? Must we check box a if my husband applying for me and my son (K1/K2 visas adjustment)?

    2)Question 22:

    I am currently:

    self-employed as:_________________what shall be put in here - the name of the company?

    On the first question, if your husband applied for you for k1 visa, then you should be selecting "a"

    We're about to file I-130 and I-485. (I'm US Citizen, filing for my wife and she's here in USA)

    What would happen if we don't file the I-864 just yet? would they reject the entire package? or would they send us a letter asking to fill it out?

    I864 is a main form. Without this, they will not process your request of AOS. They may reject the entire package or ask you for that form to process your AOS.

In I-864 column 25 there are two options to mark (one is optional).In first one, it says i have filed federal tax .......................... 3 most recent tax years.But i didnot file tax return for 2007 and 2005 as income was zero (didnt work) and in 2006 income was too low.so again didnt file($18.00 tax return)

    So should i still mark on this box.Plus i will attach a wriiten explanation also as per instructions.(low income).So just want to know should i still mark this box.

    You will be marking the first box, it says:

    I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

    As long as you have sufficient current income, which is over poverty line, you will be fine. Just include the last year tax return and you will be good.

    From my own knowledge, you are fine. They are only returning the money which you sent extra. There is no fees from I-765 and I-131 and thas why it doesn't mention in the NOA. Good luck

    Ok, so we sent off the I-485, I-765, and the I-131... a few days ago we received a letter stating a NOA for the I-485.

    We also received a "rejection notice" stating that we had over paid for the I-765, and the I-131, the un-cashed checks ( for the I-765, and the I-131) were returned, and the letter stated...

    "Recently, you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application, or the incorrect fee was submitted. Your check is being returned to you with this notice. No additional action is required at this time. Please comply with any other reject notice you may receive."

    That's fine.. I thought we might have over paid for the I-485 (we paid more than the $1,010.00), but what does that mean for the I-765, and the I-131?

    We've received nothing regarding that thus far, and the only mention of any "case type" in the NOA is that I-485.

    Does this NOA cover the I-765, and the I-131? or no?

  14. Hello guys n gals. I recently applied for SSN for my wife. It will get here next week or so. I am ready to send the AOS package for her. I was wondering if I should wait for the SSN to come so that I can include her SSN # on the AOS documents. Is it worth waiting for a week until the SSN arrives or should I just go ahead and send the AOS package. What do you think?
