  1. Well I haven't been in the forum for a long time but I just wanted to give you an update on my situation.

Well I arrived in Juarez Mex on Wednesday Jan 7th. I booked to stay in Quality Inn and I highly recommended it!!I have already had my required medical and was immediately sent to the psychologist due to having one arrest...(had an arrest for driving without a license) The psychologist was very nice and everything went fine.

I am now currently waiting for my first interview on Monday the 12...but will be staying till the 13th... because of the new policy of the counsel, the first interview will consist of taking your fingerprints, visa and will ask you a series of questions...then they will give you a blue slip to come back the following day to have your "real" interview.

The new policy works well I think because before one had to stand in line for hours...now one will only spend 1-2 hours max...they also ask for an extra day so that they can go over ones case carefully I believe...instead of doing everything the same day...I guess it was to rush full before.

  2. Hello everyone...I lost the letter that NVC sent me, telling me to go online and fill the DS-230...the letter also came with a white return envelope. I'm not sure if the letter also included a bar code such as the I-864 did.

My question is...Can I just provide my own envelope with the completed DS-230 and send it out?

I also was informed about the James Shortcuts where I can send out my DS-230 with no problem....but I don't know where to start...where do I go to get the information on sending my DS-230....or should I call NVC so that they can send me another return envelope?

You can send 230 in any envelope

    National Visa Center

    Attn: CMR

    32 Rochester Avenue

    Portsmouth, NH 03801-2909

you can make own cover page using james shortcuts, cover page contains address you are sending to, NVC case number and barcode. Below the barcode there is a visa class (IR-1 or CR-1)

I assume you did not pay IV fee online, otherwise you could print out another cover page.

    Good luck.

Thanks! but how would I know what kind of visa class am I? IR-1 or CR-1?

  4. Hi everyone...Well I received the information from the NVC to fill out my I-864. My wife couldn't be sponsor due to being a full time student. My step dad agreed to be the sponsor. My question is, do both my wife and step dad need to complete a I-864? :help:

Both the spouse and co-sponsor fill out an affidavit of support and provide supporting documentation but your profile says K3. If you received information from NVC about an I-864, that would be for a CR1 or IR1 visa case connected to your I-130. Are you pursuing both K3 and CR1 visas?

You know what, I am really confused  All I know is that My I130 was approved and right after I mailed the affidavit of support and payed the IV bill of 400 dollars. And just recently NVC asked me to send my I864.

  5. Yeah I will soon stop driving...I shouldn't risk something so important...

also, it's questionable if the owner of the vehicle's insurance would cover any accidents should you be involved in one. that too is a good reason not to drive.

Very true...I mean I now all the consequences that might occur...sometimes its really difficult to travel without driving...going to school and home is not a 5 min drive, so thats why driving was an option.

But seriously I have to get familiar with the metro system because I would rather use public transportation, rather than not being able to approve my case...

  6. Honestly, I don't think he did you any favors by saying to be careful when you drive. What happens if you have an accident? Is there no form of public transportation? It seems awfully risky to me. You were damn lucky.

Anyway, seeing as you weren't arrested, you don't have an arrest record, therefore no record to inform them of. People get stopped all the time to verify ID, etc.

I do think he gave me a huge favor...knowing he fact that I was not arrested...

Sure he did a huge favor by not arresting, but what I mean is that he didn't advise you to not drive at all, which to me is a wiser. If you get in any kind of accident, it's your fault and you don't have insurance, you are in a in a whole hell of a lot more trouble.

Yes, worry about one form at a time... if you pursue citizenship (thru N-400), that's something you may have to think about again down the line.

    Good luck and be careful.

    I understand...and thanks :star:

  7. Well I have a question since he stopped me, when I do have my interview in Juarez do I need to say I got stopped...I mean I did not received a ticket or anything...the only thing he did was type my name in the sheriffs computer for their records.

If asked, you should be truthful. If you choose not to be, that's your choice, of course.

And what is the likelihood the OP would be asked IF he/she had ever been stopped by the police at a random license check?

