Jejeje Kim, Russell is not the only one that books the wrong date or the wrong COUNTRY... Mistakenly, they book Nico that he was leaving from another COUNTRY … I made the payment and when I was looking at the itinerary I notice that nowhere it says Montevideo, where he is leaving from. So, I called the agency cancel that ticket and bought the right one. Thank God, I notice the same day and they refunded the first ticket…

I guess with all the excitement we just overlook things jejeje.

Now, we are planning a small wedding and I am just anxious for him to get here

Question: Nico received his visa stamp in his passport but in the annotations it doesn’t say anything about who petition him or anything like that. There is nothing written in annotation. I have done some research and see that usually the ones with K1 Visa have written in the annotation the petitioner fiancé’s name. Does that mean something?

Also, I hope that he finds a job soon so he won’t get bored or frustrated being home all day alone while I’m at work.

Today we got our interview date and its for Thursday September 18

I know pretty quick and its just around the corner. The weirdest thing happened, my fiance went to drop the documents at the embassy when the person at the front desk by mistake though it was his interview date and told him to go inside and talk to so on so. He did and it was the interviewer, she told him that the forms were incorrect and to fill them again and come back on Thursday at 2:30PM

Esta oficina ha recibido una petición que le confiere registro para Visa de No-Inmigrante, extranjero/a que viaja a los Estados Unidos para casarse con un/a ciudadano/a de los Estados Unidos. A fin de prepararse para su entrevista con un funcionario consular, por favor lea y siga cuidadosamente las siguientes instrucciones:

Primero: Obtenga, complete e imprima los formularios que se detallan a continuación en http://travel.state.gov/visa/frvi/forms/forms_1342.html :

DS-230 (Parte I), Solicitud para Visa de Inmigrante y Registro de Extranjero.

DS-156 Solicitud de Visa de No Inmigrante (dos formularios)

DS-157 Formulario Complementario de Solicitud de Visa de No Inmigrante (si usted es de sexo masculino y tiene entre 16 y 47 años, también debe llenarlo en duplicado)

Si sus hijos solicitan visa junto con usted también deberán completar dos formularios DS-156 por cada hijo y dos DS-157 si correspondiere.

Segundo: Obtenga, complete e imprima el formulario DS-156K, Solicitud de Visa de No-Inmigrante para Novia/o pero NO lo firme, http://travel.state.gov/visa/frvi/forms/forms_1342.html

Tercero: Obtenga los documentos de esta lista que correspondan a su caso

Pasaporte: el pasaporte debe ser válido para viajar a los Estados Unidos y debe tener por lo menos seis meses de validez con posterioridad a la fecha de emisión de la visa. También deberá presentar pasaportes anteriores

Certificado de Nacimiento, legalizado un certificado de nacimiento de cada persona que figura en la solicitud. Además, se deberá presentar partida de nacimiento de todos los hijos solteros menores de 21 años aunque no soliciten visa con usted en este momento. En el certificado deberá constar la fecha y lugar de nacimiento y el nombre de ambos padres.

Certificado de Nacimiento No Obtenible: si no es posible obtener el certificado de nacimiento, presente la mejor evidencia secundaria posible, tal como certificado de bautismo, certificado del sanatorio, registros escolares y/o declaraciones juradas certificadas de sus padres.

Certificados de Antecedentes (Buena Conducta) legalizados: todo solicitante de visa mayor de 16 años deberá presentar certificado de antecedentes emitido por las autoridades policiales del país de su residencia actual y de todos los países donde haya vivido por más de 6 meses desde los 16 años y/o de cualquier lugar donde haya sido arrestado sin importar la edad ni el tiempo que haya vivido allí. NO necesita obtener certificados policiales por períodos de residencia en EEUU. Los certificados de policía no son obtenibles en algunos países; puede consultar con la oficina consular por ciertos países en particular. Tenga en cuenta que el certificado de Antecedentes del Uruguay es válido por 90 días únicamente.

Antecedentes Judiciales y/o Penales: las personas que hayan sido condenadas por algún delito deberán obtener una copia certificada de los autos judiciales o de cualquier antecedente penal aunque luego se hayan beneficiado de una amnistía, indulto u otro acto de clemencia

Evidencia de Manutención: deberá presentar evidencia que demuestre que ni usted ni sus hijos, si los tuviera, se convertirán en una carga pública para los Estados Unidos. Deberá presentar, del peticionario estadounidense, la declaración de impuestos más reciente y una declaración jurada de sostenimiento, formulario I-134, http://www.uscis.gov/portal/site/uscis.

