  1. Today I got two I-797C from USCIS. One was for I-130 saying The above petition has been approved. We sent the original visa petition to NVC. NVC will contact the person for whom you are petitioning concerning further immigrant visa processing steps.

    The other was I-824 saying the above petition is approved and we have sent the original Immigrant visa petition to NVC which will forward to app consulate.

    so NVC is going to contact my beneficiary directly in foreign country?

  2. Why did you file I-824? USCIS will automatically send approved I-130 to NVC for CR-1 and IR-1 visas without you sending I-824, UNLESS you sent an I-129F for a K-3 visa.

    Note: When NVC receives the I-130, they will generate a VISA bill, and an I-864 request, they will not send the visa petition on to the consulate until the US citizen responds to these bills and other requests from NVC.

    Yes, I filed I-129F also but then decided to move with I-130, that is why I filed I-824. so what should be I waiting for? or what is next step?

    I filed I-824 almost couple of months ago to send my approved I-130 to foreign consulate, when I checked the status of my I-130 petition, it says we APPROVED this case on APRIL 16, 2008 and sent you a mail notice. But my I-130 was already approved, Does this mean they processed it to send it to National Visa Center?

    If yes, how long it will take to leave from NVC?

  4. I would wait too. We did the same thing because our attorney filed for both the I-129F & the I-130 and we were

    told we would have a choice on which petition to persue. After we learned so much more we wanted to go with the

    I-130. We were approved in 2 months but that is with an expidited request approved.

    I think if you start all over it will take you much longer than just waiting on the I-824 to be approved.

    I wanted to know how much time does I-824 takes to process, All USCIS has to do is send the approved I-130, but it seems like it takes forever, Should I just wait for it or just re-apply all over again and not file I-129F so USCIS just process I-130?

    I filed form I-824 in March.

    I think you should wait. The latest reported timeline for I-824 is two months.

    If you want an immigrant visa, don't file an I-129F for spouse.
