Hello All,
I had my N400 interview on 09/19/2012, I have pass all my tests.I have signed and fill all forms needed to be sign after N400 interview.My problem was,I have owed city taxes, but prior my interview, I have make a payment agreement with the city. Where I have paid twenty percent down, and will make a $100. monthly payment there after.
On my interview date the immigration officer, asked me if I owe any taxes, and I said yes. She further asked if I have make any payment agreement, and I said yes. She asked me the payment agreement between me and the city and I showed it to her. She just glance the letter, and said this not a payment agreement. Instead this just said that, you have agreed that you owe the city taxes. She argued that the letter did not said that the City has agreed or approved the payment agreement. She asked me to go back to the city and asked them to write a letter. which will indicate that they have AGREE/APPROVE the payment agreement. She later hand me a red papper which reads that.
I call the City and told them about it,and they said that they have gievn me a payment agreement and that is all I needed.But when I have explain to them what it is about, they asked me to send them a copy of what the immigration officer is exactly saying.I send them the copy, and they wrote the letter just like she the IO have requested.
As soon as I got the letter, I mailed it next day delivery on 09/25/2012 to the Memphis local office as instructed by the officer. Until to day, I have not heared any responses from USCIS, or Memphis local office. I have checked case status on line and there is no changes on my status still. It only said that a letter was sent to me on 08/19/2012 about my interview and if I have not receive the letter withing 30days I can contact 1800....While I have receive the letter and all that of that.
Is there any one out there, who has experience a similar problem like mine, or can some one tell me what that means. Will they end up denying my application for n400 because of my pass due local taxes. Even if I have payment agreement with the city; or will they continue to do more intense back ground check on me or not. I am just saying.

While I can not comment on the specific tax agreement evidence issue, we too had a request for further evidence (RFE) during the N-400 interview. We returned the evidence the very next day. It took around 50 days before our online status indicated that the RFE was received. When I called the 800 number, they said that they have 90 days to respond. They move extremely slow.

Nope. Today is the last day to register fore the election. My wife has her oath ceremony Thursday. She missed it by 2 days.
Actually, there may still be the One-Stop Absentee Voting, Same Day Registration option.

Update, October 8:
Placed in line for oath scheduling. Apparently I had enough days inside the country. Hopefully it will be in time for election day.

Here's a quick update:
As I mentioned, we sent in our response to the RFE on August 16. It was received on August 20 according to the USPS delivery receipt.
Today our online status finally changed:
On October 4, 2012, we received your response to our request for evidence. This case is being processed at our CHARLOTTE, NC location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.Once a timely response to the request for evidence is received by USCIS, we review the evidence or information you submitted. If you submitted the requested evidence, we continue with the adjudication of your application or petition in light of the new evidence.
That's right, received on October 4.
Well, hopefully this means it is moving again. Fingers crossed... -
My Oath Ceremony was yesterday. I can officially say that I am now a US Citizen!
Thanks to everyone who have answered all my questions & good luck to those who are still waiting for their Oath schedules. In some ways, the anxiousness in the waiting will no longer be significant once you are sworn in as a US Citizen.

Hello all,
Last week I received an online status update stating:
"On September 21, 2012, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling. When scheduling is complete, you will receive a notice with a time and place for your interview. If you have not received the notice within 90 days..."
My question is... Do they update your status online to notify you once they have mailed you the (interview date) notice??
...Or can I just expect a letter in the mail without an online update.
(The reason I ask is because I have encountered some problems with mail at my apartment complex where the mailperson has mixed up people's mail)
Any input or advice would be greatly appreciated

Our online status changed to indicate that our interview had been scheduled and a letter with further info was sent to us. We received the letter a few days later.

My interview was on Monday 08/06/2012. Before sending the application I used the USCIS calculator and it said Earliest Accepted Filing Date: 04/23/2012. They have received my application exactly on April 23. The USCIS officer told me that my application was received a day earlier, anyways she did interview me and I passed the English and Civics test. She told me that a decision cannot be made at the time and the will send me a letter. My question is: Who makes the decision and what should i expect?

Why did you cut it so close as to have a problem? Seems you should have known the answer before you filed.
If you had read my posts, you will see that we did know the answer and left a few days to spare. We filed the same way throughout our visa journey, leaving a few days to spare on filing timelines. Everything was done by the book, spot on. This was completely unexpected and we were blindsided by this officer's incompetence. I was merely asking the questions above to see if by some remote chance that my math was wrong. It wasn't.