Examen Médico: deberá hacerse un examen médico con alguno de los doctores que figuran en la hoja adjunta. El costo del examen médico es a cargo del solicitante. También necesita un examen médico cada hijo que lo acompañará.

Evidencia de Vínculo: se le podrá pedir que presente comprobantes de que usted mantiene una relación legítima de novios con el peticionario. Por lo tanto, sería de utilidad que traiga consigo cartas, fotografías, facturas de teléfono u otra evidencia de su compromiso.

Carta del Solcitante estableciendo que está legalmente habilitado y tiene la intención de casarse con el beneficiario dentro de los 90 días de su ingreso a los EEUU. Aunque no es un requisito en algunos casos podría ser conveniente que quien hizo la solicitud esté presente el día de su entrevista con el oficial consular.

Traducciones: todos los documentos que no estén en inglés o en español deberán ser traducidos al inglés por un traductor público con la correspondiente certificación.

Solamente se requiere un original de cada documento, excepto las fotografías. Sin embargo, se le recomienda obtener y guardar un duplicado de cada documento para sus archivos.

Cuarto: Tan pronto como haya obtenido todos los documentos que correspondan a su caso lea cuidadosamente la declaración adjunta, fírmela, póngale fecha y devuélvala a esta oficina junto con los formularios completos: DS-230, DS-156, DS-157 y DS-156K; I-134, fotocopia(s) de pasaporte(s), partidas y/certificados y fotos carné a esta oficina.

Una vez recibida esta documentación se le citará para la entrevista para solicitar la visa tan pronto como sea posible. Deberá traer los restantes documentos, pasaporte vigente y anteriores y evidencia del vínculo el día de la entrevista. El costo de las visas tipo K1 y K2 es del equivalente a $131.00 (ciento treinta y un dólares) c/u, pagaderos al momento de su entrevista, en pesos uruguayos y en efectivo, a la tasa de cambio interna de la Embajada de los EEUU.

Instrucciones para los Examenes Médicos

Para hacer la solicitud formal de una visa de inmigración se necesita un examen médico que consiste de una placa de tórax y un análisis de sangre de los solicitantes de 15 años o más. Para estos análisis se debe concurrir a uno de los laboratorios mencionados más abajo, llevando consigo el pasaporte y esta hoja. La placa de tórax no es un requisito para las mujeres embarazadas.

Los solicitantes luego deberán retirar sus resultados de los laboratorios y llevarlos consigo para realizar el examen médico general, el que debe efectuársele a TODOS los solicitantes sin tener en cuenta la edad. Para ello se debe concurrir a uno de los médicos indicados a continuación. Para la consulta con el médico también se debe llevar el pasaporte y la carta con la hora de entrevista.

Usted debe solicitar hora por teléfono a la(s) clínica(s) y al médico antes de ir. Sírvase mencionar que los exámenes son para la visa de inmigrante para los EEUU.

Estos exámenes no son entregados al interesado sino que es el médico quien se encarga de enviarlos a la Sección Consular de la Embajada de los EEUU en Montevideo.

Los honorarios para los análisis y exámenes médicos son a cuenta de los interesados.

Informacion Importante para los Solicitantes de Visa de Inmigrante

Acerca de los Requisitos de Vacunacion

Recientes cambios en la Ley de Inmigración de los Estados Unidos requieren que los solicitantes de visas de inmigrante obtengan ciertas vacunas (especificadas más abajo) antes de la emisión de una visa de inmigrante.

Instrucciones y Guías de Procedimientos

Los médicos oficiales de la Embajada ahora tienen que verificar que los solicitantes de visas de inmigrante hayan cumplido con los nuevos requisitos de vacunación o, que es médicamente apropiado, que el solicitante reciba una o más de las vacunas que se enumeran a continuación:

Triple Viral (Paperas, Sarampión, Rubeola), Polio, Triple Bacteriana (Toxoides de Tétano y Difteria y Tos Convulsa), Hemophilus Influenza Tipo B (HIB), Hepatitis A y B, Rotavirus, Zoster, Varicela, Meningocóccica, Anti-neumocóccica y Antigripal.

