Thanks a lot for the reply. I got some new details here. So my friend already applied for I-90 but the real problem is she needs to verify her employment eligibility. She has her valid DL but her SS card has the old wording on it since back many years ago "valid with DHS auth only". So, what are her options on proving work eligibility?

The only thing I found is this section in I9:

"If an employee is unable to present a required document (or documents), the employee must present an acceptable receipt in lieu of a document listed on the last page of this form. Receipts showing that a person has applied for an initial grant of employment authorization, or for renewal of employment authorization, are not acceptable. Employees must present receipts within three business days of the date employment begins and must present valid replacement documents within 90 days or other specified time".

Any other thoughts?

A friend of mine is having some trouble. I do not know how she got into US in the first place (yet) but her 10 year green card expired in february. To the best of my understanding of green cards if it is a 10 year one her card is expired not a status. If you agree what are her options now? Can she apply straight for citizenship or does she need to apply for another green card first? If so what form?

You're supposed to sign it exactly the same way as you signed it on the photo that is on the certificate. Congratulations!

Dear Members!

Long story short receiving the final piece of my immigration journey did not go smoothly after the interview but it final! I remember that officer said that there are going to be instructions with my naturalization certificate on how to sign and else but I never received those. Could you please share what is it about those instructions I need to know so I can finish this up and apply for passport tomorrow.

Hey everyone! I passed my test on Tuesday but got my oath delayed for a week. The officer I talked to when scheduling my interview said that I can do test and oath the same day so I was excited but in the end I got a paper stating please come back in the week for oath. I think thats because I relocated to a different state after filing the application since IO asked me a lot of questions such as when did you leave the old state, where do you currently work, when did you start there and such. Hopefully they won't tell me to come back another day next tuesday;)

Just a note for those who will have to relocate in between sending your application in and getting the interview. AR-11 and change address for a pending petition online is not enough, call, call, call USCIS to make sure your case is straight!

Dear Members!

Well, the time has come to begin the last phase of this journey! But as always, things just cannot be easy for me.

Here is the deal. My hubby is getting new orders next month and he is very sure we are PCSing overseas. I am ready to file for citizenship next week. I did hear in the past that if there are military orders present any immigration process can be accelerated. So I called USCIS to make sure and they gave me a list of the situations in which my application can be expedited, but they are all in the smart form, so noone could specifically tell me if I can expedite citizenship based on orders. So, the questions are:

1. Can I expedite N-400 based on my honey's PCS orders overseas?

2. Will it cost us (expediting)?

3. Can I file now and expedite once we receive the orders?

Any other info you would like to share on the topic - feel free!

Vermont, can you please hurry up. It's been almost 6 months. My driver's licence expires May 12 and In NJ I need my green card to get it renewed. We're down to the wire, but i know you can do it! Please! You're stressing me out!

I am with you on that one. My hubby is in the military and I am going to visit the state of residence we both maintain in 2 weeks. I hope I can renew my licence but I need my GC for that too. If I am not gonna get approved now then I will have to go again once I am. So inconvinient...

Thank you. Just to clarify, He got his conditional greencard shortly before we met. He and his wife went to the interview. She put him out right after that.

I feel like you need to concentrate on collecting evidence of the fact that he got thrown out of the house BEFORE you met. Although I am not an expert but this sounds like a WAWA case to me, but I am not sure if he can still file another I-751 WAWA style after first I-751 denial. The other important thing right now though is keeping an eye on his legal status. Since he has been denied he has probably received a letter of removal proceedings. Just keep in mind that if he can't get his 10 yr GS this way then he will have to leave the country and you will have to start the process all over again (K1, K3 or CR-1) because he originally came on K1 and his legal presense in the USA may be vital for that to come through.

We have one realtor and two loan officers that we contacted to do this for us. When the time comes will choose the one that is more convenient for us. One of them asked for the sun and the moon, meaning all sorts of papers, phone numbers of tax lawyer that we used to file our taxes while we were on cruise ships, comcast, at&t, etc. Also she asked us to do an explanation letter as well. The other guy who we work for was really on top of things ...very quick, he got us a pre-aproval letter in a day, and he is not asking as much as the other lady. The only thing he told us to do is pay 1000 up front for the student loan to keep it under 5k, that's all.

We saw a home that was apraised at 320k, and the asking price is 184k, we put an offer on it for 164k and fingers crossed they will except it. Also i'm not sure if it's only in Virginia, but an option that we have is to do a agricultural loan, where we put no downpayment and we don't pay for the mortgage insurance , that can save you 100 dollars from your monthly mortgage, the only thing is that the house has to be in a specific area. Tis area we are looking into is up and comming, a lot of farm land, and a military base, no bad neighbourhoods or anything like that...it's just that is 30 min away from the city....but the home is 3200 sq/f so we are happy with driving

It's such an amazing time for us, as i will hopefully get my green card soon, and i can start going back to school, we are buying a home, it's so overwelming...in a few years when i will be a nurse, having a great home, i will look back and laugh at all the craziness that is happeneing right now...but hey..baby steps...will get you there!

Loan officer who is asking for all the papers is doing a right thing because numbers may not show the entire picture up front. You may get pre-approved based on numbers but then later on when it goes to underwriting things may change based on additional paperwork they need. When it comes tomortgage it is better to go an extra mile with pre-approval.

