  1. When filling for a child under 18 years old do you also have to submit the I-129F or only the I-130

    I recommend filing an I-130 for each intending immigrant because they will need one filed either now or with their adjustment of status. If you do not file I-130 for each now, there is no chance of an immigrant visa. You will be limited to K3/K4 and need to file the I-130s later anyway along with AOS.

    If I were in your shoes today, I wouldn't file the I-129F at all. I'd go with the CR1/CR2 instead, but priorities do vary. You'll want to consider all this very carefully before acting.

    I could submit teh I-129F and olso the I-130 for my step child what is teh diference??

  3. My friends husband in the USA, working for over 10 years, and his interview was scheduled in Bogotá Colombia, he received notice in mail a week after the interview date, what should they do???

    A little more info would be useful-

    What sort of visa is he going for?

    Did he give his residence in Bogota?

    Is he legally in the USA?

    No he gave his address in the USA However he had someone in his Church do the application for him and they did the I-130 instead of the I-495 which he qualifies because his wife in Cuban, he has requested that they transferred his petition to have interview in the USA but no one has answer, I think he has going to submitted a I-495, he wanted to know since he already has a Approved visa do you think that he could have problems submitting the I-495???

Hmmm... well, the order my emails went in was: 'card production ordered', 'welcome notice mailed', followed by 'approval notice sent' (if you look at my signature, you can see how many days there were between them all, but they came in pretty quick succession) - I think that tends to be the order that most people (or many, at least) get the emails in. But if you received the welcome letter and have also had the email telling you your approval notice (ie green card) has been sent, then I wouldn't worry about the 'card production ordered' email - the USCIS automated emailing thing doesn't always do what it's supposed to, and the online status doesn't always update when it should either (my AP is still showing as 'received and pending', for example, when I received the document in the mail in mid-August!)... with any luck, you should be getting a green card in the mail any day now! How long since you got the 'approval notice sent' email?

    If my friend has not received the card and it’s been about 9 month, they went to the USA immigration office and they stamp the passport, with he’s residency #, however no card, is there a phone # or email I could send to someone for help???

In order to leave Cuba you need a exit permit and they are requesting a new letter of invitation to be send to the Cuba counselor, well we did however this is taking a very long time, and we are getting worried, to be in the safe side does anyone know the procedure on how to obtain a extension of the visa???? :crying::crying::crying::crying:

  6. have a friend that after the NOA 1 he received a email stating that they had send him some forms and that they were send back undelivered, he called and they told him to disregard the email because in the K-1 process there was not forms to be send, so after a few months he got a letter stating that his K-1 was denied, he called and they told him he had to send a form for more information and had to pay up to $10.00 an hours for the information, has anyone know what is this all about???? :whistle::whistle::whistle::whistle:

  7. Just to follow up on the topic Augustajim posted, I would like to hear people's feedback on "How do you show proof of having met in the fiancee's country and submit that proof to the government when travel there is not legal?"

    I know some of you all met your Cuban spouse during authorized visits because you are originally Cuban or had one of the special licenses (hard to get!) But there has to be some of us that met while travelling through a third country to get there. (not calling anyone out and don't want to start a legal ruckus on the forum, just putting it out there....) But does anyone know how the US government dealing with that issue in interviews:

    What do they say to you when you are sitting there telling them you met in Cuba when you were never supposes to be there in the first place (this is not an admission that I have done this or plan to but just wondering because I know some of us are not of Cuban heritage and have gone there without license, fallen in love, and wondering if that eventually comes up in this process)

    There is always the risk of a fine if you travel illegally. However, the folks at the Interests Section are really not interested in how you got there. It seems to be basically "don't ask don't tell". I have been there and spoken to officials in the visa section and also in the assistance to American citizens section. I have always travelled legally but I know others who have gone through the entire visa process and have not travelled legally and it just doesn't come up. Just show your ticket stubs as part of the evidence of your relationship and don't worry about that side of it.

    By the way, many people travel to Cuba legally through 3rd countries. Personally, I would rather go through a 3rd country than deal with Miami Airport.

    There is no many deferent visas to travel to Cuba, the only one that is not legal is a tourist visa, there is a religious visa, a study visa, people use all types of visa to travel to Cuba, I don't think that there is a issue on how a person got to Cuba to meat his or her spouse/fiancé, however since the visas or not issued immediately after you apply for them, there is a long waiting time one would have to really plan and have a exact time frame set up in order to have the visa issued and be in Cuba the day of the interview. that is why I think that one should not go to the interview.

  8. For all of you with Cuban fiance(e) or that know much about travel to Cuba I have a question for you. Does anyone know the limit for a tourist visa? I am thinking it is two months until you have to leave, but wanted to double check. Also does anyone know of ways to extend that stay besides leaving and reentering Cuba? Finally, for those going through the visa process with a Cuban SO... who bought or will buy the plane ticket for your SO to come here and from where did you buy it? I am asking being that US credit cards are not accpeted there and wanted to get some ideas. Thanks!

    Yes, there are lots of ways you could travel legaly to cuba, however to your question I have kown that ones you are in cuba you could get a extention to your visa, 21 days at a time for 6 moths, if you leave you need a new visa, and for the place ticket you have to pay for it in cash in Cuba, no credit cards from the USA.

  9. He did not take one I had to send the affivadit to the NVC, and I filled out the one they send me, the NVC acepted the affivadit, however the caunselor did not, I dont know why and I am not going to try to find out...

    Well, if you don't find out WHY, then you run the risk of being denied again because you STILL didn't provide them what they were looking for... now that would be REALLY sad...

    Better to find out from them what they want. Its probably something you can easily provide. You don't want to have to go through THAT again...

    Just a thought.

    I want to vent, I don't know what is going on I told my husband not to tell me when he is going back to the Interest Section, and know I am going insane. I know that he is in Havana so I cant even call him, this is really getting to me, this process is making me crazy. It is so hard, it is nerve braking. I miss my husband so much, I really need him nest to me to help me go throw this.

    That's what I was thinking too. It's easy to accidently fill out an older version of the form. Hope you get it all fixed quickly! :)

Well the day is almost here, on Monday my husband has his interview in the US Interest Section in Havana, I will have no contact with him till Tuesday, when he gets back to his home town, I am so anxious, I cant sleep, I am eating away everything that I see, This is really nerve wrecking.   13. Definitely a good heads up there, seems that they dont ask too much just some of the basics that Mary and Alix said. Probably nothing that you wont already be prepared for. Have you an idea of when your interview may be? Good luck with it.

    I am sure that my husband knows all those questions, however I want to make sure, if he fails to answer one of them its not going to be the counselor who he is going to answer to, its going to be me, jajajajaja!!!!