Con la finalidad de ayudar al médico oficial y evitar demoras en el procesamiento de la visa de inmigrante, todos los solicitantes de visa de inmigrante deben llevar sus comprobantes de vacunación para ser revisados por el médico en el momento de practicar el examen médico para la visa de inmigrante. Los solicitantes de visa de inmigrante deben obtener una copia de sus comprobantes de vacunación de su médico habitual, si estas estuvieran disponibles. Si no tiene comprobantes de vacunación, el médico oficial lo ayudará a determinar qué vacunas necesita para cumplir con los requisitos. Existen ciertas exoneraciones del requisito de vacunación con la recomendación del médico oficial.

Solamente un médico puede determinar cuáles de las vacunas mencionadas son médicamente apropiadas a su caso tomando en cuenta su edad, historia clínica y estado actual de salud.

En caso de ser necesaria la aplicación de alguna de estas vacunas, tenga presente que tienen un costa adicional de:

Hepatitis A (pediátrica) $ 720.00 cada dosis (dos dosis)

Hepatitis A (adultos) $ 920.00 cada dosis (dos dosis)

Hepatitis B (hasta 18 años) $ 540.00

HPPV (damas 11 a 26 años) $4,220.00 cada dosis (tres dosis)

Análisis para HIV

Si usted tiene 15 años de edad, o más, se requiere un análisis de sangre de antincuerpos al Virus de Inmunodeficiencia Humana (VIH) como parte de su examen médico. VIH ó HIV es el virus que causa el Síndrome de Inmunodeficiencia Adquirida (SIDA). Sida es el nombre que se le ha dado a un grupo de enfermedades que pueden afectar a las personas infectadas con el HIV. La infección con HIV causa una deficiencia en la inmunidad natural de las personas contra las enfermedades. Esta deficiencia deja a las personas infectadas vulnerables a enfermedades serias que normalmente no serían una amenza a las personas cuyo sistema de inmunidad está intacto. Este análisis no es para diagnosticar el SIDA sino para detectar los anticuerpos al virus. Si el resultado es positivo, no necesariamente significa que usted tiene SIDA o que lo va a contraer.

Los resultados de su análisis serán entregados al Oficial Consular.

HIV Testing

If you are 15 years or older, a blood test for the antibody to the Human Immunodeficiency Virus (HIV) is required as part of your medical examination. HIV is the virus that is the cause of the Acquired Immune Deficiency Syndrome (AIDS). AIDS is the name given to the group of illnesses which may occur in persons infected with HIV. Infection with HIV causes a defect in person’s natural immunity against disease. This defect leaves infected people vulnerable to serious illnesses that would not usually be a threat to anyone whose immune system was intact. This test is not to diagnose AIDS but to detect antibodies to the virus. If the result is positive, it does not necessarily mean that you have AIDS or will get it.

The results of your test will be provided to a Consular Officer.

Información Importante para Solicitantes de Visa de Inmigrante HIV Positivos

Inelegibilidad según la Ley de los EEUU: La Sección 212(a)(1)(A)(i) de la Ley de Inmigración y Naturalización prohíbe la emisión de una visa de inmigrante a cualquier persona que tiene una enfermedad comunicable de significancia para la salud publica. El Virus de Inmunodeficiencia Humana (VIH), que puede llevar al Síndrome de Inmunodeficiencia Adquirida (SIDA) es una de esas enfermedades. Durante el examen médico para visa de inmigrante, el médico analiza a todos los solicitantes de más de 15 años de edad por infección de VIH. En los casos en que el médico tenga motivos para creer que un niño menor de 15 puede ser VIH positivo, puede ser necesario hacerle un análisis de sangre. En cualquier caso en que un solicitante sea VIH positivo, el oficial consular está obligado par la ley estadounidense a negar la visa.

