  1. Could all IR1/CR1 visa applicants who have been transferred from VSC to CSC please advise me so that I can update your details.

I have decided to distinguish between those newly transferred filers from VSC with those already at CSC. This way we can see how much of an impact this change has on both reducing VSC backlog and on existing CSC filers. Please also include the date your case was transferred.

    Thanks.

I am one of those VSC people transferred to CSC...wow...a special list. I hope it does make a difference.

  2. I don't know that this is clearly a case of human selfishness I think it is more indicative of how the human spirit handles the complete unknown.

In the US we have been taught to trust our government- many of us will say we don't trust them, however I believe most of us don't ever think the goverment is out to cause us grave harm. We go to work each day and do our jobs, and we expect the same from them. So the people whose files were sent to CSC because that is where it was directed to originally (I am one of those people) have searched and looked at processing times and checked case statuses every day- looking for something to make this process tangible. Something to give us an understanding of how and when we will see our loves again.

I don't dare want to take away anyone's opportunity to be together with their husbands/wives- I wish that for all of us. But, I think, what the original CSC filers are seeing/feeling is this: I finally felt I was begininng to understand my place in this line toward approval. I had some concept of when I could expect an NOA2 if all went well, but now all I see is another line, coming from the side, right in front of me with no end in sight. This takes all that I thought I know and makes everything unknown.

I don't blame those being moved from VSC... in fact I am glad to see that the government is working to correct your injustices. But what I fear is that in correcting what has been done to you, they will displace another entire goupr of people. And yes, that part of this makes me angry.

I can understand your frustration. Us VSC people have been there. It was not too long ago that Vermont received an influx of CSC petitions to help CSC get caught up, and those of us who were waiting saw many CSC/VSC people get approved before us, AND regular CSC people. Than there were all these new 2008 petitions getting approved in both offices while our petitions just sat there collecting dust. For like two or three months in a row the processing date for VSC did not move forward. In fact, one month it moved backwards and just sat there.

My husband and I have been waiting nearly 9 months, and because our case is different, he is in removal proceedings, the only thing we are waiting for is a service center to do the research/leg work, and transfer our case to our local office in Boston so we can have our Stokes and receive a final approval for our I-130. So, yes I understand your anger, but I am also angry that we have waited this long just so our case can be transferred to Boston. It is ludricrous. Especially considering we are physically located in between VSC and Boston and now our petition is being transferred to CSC where we might get a stamp of transfer to local office sometime in the next two months.

    Whatever!

  3. $25,000 fee would make this an elitist system only for the ridiculously well to do. There may be a problem with folks 'gaming the system.' There may be a problem with people in it simply to gain access to green cards and citizenship. However, raising the fee's simply makes those who would like to do the right thing find another 'wrong way' to do it.

Thank YOU!!!! AMEN!! The raising of fees and making immigration law a freaking maze even most lawyers cannot make it through has caused many people who would have done it legally, go with doing it illegally.

And the immense wait times? C'mon, just another government action to cause people to fail. People say it is to weed out the fraudelent marriages, I say that is bull. It is all about making people fail. Even with REAL marriages when they have to separate from their partner and live apart sometimes for up to a year or longer, and the financial strain, etc. I guarantee you there are millions of marriages between USC's that would not survive such a thing. so please don't tell me lies.

The system is already about elitist. The 'haves' make the rules and the "haves" have the ability to bend the rules. It is only those of lowersocioeconomic classes they are trying to keep out.

  4. I am taking a break. Things are sucking very much for me personally right now and waiting on USCIS is just further burdening me negativity. There was no approvals after 5/23 last week until today, I saw one. I will update the sheet today or tomorrow, work permitting.

:( Im sorry to hear that you are having troubles. I hope that everything will ease quickly, and yes too many of us hoping you get approved these days!! Hang in there, life has a way of balancing itself :luv:

Sorry to hear that...take a break...relax...not a big deal. It is just that you are usually the bubbling force behind this thread and I hadn't seen a post in a bit.

I spoke with our attorney today and nothing on our petition. The trial attorney for the government had stated previously in DOJ court that my husband was not eligible for green card application because first marriage was fraudulent, so the attorney filed a motion to pre- termit our application. Our lawyer received motion a month ago, it was just one page, and the attorney argued my husband was not eligible for 245I, but did not mention previous marriage was a fraud or anything else for that matter, so our lawyer sent out his argument/brief, stating counsel did not mention any good reasons for the pretermit (sp?), therefore he doesn’t think we will hear anything more on it. I am actually kinda glad that the government attorney did do that so now it won't be hanging over our heads anymore.

