  1. Speaking from personal experience...

    My husband and I moved back to the U.S. after his K-1 was approved. After 10 months we petitioned to get my 2 stepkids over. It was surprisingly quick. Since the kids were listed in my husband's petition, we didn't have to deal with USCIS, we talked directly to the embassy. We got their visa in 6 weeks (we still had paperwork, doc visit, interview etc). Note that if you do not do this within 12 months of the K-1 being awarded, the kids have to wait in line with all other family member type petitions and could take years.

    Referring to your K-2 stepchildren, was the AOS process the same as your wife's (K-1)? How long did it take them to receive their green cards? How long before the stepchildren were eligible to travel? I included my wife's (K-1) son on the original I-129F application and we would like to have him join us soon, before the one year expires. My wife is concerned that he will not be able to return to visit his father in Mexico for three months while we go through the AOS process.

  2. Here in Texas my wife (K-1) needed to provide her visa with the I-94 entry stamp and the I-797 approval notice for the adjustment of status. I went to the local office first without her and talked with a receptionist to confirm what was needed. When we returned for her to start the process we had a different receptionist and this one said she wouldn't be eligible for a license. I asked to speak with a supervisor and the supervisor confirmed she was eligible for the drivers license with the documents we had with us.

  3. I received a RFE this week as well. I sent my AOS package (I-485, I-765, and I-131) on October 12 and it was received on October 20. On November 9 I received a RFE because my joint sponsor and I did not complete the I-864A correctly. I filled out what they requested and sent it off the same day I received it. I'm hoping it won't delay the advance parole (I-131)so my wife can have travel permission by Christmas. Does anyone know if it will delay the adavance parole?

  4. My fiance recently went to her medical exam in CDJ, MX prior to her visa interview and the DS-3025 she received does not show any information about her vaccinations. Does this mean she did not receive any vaccinations at her medical and must receive them before she applies for AOS? She doesn't have any record of vaccinations available so she doesn't know if she has had any that they request. From the list of the vaccinations required, will she need all of them or are some of them not necessary?

  5. I'm filing in the I-765 work authorization form for my fiance and question 16 has me confused: 16. Go to Part 2 of the Instructions, Eligibility Categories. In the space below,

    place the letter and number of the category you selected from the instructions

    (For example, (a)(8), ©(17)(iii), etc.).

    I looked over the choices but I am overwhelmed with the numbers and letters. I believe the right answer should be (a) (6) but would like a second opinion. Once we are married and I want to have as much filled out for the AOS so I can send it away as soon as possible.

  6. What you might find as you read instructions from this site and other sites, like the official government sites, there is a lot of confusion. Along with this forum I really on information such as USCIS.gov, state.gov. travel.state.gov and the website for the consulate my fiance will have her interview. Since you already have the instructions, why do bother with this forum?

  7. Sounds like your an independent contactor like myself. You'll be required to submit your income tax returns for the last three years and the "total income" is how they will determine your earnings. It would also be helpful to have who ever contracts you to write a letter stating how long you have been contracted and how long they wil continue to contract you. If your "total income" on your tax returns is not above the poverty level, you should consider a joint sponsor.