Superación de la Inelegibilidad: Un solicitante VIH positivo que sea el esposo/a, hijo/a (no importa de qué edad) o hijo menor de un ciudadano estadounidense o de un residente permanente (portador de una green card), o que tiene un hijo/a ciudadano/a estadounidense o residente permanente, puede solicitar un permiso para superar este motivo de exclusión. El oficial consular determinará si existe un parentesco calificativo. Si existe, el oficial asistirá al interesado en solicitar el permiso. Es importante recordar que es el Servicio de Inmigración y Naturalización, no el oficial consular, quien decide si se puede conceder el permiso.

Cómo solicitar el permiso: Si un solicitante tiene derecho a solicitar un permiso, el oficial consular le proporcionará un paquete de información que contiene el formulario I-60l. El solicitante deberá completar la página 1 del formulario y devolverlo al oficial consular. El oficial consular enviará el formulario al U.S. Center for Disease Control and Prevention (CDC) en Atlanta, Georgia. CDC registrará la información necesaria y devolverá el formulario I-60l junto con un formulario complementario (unido al dorso del formulario I-601), al oficial consular. El oficial consular le entregará el formulario complementario al solicitante, quien deberá completar la declaración A del formulario y enviar el formulario a su patrocinador en los Estados Unidos. El patrocinador deberá hacer completar la declaración B del formulario por el médico que tratará al solicitante en EEUU. Si la declaración B es completada por un médico privado, el patrocinador deberá hacer endosar el formulario por un oficial de la Salud, local o estatal. Cuando estén completos estos pasos, el patrocinador deberá devolver el formulario al oficial consular. El solicitante también deberá abonar una tarifa por el permiso, actualmente de 90 dólares en efectivo. El oficial consular solicitará un cheque de cajero par ese monto pagadero al INS o cobrará la tarifa en efectivo y le proporcionará un recibo al solicitante. Luego el oficial enviará la solicitud de permiso al Servicio de Inmigración. El Servicio de Inmigración notificará al oficial consular y al solicitante de su decisión si el permiso se puede conceder. Si el Servicio de Inmigración concede el permiso y el solicitante no tiene otras inelegibilidades, el oficial consular se pondrá en contacto con el solicitante y emitirá la visa de inmigrante.

Otras Inelegibilidades: Algunos solicitantes de visa de inmigrante VIH positivos también tienen otros motivos de inelegibilidad. Mientras un solicitante VIH positivo que tiene un pariente calificativo puede solicitar un permiso, el oficial consular puede no recomendar la aprobación del permiso hasta que se hayan tratado otros motivos de inelegibilidad. A veces el solicitante puede solicitar varios permisos al mismo tiempo; a veces el solicitante tiene otra inelegibilidad que no puede ser superada, que hace que sea imposible que el oficial emita una visa, aún si la inelegibilidad de VIH sea superada. El oficial consular puede informar al solicitante si es elegible para solicitar permisos para superar cualquier otra Inelegibilidad que pueda tener.

Carga Pública: Bajo la Sección 212(a)(4) de la Ley de Inmigración y Nacionalidad, un solicitante de visa de inmigrante debe demostrar que tiene medios para mantenerse en los Estados Unidos y que por lo tanto no necesitará asistencia económica pública. Puede ser difícil para los solicitantes VIH positivos llenar este requisito de la ley porque el costo del tratamiento de la enfermedad es muy elevado y porque posiblemente el solicitante no pueda trabajar u obtener seguro médico. El oficial consular debe estar conforme de que el solicitante tiene acceso a suficientes fondos para su manutención. El oficial tomará en cuenta los ingresos de la familia y otros capitales, seguro médico que cubra todos los gastos relacionados con el VIH, la disponibilidad de servicios de salud publica y de hospitalización para los cuales no hay provisiones para cobrar honorarios a los pacientes y cualquier otro factor relevante a esta determinación. No existe permiso para superar esta inelegibilidad, sin embargo, si el solicitante puede demostrar que ha adquirido un seguro adicional o fondos que serían suficientes para superar la inelegibilidad, el oficial puede determinar que la inelegibilidad ya no es aplicable. Por información sobre el tratamiento y cuidado de las personas VIH positivas, consulte con un médico o un oficial de salud pública en su país.

I did the whole process with the lawyer. I thought it will expedite things. I dont know what else to do? i wrote her an e-mail and all that and she wrote back saying as soon as she has all the paper work ready she will let me know. I feel like screaming and crying .