Our lawyer also said that currently there is a lawsuit about I-130 petitions, and that when it involves someone who is in removal proceedings, they should be put on top of the HUGE pile at the service centers because these people are facing deportation, and because they have to wait immense amounts of time for their I-130 to be cleared and transferred to their local office, it is clogging up the court systems. So we will see what effect this court case has. Not that it will probably do anything to help us...our case will probably be transferred before that case ever gets resolved.

Anyways, our lawyer says it makes no sesne to call the customer service line, it doesn't move things along, but he did say that that if we do not hear back on the I-130 in the next 30 days or so he will draft a motion to the court asking for more time because we were supposed to go back in October for the next hearing in front of the judge. :waiting:

  5. hey everybody....still hanging in there?

    Ms. Z?

    Pecky?

    000?

    Delicia?

    roll call...who did I miss??

I leave to see my husband on June 6 for 6 weeks. I wanted to have all my NVC stuff enveloped, ready to go INCASE I was approved while I was gone so my sister could mail it in..but I dont think thats possible with case number stuff..is it?

Anyone have any idea how I can do this?

guys..this is it for me. If I come home and we have had NO movement I just might die. I just have this fear that everyone will get approved and I will be like poor HOHOHO waiting forever.

I will keep my fingers crossed for you. Have fun and relax with your husband and try and forget about USCIS for a while. We are right behind you at VSC at 193 days since they received our I-130, so I feel what you are going through. I pray they approve you...that way maybe we will be next.

  6. OMG, I was APPROVED Today!! Even now as I write it, it's surreal.

Congratulations. I bet it feels good to get the news. Happy for you..... I look forward to the same news as well. Good luck on your next stage.

 Yesss if feels wonderful, tho I can say now I have alot of work to do... NVC is alot more work in less time.. Thank you for your kind wishes.. I hope your case gets approved next week!! Too many ppl have been waiting tooo long!

Do they take this long just hoping that some people will give up? Sorry...my mood sucks today.

  7. Grats bnm, you waited a long time! The spreadsheet is updated.

Has anybody noticed that CSC is at least a month ahead of VSC when you sort by the NOA1 date? And when you look at the two centers combined...geesh it is ALL Vermont people who have not been approved until you get like 3/4 of the way down the spreadsheet.

This just sucks because we have reached our six month point...and nothing. I checked the USCIS website and they haven't updated their processing dates.

  8. :luv: Thanks again Delicia for your wonderful spreadsheet, girl you really know your stuff! I see you are nearly to the 200 day mark.. I hope you get to post your approval soon!! Im keeping all of us in my prayers!!

    Day 207

Yes, thank you so much. I never really look at the spreadsheet with CSC and VSC mixed but WOW...CSC seems to be WAY ahead of VSC. And when I looked at it sorted by NOA1 date...it appears that VSC is working on January dates...PLEASE I hope this is true...this whole process sucks.

    Day 172

  9. If you've never gotten a touch I can't see how it can depend on the details of your case. Wouldn't they have had to have begun processing to know whether it is a complicated situation or not?

I should imagine that the highest incident of "complication" is previous marriages. Behind that, children. After that, criminal backgrounds. So the simplest cases would be in terms of first marriages for petitioner and beneficiary. It'd be interesting if we could collect any complications and see if we could come up with a pattern.

Are those people who've been approved ahead of others 1st time marriages?

(I'm leaving out obvious expedites due to country of origin. Those make sense and I agree w/them.)

What do you mean "expedites due to country of origin?

And as far as our case, this is not the first marriage for either of us, he is in removal proceedings, and he EWI. And I am sure there are many other "complications" from his file...but honestly I think USCIS makes complications where there really isn't.

  10. Does anyone knows when VSC will start approving petitions??

I feel bad for me and everyone else who have been waiting longer than i am. But seriously, anyone live near VSC and go their find out whaether people their are sleeping or they like pick and choose the applications to be approved or feel like doing any work????:blink::wacko::wacko:

Does anyone live near there and can smack the hell at them?????? :bonk::bonk::bonk::bonk::bonk::bonk::bonk::bonk:

    Reehon,

Are you suggesting a road trip?? If so, Im in!!! Who else is game????

    Paris Heart

This is my theory, and i posted this at a different site I belong to:

I found this article this morning. It is about a letter written by Senator Patrick Leahy at the end of November 2007 to Emilio T. Gonzalez Director of USCIS asking him to please deal with the fact that because a different employment agency (?) won the contract at VSC, "approximately 200 long-time employees will receive serious reductions to their hourly wages. Some of these employees stand to lose almost $3.00 per hour"

SOOOO, not only do they not have enough people to meet the increased amount of petitions filed, they are going to backstab the employees who are there by lowering their wages! No wonder the employees on the other end of the phone are moody, cannot answer your questions, and tell you they don't have the time. I would be moody if someone was going to cut my pay by $3.00 an hour. And if a possible job loss was constantly looming over my head I don't think I would feel too motivated to work efficiently, effectively, or expeditiously.

