  1. My interview was easy. IO did not ask us much. I think the interview was just 5 minutes. She wanted to know my father, mother name, where did we first meet, how long we have been married and that's it. She did not ask for any supported documents during the interview. We thought it was done successfully but we missed one notarized document that she needed. I did not bring the original of that document either so she could not make a copy instead. The IO ask us to mail her that paper to approve my application. We sent that notarized paper right away after the interview. Hope we will heard from her soon

  2. My husbands biometrics letter was late as well. The good news is that they processed the EAD and AP quickly after his walk-in and he received EAD, AP and his interview date all last week. FYI, there was only touches on his AP, nothing on anything else and only one e-mail. I was surprised when he received the EAD and interview letter on Friday since on the USCIS site it still shows the I - 485 in acceptance phase. Don't let USCIS website freak you out.

He will be off to the DMV and SS office today.

Thanks to everyone here for their support and help.

Thanks for sharing. Hope I will get my EAS soon. Waiting for touchs on my application now!

  3. Hi guys,

    I am a F1 visa student. I am filling my I-130 and I485 concurrently.

On the I-485, Part 2: Application type(check one), I selected the first option: "An immigrant petition giving an immediate available immigrant visa number........available visa number, if approved).

I am not sure what I filled in the I-485 was correct or not. Please help me verify it. Any help is greatly appreciated!

  4. Hi Beth,

Thanks for the update. Sorry I have nothing to report, aside from a touch on i-130, Ead and AP, nothing on I-485.

It's frustrating because I see everyone else getting their biometric letter. Nir12's package was sent same day as mine, but received one day sooner and they got biometrics over two weeks ago and have gotten touched a lot.

You may wanna give USCIS a call if you have not received anything with 30 days. Hope you do not have to call them like me!

  5. My I-130, AP and EAD were touched today...no biometrics appointment yet though!

What does the touch mean? Does anyone know? Wonder what they did with my package ;)

My application is supposed to get a touch today but nothing has happened yet! Still waiting for biometrics letter...

    AOS from F-1 Timeline

    (based on marriage to USC)

    2010-06-16 Send I-130 and I-485 packages

2010-06-17 arrived at Chicago lockbox (express mail service was quick, it took less than a day)

    2010-06-24 Checks cashed

    2010-06-25 Received NOAs for 1-130, I-485 and I-765 (EAD)

  6. still no biometrics appointment. How much longer should I wait til I call??

Basically, my AOS application date is after you 1 day and I have not received the Biometric letter yet. I am from F1 also so look like we are on the same case. Hopefully there is no problem with our applications and we will get that Biometrics letter soon.

  7. Hey guys,

Thanks for all of your comments. They help me a lot. I think I know what is the difference between a USC and LPR spouse. The waiting time for my I-130 application would be too long when my wife is a LPR. I think $2,200 ( the saving I may have from my school tuition fee) is not worth the wait ( one guys say around 4 year). I think I just wait to file everything AT THE SAME TIME when my wife becomes a USC. Hopefully she will got her oath ceremony right after her interview on May 18,2010. I have searched some oath ceremony schedule in Houston an they say it is the third Wednesday of the month. My god, it is May 19,2010 is the the third Wednesday of May. Just praying for that happens in a timely manner! Thanks again and wish all the best things to you guys!

  8. I believe OP was told in the other thread (naturalization section) that he is risking his AOS being rejected and possibly his money not refunded as spouses of LPR are not eligible to AOS before there is a number available for them.

Why he would still try to do it instead of dealing with his university when his wife has a naturalization certificate in hand and AOS filed (NOA1 received) is beyond me.

Moving thread as OP does not have a family based visa but is on F1.

What number do you mean? Is it too risky if you file I-485 as a spouse of a LPR while you are a F-1 visa student and later on you can support you spouse naturalization certificate? Man, time is playing around me seriously! hiz... I always have problem with time!

  9. Hi guys,

Got a time demand issue here. I am a F-1 visa student. I would save $2,200 for my tuition fee if I can get a receipt for my I-485 application before Jun 17. My wife got an interview for her naturalization in May 18. We still could not tell when is her Oath ceremony date now. Do you guys think it is a good idea if I file my I-485 when she still a LPR and support her Naturalization certificate later? Does it take much more time than the case that I file I-485 when she got her naturalization certificate? Any comment are all appreciated! Thanks!

