  1. Do you have to take the fingerprint on FBI fingerprint card or at US consulate or is it ok to request form from RCMP, take fingerprint at local police station in India and send it to RCMP in canada for processing.

    You can get fingerprinted at the local police station. Then send the form to the RCMP. I don't know if you can open the envelope first. I don't see why not though because you have to make copies of your PCCs before showing them to US government authorities.

    Police Records

    Inside Canada: Applicants who are physically present in Canada should contact their local police service or Royal Canadian Mounted Police (RCMP) office regarding criminal record check procedures. Applicants may obtain a certificate of no conviction issued by any Canadian police service so long as it notes that Canadian Police Information Centre (CPIC) or the national criminal records repository was searched using the applicant’s name and date of birth. Applicants should ensure that the search includes all names that they have previously used, including maiden names, prior married names, or names used before Canadian naturalization. (Note: Because records checks based on name and date of birth only are sometimes less thorough than those based on fingerprints, U.S. diplomatic offices reserve the right to request that certain applicants obtain fingerprint-based searches from the RCMP.)

    Applicants who have been convicted of a crime in Canada must contact their local RCMP office to obtain a “Certified Criminal Record Check,” which lists an applicant’s criminal history, indicating the section of the Canadian Criminal Code under which the applicant was charged, the disposition of the case, and the penalty imposed, if any. Obtaining a Certified Criminal Records Check requires submission of a fingerprint chart; the RCMP could take between two and twelve months to process a request for a Certified Criminal Record Check. (Note: If a namecheck by a police agency reveals a conviction record, that agency may be unwilling to issue a certificate and may refer the applicant to the RCMP for a Certified Criminal Record Check.)

    Canadian pardons have no effect under U.S. law. Applicants who have been convicted of a crime in Canada that was subsequently pardoned must contact an RCMP office to obtain both a Certified Criminal Record Check and copies of their pardoned criminal record. Additional information is available online.

    Outside Canada: Applicants who are not physically present in Canada must obtain a Certified Criminal Record Check by sending a duplicate set of fingerprints (taken by a local police force) to the RCMP. Fingerprint submissions must include the following:

    rolled and flat impressions of all ten fingers taken with black ink (may use a standard FD-258 FBI fingerprint card)

    full name, date of birth, and sex of the applicant

    the name and address of the police agency taking the fingerprints

    the signature of the official taking the fingerprints

    the reason for the fingerprint submission (U.S. visa)

    the processing fee of CAD 25.00 or USD 18.00, payable to the "Receiver General for Canada" by certified check or money order.

    Fingerprint submissions should be sent to: RCMP, Civil Fingerprint Screening Services, P.O. Box 8885, Ottawa, ON, K1G 3M8. Additional information is available online.

    Special note for applicants who reside or resided in Newfoundland and Labrador: The RCMP did not operate in Newfoundland before April 1, 1949. Therefore, applicants who were age sixteen or over in 1949 and who resided anywhere in Newfoundland and Labrador for six months or longer after reaching the age of sixteen must obtain a Good Conduct Certificate issued by the Royal Newfoundland Constabulary (RNC). Applicants should inquire at RNC offices in St. John’s, Corner Brook, Churchill Falls, or Labrador City, or may contact the RNC at: Headquarters, Royal Newfoundland Constabulary, 1 Fort Townshend, St. John’s, NL, A1C 2G2, tel: 709-729-8000.

    I recently had my interview in India and was given form 194 requesting fingerprint criminal record check from Canada. But due to my stay in Canada, I was asked to bring a fingerprint criminal record check from Canada. In the form 194 it states that "applicants requiring fingerprint must return to the consulate any working day at 2 pm for gingerprint must bring their form 194, passport, and etc." DOES THIS MEAN IT IS REQUIRED TO GO TO THE CONSULATE OR CAN IT BE TAKEN AT LOCAL POLICE STATION IN INDIA WITH FORM FROM "RCMP CANADA".

    My questions is:

    1. Does the fingerprint have to be done at the US Embassy or can it be done at local police station in India?

    2. Is it ok to open to result received from The Royal Canadian Mountain Police in Canada or does it have to be sealed before submitting it to the US Consulate in India?

  4. Police Records

    Indian Police Clearance Certificates should be obtained as follows:

    All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office. These are usually more dependable than those obtained at a local level and indicate that the subject had no serious criminal convictions on record at the time of passport issuance. Applicants whose Indian passport was issued within the past six months may present just the Passport Office Police Certificate, and need not obtain additional police clearances.

    Applicants over age 16, whose passports were issued more than six months previous to visa application, must also obtain a police clearance from the District Police Office serving the applicant's place of residence.

    Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.

    Thanks, but I am aware of all of this. My question is how many days does it take to get a District Police Office report. And what documents they require.

    Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.

    Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

    Can some one please tell me how long it takes to make a police report to be ready and either get picked up or in mail. Interview is first week of November in Mumabi, India.

    First one is the Police Passport Report? How long? Can it be picked up or its just mailed? We have this already.

    Second, Local Police report? How long? Can it be picked up or mailed ONLY?

    Also, what documents do they ask for in order to get a police report. Please help us.

  7. HELLO ALL,

    OUR INTERVIEW CASE WAS RECENTLY TRANSFERED FROM K3 TO CR1, IT IS A GOOD NEWS DON'T GET ME WRONG. BUT WE HAVE SUBMITTED ALL THE DOCUMENTS TO VFS FOR K3 SINCE WE WERE NOT AWARE OF THE CHANGE IN CASE.