    Very true.

When you fill out your forms, you will have to check off if you have a criminal record. You either do or you don't.

I don't know what forms the OP will be filling out, or for what benefit he will be interviewing.

However, on the N-400, there is a question, worded as follows:

Have you ever been arrested, cited or detained by any law enforcement officer for any reason?

Whether the incident narrated by the OP warrants a "yes" or not depends, I suppose, on the precise definition of 'detained'.

You know you have a point...but isn't the N400 apply only to those applying for citizenship? I'm in the process of obtaining legal residence...hmm

That is correct. Like I said, I don't know what benefit you're seeking or what forms you're filling out. Read the forms carefully and use common sense. If in an interview, listen carefully and determine whether disclosure of this incident is expected or not.

And if you choose to purposely lie, be aware of the consequences before you do so.

Yes I will be very cautious on how I read and respond during interviews...I'm guessing that what they really look for is criminal records such felonies...but what ever the case might be, it is always best to be honest....thanks for the useful information..:)

  10. 2 hours ago I got stopped by the sheriffs on my way to school...First of all for everyone knows that is trying to legalize their status in the united stated you need to be clean with the police.

Well I got stopped because the cop was checking licenses. Of course I don't have one because I cant get one. He asked me if I had a drivers license and I said no. Then he went on to tell me that he could arrest me for not having a valid drivers license and thus receiving a misdemeanor. I said i understood but sometimes its necessary for me to drive...I said I had a final today and that the university that I go is far and that sometimes I need to drive. He then asked me why I don't have a drivers license, and I responded by saying that I cant receive one because I don't have a SSN. I then gave him the story on how I was brought here illegally when I was 2 years old and its been very hard for me not only to obtain a drivers license but to also get a job, establish credit and many other things.

He then asked me what was I studying and I said Fire Administration and that I will be graduating with a bachelors this year. He's eyes then lit up and said firefighter? and I said yeah I want to serve the community, be part of the law one day to make a difference. After that he said that i looked like a very honest guy...and that he was just going to check my car as a requirement and if everything came out clean he would let me go. Finally everything was clean my name my car and he let me go. He then went on by saying that I should be careful and drive only when necessary...he also said that he came from an immigrant family and that he really understand me...

He was a really cool cop (Asian background)...he technically should have arrested me and gave me a ticket...but he saw that I was doing the right thing which was going to school to better my self so that one day I can serve the community.

Well I have a question since he stopped me, when I do have my interview in Juarez do I need to say I got stopped...I mean I did not received a ticket or anything...the only thing he did was type my name in the sheriffs computer for their records.

  11. I've heard a lot of stories about kids just like you who didn't ask to come here, were brought by parents, and then have no legal route toward citizenship. Is it the case that you could join the military?

I'd see an immigration lawyer. It would suck for you to have to leave the only home you've ever known.

Yes I have tried to enlist but one needs a social security number, ands that's something i don't have  I've talked to many lawyers and say most likely I will have to leave...it really does suck...

  12. i guess the question would be how have you lived here all this time without some sort of green card or visa?

Well I actually just "lived" here like everyone else...I mean I completed preschool through high school with decent grades...never got into trouble...I guess you may say I have been here illegally but without a choice. I have never been to Mexico (my birthplace) and I am currently attending a 4 year university and have never worked here illegally...its unfortunate for my situation being raised here with basically no hopes in workig, driving, voting etc...

  13. My wife petitioned for me with the case type I130 and was approved 3 weeks ago, but in the approval notice it stated that I am not eligible for an adjustment of status. The USCIS already forwarded my petition to the NVC ant the NVC already sent me the Choice OF address and Agent paper work as well as the Affidavit support I864 bill that I need to send a payment.

My question is, is it going to be required for me to leave the US and for how long? I've been here 23years (25 now) brought to the US as a baby. I hope I don't leave because I will be graduating early next year from college and planning to attend graduate school... :help:

Another question, As of right now how long do you guys think I will receive my green card?

    Thanks.