  10. Thank you guys for your response,

You do give me a good solution when telling me a possible way to have the oath ceremoney early V333k. I will tell my wife to do so. So here another point, couldn't we call a person USC right after she pass the interview in my AOS application? Is there any other way to get a naturalization number right after the interview?

  11. Hi V333k,

Thanks for your response. I am currently a F1 visa student. I did go to my school and asked for the requirements that I have to meet to be eligible for a in-state tuition fee. Basically, They require two criteria, A receipt of my green card application and we need to get married in 1 year. The issue here is that I want to graduate in summer 2010 ( there would be no problem with my tuition fee and green card applicationif I graduate in Fall 2010). I am trying to save $2,200.00 from my tuition fee If I can get a receipt of my green application (which I refer my wife residence status is a citizen) before June 6. It looks like time is playing around me since my wife have an interview on May 18th. I do know that the USCIS require the citizen certificate from my wife but there is another way I am thinking about to work around with my tuition fee. Can I just send my green card application with the passed paper from that office( assume my wife pass on the interview). Do you guys think that the USCIS would send me a receipt and a request for additional document/evidence to prove that my wife is a citizen <-- there should not be any problem at that time since I get the receipt of my application and my wife will get the citizenship certificate sooner or later. Any other ideas are all appreciated!

  12. Hello guys,

Just have a quick question. Do you get the result right after the interview? My wife is about to have an interview on May 18,2009 for your N-400 Application. I wonder if we could file my green card for me as a spouse(me) of a citizen (my wife) right after my wife interview or not ( I would not prefer filling my application when my wife is still a permarment residence)? Time is very critical for me now. I need to get the receipt of my green card application before June 6 to be qualified for an in state tuition fee at my university in this summer. I would appreciate it if someone could give me advise?

  13. My wife got the 10 year green card base on her previous marriage. She divorced last year. I know it is difficult for me, a F1 student, to file a green card at this time but what should we do? Should we wait until she get naturalization ( it takes 1 more year), gather as many evidences as possible to tell USCIS that this is not a fraud marriage? We came to each other at the beginning of this year. I has been 6 months and we have some evidence of living together such as joint lease contract, joint checking account, sharing my credit card to my wife with her name on her card, car insurance, CD account showing both our name, lots of pictures during the last 6 months, car title showing both our name. It is real so I am confident of maintaining and having more such evidences. I am still with my school and will maintain my legal F1 status in America at least in 3 years. Somebody tell me to wait but some tell me file i-485 right now and wait. Either way i have to wait but i may get EAD, SSN or International student tuition fee waived if I file i-485 right away. Together with those benefits would be so many times of getting inforpass ( every 3 months). I heard some also have problems of renewing driver license due to long time ( more than 1 year) of pending document. If someone was on my same case or have experience on this, please share!

  14. Case touch today!

Current Status: Case Transfered to Another Office for Processing

On January 31, 2008, we transferred this case CRI89 PETITION TO REMOVE

CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED to our VERMONT SERVICE......

The 10 yrs Green Card is now in my hand. I really do not know whats going on at USCIS. I guess their system got some problems!

  15. off topic!

the good news of receiving the green card just come, but the the bad news of probable divorce follow. I realize that my husband got some extra girl friend while still living with me for along time. This girl also call me to tell the relation ship between her and my husband. Its unbelievable but true. My husband try to say sorry but i do not accept his apologize. I want to get divorce rite now but he say that he will sue me for the reason that i do not love him, just cheat on him and get married to him just for Green card purpose. So if i am the person who file the petition of divorce, is there anyway he can do to terminate my 10 years green card or do i have any trouble with the US immigration department. One more thing, I am still confused about what he say! Do the law allow him to sue me for those above reasons. I do not need any asset from him. We do not have any child. I do not need his money in the bank. Just want to leave him as soon as possible. Every respond is appreciated.

he is going to sue you???? why??? because you want the divorce? or he told you he would call immigration on you???? please explain!!!!! I am not sure what it is hgoing to happend.. as a matter of fact I have been asking the same regarding a friend I have... same people say that you could divorce same other says that you coul dhave problems... the truth I do not know.... when you know it let me know.

the word " sue" is just what i translate from my language into English. I guess formally, It is a report that he send to USCIS
