The child isn't your daughter-in-law, that would mean she married your child. She is your Step-daughter which makes her an immediate relative.
You don't do a ten year extension, that you do is support your wife in filing for Removal of Conditions on her Residency.
For the child, you file an I-130 Petition for an immediate relative. The relationship you need to prove is that you're married to her mother so you will provide the child's birth certificate, your marriage certificate to her mother, your birth certificate or passport pages to prove you are a US Citizen.
Since she is so young no G-325A is required for her.
The rest of the process will be almost identical to IR/CR-1 even though she will be IR/CR-2.
Ya lol ,daughter-in-law that would be complicated. I forget all the terminology about visas ,seems like it’s been so long since I did my wife’s and I don’t look forward to doing her RCR but it’s better than paying some incompetent immigration lawyer that might mess it all up. Do you happen to know the amount of time it takes? I was thinking that it would be a much faster process then the last one I did which was very hard considering I was in Iraq at the time and it took 6 months. Thanks for your response

So me and my wife have been married for a couple years now.She is here on a 2 year green card ,next year around July is when i have to to the 10 year extension.She has a 7 year old daughter who is still in Thailand that we want to bring to the states now. I know i need to file a i-130 but i can't find any info on all the step that i have to do.Can someone please guide me through the steps.Also how long does it take to get a visa like this approved and do i have to wait till next year till her extension is done?Can i sponser her or does my wife have to? No offence to you forum rats or whatever you are called but i would rather get a response from someone who has experience with this type of Visa.Thanks in advance

my wife came on cr1 about a month ago and she got her gc but we had to go to local ss office for the card, u can just contact the local office for ss card. good luck. abby n sheryl

Hi my wife entered the states with a cr-1 visa on the 22nd of Sep.She received her green card today.I was told by a friend that he was positive that with this kind of visa she would automaticly receive her visa in the mail within couple weeks of entering the states.Can anyone confirm this for me.Thanks

Has anyone here submitted a laminated birth certificate for the ds 230 and do you think it will be a problem?Im a little worried about this cause i know how the us goverment is .....

Normal Thai birth certificate is fine, along with the translation.
On the nvc website it says."Annotation by the appropriate authority indicating that it is an extract from the official records "
her birth certificate has nothing like that on it.Did the one that you used have any goverment seal? thx

Hi we sent the ds 230 packet to the nvc with a copy of her birth certificate that had been stamped and attached to translation by the ministry of foreign affairs.i was told by the nvc when i called to find out about progress that we had to send her original birth certificate.My question is does the og birth certificate have to have any special stamps on it like say one from minestry of foreign affairs or hospital or anything like that or is just a normal thai birth certificate fine ..Thanks in advance

I sent in my I-864 form the other day had a few questions.I was told that only including the most recent years tax return was fine.Is that ok? Also my 2006 gross income was under the poverty levels due to school do you think this will be a problem?
I sent mine this morning and also only included 2008's return. I was way, way, way below the poverrty level for 2006 and below for 2007 (maternity leave). The one tax return should not be a problem - that is all they say they require. Also why would they need more to prove you were under the guideline. Did you include an employment letter too?
I didnt really include an employment letter just a monthly earnings statement im in the army so that form should be obvious that im employed.

OK so month and half ago payed iv bill and I-864 bill online.Figured after that would get proper forms in the mail but when they didnt come i looked on the site where i payed and seen that i had to print out cover sheets and mail them in with corresponding documents.So my question is on the guide on this website it says that u only send the NVC a filled out ds-230 from and copy of info on passport.However when i looked on the visa website it says that the NVC handles all the paperwork and that i need to have my wife send in the ds-230 form along with ,marrige cert ,birth cert,ect ect.These are all forms that i thought were just needed for the final interview besides the ds 230.Also it says that each form has to have an original,a photo copy and a translation.My wife is smart and she reads and speaks english very well but this is still alot for her to handle and i cant really help her cause im in iraq right now.Here is a link of the visa website http://travel.state.gov/visa/immigrants/in...ml#certificates

I know i could have probaly found this info somewhere on this site however my internet is so slow i dont really have that option.My question is how long would it take for me to get my first NOA.I sent the visa application around october 30th and they cashed my check on the 7th of november it is now December 18th and i have not heard anything from them.Is it noromal to take this long and to hear nothing and is there a number i could call to find out what is going on if there is a problem...thx for ay response

I don't have the form right in front of me but at the bottom of all the boxes you put those numbers in there should be two colums. The first column should be a "1" and the second column a "2" as you should have that first 1 in the column on the left side at the beginning. I know it sounds confusing as I don't have a better way to describe it.
I think i understand plus i didnt read the top part it says not to count anyone twice so..These visa things are a pain in the A%$$# this is the last time i marry a foreigner )p btw thx for the help

Ok a little confused on the the I-864 form.Its about section 21 (household size) under A it asks enter number from line 10 which is 1 then after that it says Persons NOT sponsored in this affidavit: line B enter 1 for yourself... line C If you are currently married, enter "1" for your spouse.So that make no sence cause my spouse is who i am sponsoring and if i add all the lines together that makes my household size 3 and my household size is only 2.So all that makes me wonder if i am going to need this form thx in advance....
I got confused about that too, but I sent mine in and had no problems. You do have to send the form in. Put a 1 under A. Then put 1 for yourself and 1 for your spouse. Then when you add it up you will have a 1 in the first box and a 2 in the second box. Don't ask me why it is so confusing but that is what I did and it was accepted just fine. I posted this topic before and someone else told me it was fine so others have done it as well.

First of all, thank you for your service!
secondly, you can put your brother's address as your address on the I-130 and that way it will be sent to your brother's house. Also, you will likely want to file as soon as you can and then file for an expidite since military service is a reason to expidite.

I have thought of going that route but i was worried that might create some problems when they see that my address is diffrent on my 325a and if i change the address on both of them then wouldnt that be considered lieing to them.Do you think i i wrote a letter explaining the situation that it might help.