You should have argued your case and explained to him why you believed you were eligible. Were any of the trips you took on business while working in the US? Normally you get a break from business trips.
If it doesn't happen this time, wait for the five-year mark. Hopefully until then you'll be staying longer stateside.
One other thing... If you are using your greencard to visit the US, chances are you will not be able to get your citizenship prior to five years.
You're right, I should have argued my case, but as you could imagine I was very anxious and thought that maybe I did make a mistake. I was also nervous about irritating the officer, as he was quite cocky..borderline arrogant. They hold all of the power. It wasn't until after the interview that I could think about it with a clear head and realized exactly what happened. I work in the USA for a very large US company and I was in fact working in the UK office during some of the trips, but would always combine it with family visits in the UK...etc. So the travel outside the USA was a mixed bag.
Just to clarify, I live, work and reside in the USA. I don't visit the USA.
I haven't been denied, but I'm getting a bit worried as I've heard nothing since responding to the RFE. My status on the USCIS website still states that my application is on hold until they receive the evidence, or the opportunity to submit it expires. Again, it was delivered to them on August 20 per my return receipt. We thought ours was such a simple case. I guess there's no such thing.

Based on your method at post #5, you've forgotten the leap year day.
366 + 365 + 365 = 1096 / 2 = 548 physical presence days required.
Thanks. The leap year day actually helps me. I was outside for 545 days, which means I was physically present for 551 days. Three days to spare.

EXACTLY, thank you Gegel!!! I should be ok, except if I happen to get an incompetent officer interviewing me...which is what happened on August 16.
I passed all parts of the interview and then he looked at my time spent outside the USA and said that I "didn't have enough days". I've been over this very thoroughly, so I was sure that I did have the right number with a few to spare, but I didn't want to argue with the officer and cause a bigger problem. Thinking back afterwards, I know now that he must have been reading the question incorrectly as days inside the USA, instead of correctly as days outside. That explains why he said I "didn't have enough days", instead of "I had too many days outside". I mean seriously, shouldn't these guys have a simple number to go by? Over 547 days = bad, Under 547 days = good. It's that simple.
So then he proceeds to tell me that he doesn't have time to do a detailed recalculation and he'd do it later in the day and then leave me a message as to what the decision was and I would get my oath date in the mail. And just in case, he also gave me the yellow RFE envelope with instructions to make copies of my passport pages illustrating time outside the USA and then list my travel dates again. I did all of that and sent it in the same day via certified mail, so I know it was received by somebody. That was August 20...nothing since. How can something so simple turn into such a nightmare? UNBELIEVABLE!!!

It could also be 540 if you do the simple math of 18 months @ 30 days....
I guess that the question here is how many days have you spent outside the US in the last 3years? That is what matters for your application.
540 days would be incorrect and very incompetent since not all months have 30 days. However, it would actually help if they did calculate it that way.
So here it is, I answered Part 7 question A. as 545 days spent outside the USA. Does that make me eligible or inelegible?

It is mentioned in the last bullet point:
Be physically present in the United States for at least 18 months out of the 3 years immediately preceding the date of filing the application.
OK, nobody wants to play this game, so I'll answer. 18 months = 1.5 years = 547.5 days physical presence is required. So, if you answer Part 7. question A. with a number that is 546 days (to be safe) or less, you would therefore still be elegible for citizenship based on the physical presence rule.
Does anybody disagree with that?

Thanks Gegel. I've read the USCIS instructions and they are quite clear. I guess I should clarify, I'm looking for a physical presence number response: 500 days, 600 days...etc?

A question for eveyone regarding Part 7, Question A. on the N-400: How many total days did you spend outside of the United States during the past three years?
I became a permanent resident on 3/12/2009. Based on three years since my green card was initiated, what is the maximum number of days allowed spent outside of the USA? I'm curious to see your answers.
I will respond and explain once I get a few answers.

Thanks, but none of those reviews were for a naturalization interview. just AOS and Bio. I'm really hoping it takes no more than 2 hours like the letter states.

We are running a tight schedule on the day of the interview. The interview is scheduled in Charlotte, NC at 1:45 pm. We then have a flight to London to catch at 6:25 pm. It will probably take about 20 minutes to get to the airport. We have to decide if we need to reschedule or not. The interview letter says that it will take about two hours. Is that accurate?
For any of you reading this, how long were you at USCIS office for your interview (time arrived to time departed)?

Still no interview for me. Based on times here, seems like the wait is anywhere from 4 days to 28 days. I talked to USCIS yesterday and was told that FP > Interview Letter can take about 30 days. Fingers crossed I hear something soon
Charlotte, NC is very slow. We're on 37 days, and counting...
