hello everyone

I just got an email from he embassy that says the applicant can come in to collect the packet of requirements to be able to start the process.

our case has been reaffirmed by USCIS back in Feb of 2010. I thought once the embassy gets the case back from USCIS they scheduled a second interview. so anybody know anything about a packet of requirements?

I am sorry to hear about your denial.

get a good immigration lawyer before the case is sent back to the USCIS and find out exactly whey they denied you.

if the lawyer is good they might be able to get you a second interview.

once the case is sent back, you will have to wait along time before USCIS contacts you and gives a chance to prove your case again. my wife had her interview in Nairobi,kenya on 8/18/08 and the case was sent back to US and we didn't hear from USCIS until March of 2009.

my question is for anyone who had to do a second interview. does it help your case if the petitioner is present at the second interview? I am debating the pros and cons of this.

the form I got is I-797C notice of action. I called DOS on 3/5/10 and they have not received it yet and I have been calling NVC daily and they have not got it too. I wonder if the case is with the embassy?

I don't know who has it or where it is.

The USCIS letter that I got has the same wac number and the DOS wont give you an interview date the embassy will do that and allso the embassy will asign you a new number

I finally got my reaffirmation letter and it does contain the same WAC number.

I have not received the letter myself, I am afraid if I call DOS I might not have the new WAC number.

also I wonder if DOS sends the case direct to the embassy or is it DOS that let us know of the new interview date.

has anybody had any experience with appealing I-130 denial? how long does it take?

I have hired a lawyer to help me appeal the denial of my wife's I-130 due to lack of prove of our marriage.

we have sent our appeal to california service center in Aug,18 of 2009. they are supposed to foward it to the Board of immigration. so if anyone has done the same thing in the past. please give me an idea of how long we can expect to hear from them.

Hey, did they return all your documents or they sent Notice of Denial right away? Our case status online says "document" was mailed to applicant (my husband) and until now he still didn't receive it so we're wondering what document could that be..Thanks.

no they did not send back any of my documents just the NOIR.

I sent in the wedding pictures, letters from co-workers and friends, phone cards, money wiring receipts and prove of my two trips to kenya to visit my wife. I guess they did not like our pictures and they said they do not look like wedding pictures.

Did you send in your marriage cert? You don't list it and if you did not send it in, that would be clear cause for denial. JUst trying to figure out if your denial was based on "lack of evidence of marriage" or "lack of bonafide marriage".

I did send in the marriage cert. I think the denial is for lack of bonafide marriage.

I have no very informative information about your situation, however I wish things move faster and may you have more patience and strength as you go through this process.

besides the normal required documents, does the CR-1/IR-1 beneficiary need copies of I-130,I-864 and DS-230 at interview? if so what to do if no copies were made when filing these forms.