Thanks for the reply. I'm sorry I keep saying he/we. Everything is he. Since we are not legally married(yet), all of the paperwork thus far has been filed independently. Yes, his wife put him out after she abused him mentally, emotionally and financially. He moved in with his cousin. About a month later i met him. We became friends and soon after started dating. He was very honest with me about his situation the entire time. We fell in love and i asked him to move to GA from FL (I live in GA and he lived in FL). He did, and we've been living together happily ever since (3 years). He filed his i751 on time with the extreme cruelty waiver. He could not file with the divorce waiver because he is still not divorced. he was afraid to file for divorce because he was told he could not be in proceedings when he filed his i751, so he waited, filed the i751 and is now ready to file for divorce and we plan to marry. I hope that clarifies everything. I think an option may be to file another i751 using the divorce waiver after the divorce is final. It's my understanding that the IJ will not order deportation if another i751 is pending? I don't know if that's true? He was also considering i-360, but if they said he didn't have enough evidence on the i-751, then the i-360 may have the same outcome.

Do you know when he received his first GC? Divorced or not the actual relationship with his wife fell apart too fast and thats what immigration cares for. Talk to a GOOD lawyer. This case may have more complications if you marry and try to adjust together since he came on K1 and can only file for immigration benefits with the original petitioner. God bless.

Four weeks is the window of opportunity to file a motion to reopen your denied petition case. That's the "action" they're talking about. You can't file a motion to reopen without either evidence that USCIS erred when it denied the petition (they didn't), or new evidence that would counter the reason for the denial. If you don't get the waiver before the four week window expires then you can't file the motion. As you presumed, it would be denied.

For all practical purposes, it sounds like your petition is dead. You're going to need to refile once you receive your waiver. Yes, you will need to do everything over again, including paying all of the fees. The possible exception is the I-130, since that's a separate petition filed by your US citizen spouse. If that's approved then you include a copy of the approval notice with your new I-485.

I suggest you don't use the same lawyer the second time around.

Seriously, how can you call yourself a lawyer andbe such an i###t. I hope doctors are not just calling themselves doctors...or pilots... Sorry, it is just really pi###ng me off when crooks like that try to take advantage of the immigrants. We should start a forum on which lawyer to hire and which is a crook. Anyway, if I-130 is pennding attach a copy of NOA1 from it to the new I-485 along with the waiwer, if I-130 was approved then attach NOA2.

Well, it can be a trouble along the way but it is definetely fun once you close!

We have been throught hell on our first home purchase so let me tell you how to avoid the bad and make it great!

First, get PRE-APPROVED for a mortgage!!!!! No raltor will speak to you without that. Pre-approval makes them see that you are serious.

Second, organize your cash, if you have down payment get that on the savings or something to have it ready when you are. In addition, you gonna need an earnest money deposit which will go to the seller with your offer like a promissary that you are going to close the deal (cus if you were to be denied for a mortgage the day before closing, trust me it happens, the seller gets to keep this money, so take everything seriously). DO NOT LIE on the pre approval, it may result in denial later. Remember, mortgage Pre-approval is not like a car when you go and buy a car with it, bank can still deny you until deal is closed.

Third, once pre approved ask bank if they have some kind of local agent referral program, if they do they should connect you right away. If you use referral network they may actually give you some money back they collect from the sellers closing cost in the end. The ternd in VA lately is that seller pays all closing costs so better for you, but do discuss that with your realtor cuz if not you gotta have that cash ready too.

Forth, find you dream home, make an offer, wait 24 hours.

Fifth, when your offer is accepted the most difficult part begins. Provide EVERITHING your loan officer is asking for FAST, DO NOT use your credit cards, DO NOT make any purchases on credit, find strength to break a deal and walk away from the houseif there is a "cloud" on the title (in this case scenario you will get the earnest back).

If you make it to the settlement table you WON.

I would not recommend purchasing your first home by yourself without a realtor, but I will definetly consider doing so on the second one.

Wow I can see how this can be scary.

We aren't quite to the point of applying for ROC yet, but trying to start gathering stuff up.

As of right now, we have the DL with same address, all the insurances, ie. car, life, medical, but my biggest concern is the utilities are all in my name and when I questioned the bank, the only way I can get my husband's name on our mortgage is by refinancing it. NOT planning on doing that right now!!

Is there some other way to get his name on the house?

You shouls be able to put it on the deed. Our mortgage is on hubby's name but deed is on both, however, things have been done like this at the time of purchase.

In addition to all the jount evidence I would also recommend detailed cell phone bills which show how much you call or text each other, pet adoption papers if any, not just checking acct or credit card statement but the breakdown by cardholder showing how much each one spands (shows that it is not only joint, but being used as joint).

Same happened to me. I called USCIS prior mo mailing my stuff and they had a new address on file but reminder came as redirected mail from the old one. I just put new address on all the forms and that did the trick.

Well, I am not at this stage yet but you all know time flys. Me and hubby thinking of changing names. His name is a very common hispanic name. So every time we are at the airport he is getting grilled or if we apply for credit, lease his background check takes too long. The question is, can I change my last name when I apply for citezenship? For Example, lets say my name was Anna Ramirez, can I put Anna Johnson and show court documents that my husband also filed for a name change?
