  1. It was unfortunate for me to have my case denied a while back, however, I have gotten my case reaffirmed in 2010 and she is in the states with me now. A real nice birthday gift! It's been about 10 months now (almost a year). I give all the credit to Marc Ellis & his associate Mr. Nam! They did an extraordinary job! Happy New Year! Good Luck to everyone processing for their visa!

    yo, i don't think the congressman will work, sorry to let you down on that but i personally tried it. Staff there said they consider all immigrants criminals and you're suppose to prove you're not one in general, you're guilty until proven otherwise. I'm resorting to Lawyer-up them folks. I feel for all of you who are going through this tough situation.

  3. My wife will has her interview coming up on May. It getting me worry what HCM consulate is looking for now? Your evidence is over qualifies than me. I can’t believe the reasons they denied you from 1-5. How the world is your wife will remember your boss name. My wife having a hard time memory all my siblings name. This is so dumb.

    this is just a little heads up for those of you who are soon to interview...

    They will ask your wife how many rooms are in her husband's house in the STATES.

    My wife didn't know and she guessed the wrong amount... 'DOH'!

    I don't recall declairing how many rooms in my house. I really dislike the way they treat people.

  4. Ellis is a little strange. You should contact Mr. Nam. I've just have too much time on my hands and have been trolling on this site for over a year now. We've opted to hold onto our case until I see if I can get a job over there. I'm leaving at the end of January. If I can work there I will file at the USCIS field office after a year, which is the requirement.

    you speak as though you personally know him? do you know him on a certain level?

    You're welcome. I have to say though friend that you are going to be lucky if the case hasn't been returned already. You may want to start thinking about marriage in Vietnam and go the K-3 or IR1/CR1 route.

    actually, that is the route i'm taking. I've already accomplished the wedding part. this is just a case of unfair treatment and lack of human rights. The agency in HCMC is delusional. They fail to take on the task of determining the real from the unreal. Staff there neglects basic human rights. I basically think that the people who work there do not have what it takes to deal with the duties set forth there, I think they are just overwhelmed with duties that they neglect all the evidence put forth to them. Don't even have an evidence verification process that will account for anything. Why the f*** do you request for evidence when you don't even look at it verify it an take it accountable into case records.

    And I smell corruption when I'm there.

    No prob, yea I did listed it in my sig, just didn't complete the part after approval for interview cause it was a refusal. Yes as a matter of fact I did reach him. He was on the road in Vietnam and was a little irritated in me calling and asking questions. He did gave me Mr. Nam's cell mobile number instead of the office and I also managed to contact him and setup a little something. You seem too familiar with all this seems like you once experience this path. you are O mighty wise Obi Wan Kenobi!

    People are trying to help you here... time to get your head out of your ### and understand what your options are..... A letter to the Consulate General in HCMC is not one..... If your file is returned to the USCIS... you can just about kiss your petition goodbye....

    Normally the petition is either kept at the embassy for review [AR] and you have a chance to submit other evidence. If outright denied the case is sent back to USCIS and you are basically screwed.

    You need to communicate with your wife and see EXACTLY what "files" she has.

    WHY? Wasteing your time.

    Call your senator and get your senator working on your case if it's still at the embassy. Time is of the essence.

  9. I'm totally lost here. Your timeline and signature say your case is still at NVC. Am I missing something?

    sorry i didn't get the time to fill it all in. but it should be all done. I had the interview but was denied. I also took the marriage route. anybody have any ideas on how much on the average it would cost to use Mr. Ellis's service? also, does anyone know what state his offices are in? how would it work if I were to use his service and reside in different states?

    I went to a lawyers today and they wanted me to sign a contract for $10K to work on my case.

    anyone know what an average cost for a lawyer to work on your case is?

    The organization I talked to is a member of I think "American Immigration Association" or something like that, I don't know if that is something to consider.

    You do not have time to "dink" around... By the time the consulate general would even consider even reading your letter, your case file will be gone and then you are screwed.... seriously

  13. Can you show me how to get to the Citizens Service desk @ the Consulate in HCMC?

    i guess every US embassy, no matter what country has its own ACS (American Citizen Services) ;) . check with the local embassy through their local webpage or better yet, go personally to the USEM, bring your US passport and inquire about this service.

    During the interview my wife accidently responded incorrectly. She said I visited Vietnam in October 2004 instead of October 2005. She said they wrote all her statement down on paper. Is there any way we can retract the statement and change it back to 2005? The reason is I came back in December and not October. I also came back in October 2005, that is where she got confused and we would like to retract that statement. Is it possible to retract the statement?

    your wife's confusion would probably be the reason why they're asking for additional documents. basing on some post and testimonies from people i know who have been through the interview, they usually see the CO taking notes because sometimes they ask questions twice (same question or rephrased question) just so to confirm if the previous statement was correct or there is a discripancy.

    retracting statements during the interview will give the CO an impression that the interviewee (beneficiary) is NOT telling the truth even if it was JUST an HONEST MISTAKE. this in turn will give them the excuse to further lengthen the "burden" of the visa process..i guess you're left with no choice but to accomplish everything that's asked from you and submit it personally to the USEM.

    i hope everything would turn out fine in the end..just stay focused. you can do it. :thumbs:

    Should I correct my wifes statement in the timeline and let them know or should I just let it be and take the risk? If they compare my wifes statement with my airline ticket, there will be a 2-3 months difference?

    In reference to the sworn statement just give detailed answers to the questions they are requesting where you 1st met etc.

    At the bottom of the statement just write. 'I swear that the information provided on this statement is true and correct'.

    The notary then places their stamp with some wordage to the effect that you 'john doe' swear this information to be true' they should know the exact wordage.

    I'm living in the US and I have a dumb question there are no Public Notaries overthere ?

    The other request is pretty self descriptive.

    You can get the letter notarized at the HCMC Consulate US Citizens Services desk.

    Bear in mind they are asking for this evidence to rule on whether your relationship is bona fide or whether you are being paid to marry in order to facilitate visa fraud. There's no need to address the fraud suspicion directly but you'll want to taylor your letter so there is no doubt and, of course provide the proof you paid for all tickets with your own money.

    I checked out the site and found out the embassy is in Hanoi, which is up north. I am currently in Saigon (Ho Chi Minh City) So I can't get to the embassy. I was told to go to a lawyers office or look for notary services. I can't seem to find information on an embassy in HCMC (Ho Chi Minh).

    I went to Vietnam before the interview and also escorted my wife to the consulate. I was not allowed to attend the interview and had to wait outside. How would I let the consulate know I was present? The consulate did not know I was present in Vietnam, but I can provide my airline ticket.

    Right now I am working on composing a timeline, any help would be appreciated.