On the other hand, my fiance because he had some drinks with his best friend that came from another city to visit him on sunday. He didnt get his medical on monday and then on tuesday they are on a stike.

It just sucks! I 'm upset and not feeling very well.

Congratulations to all the new approvals !

I received the NOA2 a month ago and that's it ... Nico got the instructions to get his medical and in Uruguay there is a strike and havent been able to get that done. I havent sent him the package with all the forms fill out due that my lawyer's assistant was on vacation last week and this week , she still havent contacted me.

I had a deadline on mind when I apply for the K1 visa , that he will be here by August 31 and I know now that it would not be the case.

I'm down and upset!

How long you guys think it will usualy take to get your interview date once they received packet 3?

I’m having anxiety attacks and my previous surgery is bothering and I have to go to the specialist and my company stills working on my health insurance…

I hope my day gets better… this morning I had an argument with a friend so… its hectic and we work together

You should try giving them a call, I have heard that some embassies / consulates don't respond very well to their e-mails (while others do). I would just explain that you feel that your packet was sent incomplete and if they could kindly send the medical instructions to your fiancee that would be great.

Sandra, you need to call the NVC... You need to call NVC 603-334-0700, 1, 5 to talk to someone and they can tell you if your package has arrived and if/when they sent it out to the Embassy. It usualy takes just a couple of days to get to the NVC and it's often sent out pretty quickly. After you know it's there you can track it to the Embassy using DHL. It wont state it's 'yours' but it will state a shipment to Uruguay. Here's a quote from Nich explaining how...

My package left NVC on 08 May 2008. This is what I did on the site http://track.dhl-usa.com/TrackByRef.asp?nav=TrackByRef

In the "reference" box, I put EXP 07 MAY 2008A (notice that's the day before they said it left)

They may generate their reference and do the packing the day before pick-up because EXP 08 MAY...didn't work.

Below in the "shipment pick up date range" I put May 8 2008 to May 8 2008 (I wanted to see things leaving NVC on only May 8) If you put in a range of dates, you'll see packages show up that are halfway there that actually left a couple of days before yours.

Then click the red arrow that says "track"

There were three pages of shipments, so be sure and click "next" which indicates if there are more pages.

I noticed that there were 67 shipments leaving NVC on May 8, but each was to a different country (no duplicates) which tells me that they combine petitions going to the same Embassy. Looking at details on some shipments, the London package was 3 pounds and Manila was 40 pounds, so there must have been many petitions from Manila going together.

I did the same steps above for the previous day (May 7) and there were 16 countries, but they were all different from the May 8 countries. Thats 83 different countries in 2 days, with multiple petitions in many boxes! It kinda gives you an idea that many more petitions are being processed than just the timelines we stare at here on VJ.

Thank you for the advice I actually did that last friday and I been tracking the package since then. I know that it got to the embassy yesterday noon. What I was referring was if I should call now the embassy and see how long it will take or what do I need to know...

I did all this with a lawyer, which his reputation is excelent. I been calling his assitant to gather more information, but nothing. The last time we talked, she told me that she will e-mail me some forms that I needed to fill out and mail to my fiance... this was last week

I hope that from this point foward, everything goes fast and nothing goes wrong. I cant really tell anything from the embassy in Uruguay because there isnt much information about it. There arent many cases :S...

I'm still stress, I don't know what to do, if to call the Embassy or what? Also, I received at home two letters from NVC stating that they send my application and to wait for the interview or something like that. Both are the exact same, just that one was dated the 28th ant the 29.. I wonder why ?

What should I do now? Please any advise will help.

The case went to Montevideo Embassy, now that my fiance is gathering all the papers that he needs... he doesn't find his vaccination certificate.

Last time I saw my honey was on April 15 ... I want him to be here by the end of August, the sooner the better.

I don't know how the embassy in Montevideo, Uruguay is, there aren't many that apply in that country for the K1 Visa. In visa journey, I have find only 3 cases ....

If any of you know anything about the embassy in Montevideo, Uruguay. I will appreciate it.

Hello To All:

These past week, I had a lot of stress waiting for NOA2 approval , my NOA1 date is April 14 and touched May 15 . My fiance is from Uruguay and it seems that we are the only ones doing a K1 visa for that country.

Today, I'm feeling a bit better but still thinking if everything is fine and that we will be approved.