Geesh, I wonder if this has anything to do with the increased processing time, never mind the fact that they are advertising the directors position is open up there.

    http://leahy.senate.gov/press/200711/113007b.html

Oh, yeah, and here is a previous article from Sept. 2007 in which Leahy is pleased that VSC will be appropriated 300 additional positions...

hmmm...well I guess to be able to ADD 300 positions they had to bring in a new employment agency/contract, and lower wages on current employees so they could stay within the budget even though they increased the fees of petitions for immigrants...something isn't right. Especially since the processing times for Vermont have increased.

    http://leahy.senate.gov/press/200709/092807.html

And another letter explaining their plans for Vermont...

    http://leahy.senate.gov/press/200709...SCISLetter.pdf

But none of this is working...CAN't THEY TELL?!?

Sorry...didn't mean to burst anyones bubble...but I am the type of person that NEEDS to know what is going on at all levels.

Last week when speaking to our lawyer he had mentioned that recently there had been a big conference/meeting for all types of professionals regarding the backlogs being experienced at USCIS, but particularly VSC...they were all given a standard BS line that they were dealing with the situation and doing the best they could, but there was no way to speed up the process. Our lawyer asked what about people who are in removal proceedings, shouldn't they be allowed some type of expedited service considering they are in court and the answer was no...

Sooo...I felt motivated to dig up some information to find out what is going on up there because I knew there was more to it than "oh we received tons of applications, and are in the process of training new employees"

I don't know how many of you have ever been to Vermont...but it is quite RURAL, and the population is LOW

It is my opinion...that IF USCIS is SCREWING their current employees...and any new applicants are TEMPS with no bennys for up to the first year...and are promised NOTHING...they are having a hard time filling those positions...bad news travels quickly, particularly in rural areas...and who the hell is going to want to work for them...and than when you consider the requirements to even apply or be considered...geesh...you started with a limited pool of possible applicants already...why not needle it down to nearly non-existent....

Its easier to go work at the local Wal-Mart.

    I looked a little further.

The town of St. Albans Vermont has a population of approximately 8-9,000 people. The county of Franklin which includes Burlington and St. Albans and a whole mess of other towns has an approximate population of 50,000. Not much of an employment pool if you ask me.

Their racial make up is almost all caucasian. If you added up all the others I doubt it would even break 5%.

And the majority of constituents are REPUBLICANS, and were big fund raisers of BUSH. Which to me is odd because we are talking about Vermont a predominantly Democratic state, where the tree huggers, and crunchy granola people migrate to...

I also went to a local newspaper called the St. Albans Messenger, and there was a front page article about the low morale and dis-satifaction of DHS Border employees in Highgate Vermont (I know its different, but they are still under the same umbrella) and how people are leaving, they cannot retain many, and they are having a hard time getting new ones...part of this due to internal reorganizing.

Sigh....I just want our petition OUT of Vermont and at our local office so we can get our damn interview and approval on our I-130!

  11. I wonder what the latest you can file a 129F and reap the benefits of seeing your I-130 approved quicker.

If I had to do it all again, I would have gone K-3 and said that he doesn't need to work for 3 months or whatever.

    hahah mrs.Z...nice signature....

I know we really just keep seeming to get the crappy end of the stick, right???

What is up with this touch date of 02-24-08 that I see all kinds of Vermont people with...myself included. Was this a mass data entry day? This is the one and ONLY touch our I-130 has ever gotten. Every time I log onto USCIS and see the same date listed I want to pull my hair out.

  12. It's updated again.

I decided to take the 2 service center sheets and sort them by NOA1 date. I had a feeling that VSC was processing based on NOA1 date, but that theory doesn't stand supported. VSC is just approving them randomly, best I can figure. CSC, although slower than VSC, at least seems to have some kind of method to their madness.

I didnt think they were either Delicia. you are awesome for figuring this out for us!!

It has always appeared to random to me...people who have a NOA1 date before and after us have gotten their NOA2. I think it all depends on the details of your case.

  13. does anyone know the link to the page on the uscis website that says they will process cases in the order received?

I am going to fax the copy of my receipt (with the received date highlighted) and a copy of that document..

we talked about it before but now i cant find it

    does anyone remember this conversation??

Hey, let us know how it turns out. Our timelines are pretty close to each other. VSC received ours on 11/21/07, sent out NOA1 dated 01/25/08, and I see people who filed after us who have received their NOA2 which I do not think is fair.