    NOW WE RECEIVED THE PACKET IV FOR CR1 AND THEY ARE ASKING US TO SUBMIT THE DOCUMENTS (ORIGINAL POLICE REPORT, MARRIAGE CERTIFICATE, AND ETC.) FOR CR1. BUT SINCE WE HAVE ALREADY SUBMITTED THE DOCUMENTS TO VFS, DO WE HAVE TO DO IT AGAIN, OR WILL THEY TRANSFER THIS DOCUMENTS FROM K3 TO CR1 CASE INTERVIEW.

    PLEASE HELP....THANKS FOR ALL THOSE REPLY!!!!!

  8. As far as I know, I-864 is for AOS (CR1) and it doesn't need to be notarized. Only I-134 (K-3) needs to be. Others can confirm.

    I had thought that it was the reverse, because when I sent in AOS for K3 I was told not to have it notarized. Can someone else please confirm this. Please I really need help.

    THERE ARE TWO visa processes going on at the same time, CR-1 IMMIGRANT process, and K-3 NON-Immigrant process.

    I-130 IS CR-1 process, when approved it gets sent to NVC which generates I-864 Affidavit of support fee bill ($70), and later DS-230 fee bill ($400) these are for CR-1 visa NOT K-3. (I-864 is NOT Notarized)

    I-129F is K-3 process, when approved it rapidly passes through NVC and results is a K-3 visa interview, this requires the NOTARIZED I-234 Affidavit of Support brought to visa interview, because K-3 is a NON-Immigrant visa.

    Since the K-3 was dropped, the I-864 sent to NVC supersedes the I-134 which is only used for K-Visas, you should have a copy of the Affidavit of support that was sent to NVC handy for the interview.

    The petitioner had already send the Affidavit Packet which was recieved from the lawyer. It included I-1864 and NOT I-134 with other documents (tax, paystub, employment letter, joint sponsor...etc.). So if I am reading and understanding this right the interview should go fine. Since the beneficary have the I-1864 (NOT NOTARIZED) to submit. Right, so it should be ok?

    YESTERDAY I FOUND OUT THAT OUR K3 VISA WHICH WAS SCHEDULE IN NOVEMBER WAS CHANGED TO CR1, WHICH IS A REAL GREAT NEWS FOR US. HOWEVER, MY QUESTION IS REGARDING THE AFFIDAVIT OF SUPPORT.

    WE HAVE OUR AFFIDAVIT OF SUPPORT FOR K3 VISA HOWEVER, I AM NOT SURE IF FOR CR1 VISA THE AFFIDAVIT OF SUPPORT FORMS NEEDS TO BE NOTARTIZED AND SINGED BY THE PETITIONER.

    PLEASE HELP US, I AM NOT SURE AND INTERVIEW DATE IS GETTING CLOSER AND LITTLE TIME TO SUBMIT AND SEND PAPERS TO MY WIFE. PLEASE HELP.

    My question when submitting I-134 affidavit of support for petitoner and joint sponser do we need to have it notoraized. But our I-134 forms were completed by our lawyer does it still need to be notoraized or should it be good. Please help us.

    WE HAVE PAID OUR $400 FEE AT THE NVC FOR OUR I-130 OR CR1. DO WE HAVE TO PAY THE FEE OF $400 AGAIN FOR OUR I-129F IF WE PLAN TO PURSUE THAT PATH. OR CAN WE USE THE FEE WE PAID AT THE NVC FOR I-130/CR1. PLEASE HELP I AM NOT SURE WHAT TO DO AND OUR INTERVIEW IS IN SHORT TIME.

    I just called the NVC and found that they are asking us to complete the check list they are sending which includes biographic page of passport, original birth certificate, original marriage certificate, and etc., to complete our case.

    Just wanted to know if anyone else has gone through this and if this is a necessary step that everyone has gone through. Please help I am freaking out and need help. I do not want to send the original because we have K interview scheduled for November and we need to take the original there at the time of interview. Please help this is really worrying us please any help would be good.

    I have a quick questions regarding sending the packet of information (DS-230, employment letter etc.).

    We had sent our packet to the NVC last week of August 29, 2008. But when I call the NVC automatic line it does not say it has received the packet. Does anyone have any idea when this updates, does it update soon as they get the packet or it updates at a later time. Tried calling the NVC operator but could not get through because operators are busy. Will the operator be able to tell me if they have received it or not?

    PLEASE HELP...

    I am freaking out not sure if they have received or what is causing the delay please help.

  16. Hmmm...That message doesn't look familiar at all for a CR1/IR1. :blink: That is the exact text of the AVR message?

    Also, are you pursuing a K3 or CR1/IR1?

    What number did you give the Automated system? Was it your NVC case number or your USCIS receipt number?

    I am actually doing both K3 and CR1 but will go with which ever interview I get first. The actual recording after entering the USCIS receipt number said "package and information has been generated and will be mailed out in few weeks." This is for my I-130, my I-129F is already at the US CONSULATE in India, and we have sent the packet 3 for that last week and now waiting for packet 4.

    What is AVR message?

  17. When I called the NVC the automatic operater system says, "Document & Package Generated on 08/26/08" but we have not submitted are AOS, tax returns, and etc.

    What does this mean?

    When will we get this documents and package?

    Will it be mailed to the Foreign Embassy also?

    Or will it be mailed to Foreign embassy after we submit the documents here?

    PLEASE HELP!!!!!!!!
