  1. my husband was legal PR but he abandoned his status in 2010 and went back to his home country , ha has valid SS# , now that we got married i applied for him but he entered illegaly , the petetion is still pending so my question is can he get a DL in california without a green card? he has valid S# and expired ID card from last year . thank you

  2. It is definitely possible for them to deny your I-130 petition before the beneficiary can even apply for a visa/ get an interview, for example if you are considered inelligible to file for whatever reason (not properly divorced etc).

    Are you a greencard holder or a citizen?

    Is there anything weird about your background that could set them off, such as married to a foreigner before, criminal convictions, recently divorced?

    [/quoyes i am u.c citizen and i have very clean records . i was married to a u.s citizen for 18 years . my current husband was PR and he withdraw his application for admission back in 2007 and left the country and then i marry him one month later . he also has very clean rocord

  3. after waiting for 2 years and 2 months for my i-130 i finally heard from the congress office and it was bad news ,the lady at the congress office informed me that my i-130 is currently under review at the fraud unit at los angeles local office and she doesn't know why .they previously denied my i-130 back in 2007 for lack of evidence but i sent some excellent evidence with the new application , i have no idea why they have it there , any idea please? my husband is not in the country , are they going to deny it without interview ? what should i expect from them at this stage?

  4. 2 and a half years?!...yikes!this just proves how stupid this is,if you applied and have been for that long,and still are together,i would just assume they should logically accept you right away,since obviously it's not fraud(not saying people that are less than that time are frauds,but i mean it's just more proof you are together for love not anything else!)...couldn't they just save us the trouble and accept all,and like have visits to them within 5 years or something to see how genuine they are?until proven if they are or not,like within those 5 years?instead of separating all of us,and keeping us on hold!i am so sorry you had to wait that long!have patience though,and hope,and who knows?maybe your approval is on it's way to you :) Goodluck with your journey :)

  5. it was a mistake and even the officer told me that at the local office but then she said i can't do anything about it because it's been denied but go ahead and either appeal it or file a new i-130 . but it's very strange , i mean i have a denial letter back from 2007 , why would they pull that case two years later when i have brand new i-130 pending ? and they even change the online status msg . is it possible that they put both files together ? and if yes why would they do that

  6. as you guys know i have been waiting for the i-130 for little over two years . the first i-130 was denied at the local office two years ago and then i appealed it and later on i withdraw the appeal . a month ago i checked that old receipt number for some reason and the msg changed from denied to ( sent to another office for process ) so i added the case to my profile ( uscis website ) and i've noticed that they touched the case more than 7 times ????????? in fact they touched it after my current pending i-130 case ? is this normal ?

  7. I wonder why they are transferring your file from one place to another :blink: Do you know having a special case for any reason? I see it got to NBC just 2 months ago...maybe you'll get a reply this month...If not, I would send that letter too.

    but the transfer letter i received 70 days ago says to wait 15 days and iv'e been waiting 2 months and 10 days and nothing yet

  8. Hey, at the end of the day...anything that works is good enough I suppose, but did you try to contact your Congressman first? :innocent: I know USCIS HAVE to reply to a Congressman's inquiry in 48 hours...That might help! Best of luck!

    i sure have , congress,senator,ombudsman and nothing . ( your case is pending ) so i will give it a last try before i take the case to the court but i am afraid that he will just deny my case . iv'e read some scary stories about the director of NBC online . seems like hes a mean man according to the ppl who work for him . i really don't know ,im just confused

  9. is it a good idea to mention to the director of the national benefits center that i am going to take the case to the court? my case is still pending ( two years ) and i wrote a letter to the director and mentioned all my medical issues and requested expedite but i mentioned at the end of the letter that i am going to take the case to the court if they don't resolve my case within 30 days . a friend of mine tried it and her case was approved after she was stuck in the name check for almost two years , they approved her case two weeks after she sent the letter to the director of the service center . is it a good idea to mention court or not? should i write the letter again without mentioning court or leave it the way it is? thank you

  11. thank you everyone but i really can't move there . i see my doctors three times a week and if i move there that means i have to drive back and forth three time a week ( four hours to get there ) this would kill me and also i am not supposed to drive for more than 30 min a day . one time they got me on tape ( insurance company ) carrying two bags of fruit and i almost lost my case and this is why i need the surgeries in my lower back and neck . medical is very bad in mexico and i can't risk my life just to move there , i could end up losing my case which means i will lose my surgeries . i appreciate all the comments and the help

    two years delays . actually four years , i filed the first i-130 back in jan-2007 and was denied at the local office ten months later because they lost my file . they requested more evidence and they lost it after i mailed it to them so they denied the case :( this is my second i-130 , it has been two years and i need more than seven surgeries in my back and neck and i am permanent disable and i need my husband home . i am tired of this background ####### everytime i call . i know they have to but this is way to long and unfair . and i still don't understand why the file was sent to the national benefit center? the letter states to allow them fifteen days and its been 62 and nothing yet .iv'e lost my house and my car and been sued by several credit companies and even by my own bank . i send them letters from five different doctors and medical reports supporting my claim and they just send it from one place to another . they kept it 14 months at the local office in l.a and who knows how long the NBC will keep it there
