Hi Everybody,

I have a couple of question regarding one of my friends.

She is the sponsor of her sister ( under I-130). she wanted to change the address. which for to fill AR-11 or AR- 11SR ?.

what she should write? her name ( the sponsor) or the beneficiary name?

The case status says that her I-130 documents were returned by the post office as undeliverable, and that she needs to file a new application.

My question is : Is there any solution to appeal or to solve this problem? the time frame is 180 days. but it has been now over a year.

You will be interviewed alone. If your spouse is there in the waiting area then the interviewing officer could ask her to clarify if needed.

Since your wife is not sure about the status of her ex, go in for the 'others' option. As suggested by others, she can explain the situation when asked at the interview.

She does not remember his status by the time of divorce?

You will need to check others, and put unknown.

And when you are asked at the interview let them know that your wife doesnt remember.

question G #1 Prior Spouse 's family Name ? i assume i have to write the name of my wife 's Ex husband . right ?

G:#2: Prior Spouse 's Immigration Status? i assume they refer to my wife's Ex Husband Status , right ?

You can submit the N-400 90 days before your 3 year (for spouses of USCs)/5year Green Card anniversary, and they will start processing it, but you won't be able to be sworn in until the anniversary has run.

He's not asking if he's eligible to file, since he already knows that he's eligible 90 days before the relevant GC anniversary. He's asking if USCIS will hang onto the petition during that 90 days or will start processing it.

Well at the interview we wer told that our case will be approved after some more administrative work. i knew we dont need to worry because evrything was fine with our case. it just took a bit more time to get the Card in the mail. Thank you.

I submitted my I-751 at the end of June 2011. I received my biometrics appointment letter dated 08/12/2011 in mid-August, and had to setup an info pass to get a I-551 stamp in my passport because they forgot to send me a NOA for a 1-yr extension. I had my biometics test on 09/09/2011 with ease.

Two weeks ago, I received a I-797E, Notice of Action as a RFE for my I-751. They attached a template list of items without speficifying the missing ones, so my husband and I are guessing it's probably the evidence for "joint residency". I just read some of the discussions on this forum, and realized that apparently they pick on couples who don't have kids and/or jointly-owned properties after 2 years of marriage! So, we're one of them and we've been renting the same apartment ever since I arrived.

We've already asked our leasing agency to add my name to the lease, so do we still need to explain why we didn't submit it originally?

There's a bolded line on the RFE that says:

Pursuant to 8 C.F.R. 103.2(b)(11) failure to submit ALL evidence requested at one time may result in the denial of your application.

Since the RFE doesn't specify any particular evidence, and they've enclosed a letter-sized envelope, we're wondering whether we should resend copies of all of the documents that we originally submitted?

My gut feeling tells me that a complete pack of info would help the examiner's assessment, so hopefully it'll be approved faster.

However, this means we'll have to use our own bigger envelope. Is it ok to do so?

It's been a long and frustrating process for me, so any advice will be greatly appreciated!!! Thank you all

I was in the same situation as yours,(no kids , no lease, got RFE and was called for interview) and for sure you got the RFE because of the lease or rent agreement. You can always add your name to the lease, but it has no sense because the date should cover the 2 years of mariage. what i did is the folowwing, : i sent them some mails that i and my wife received from family, friends and gouvernment administrations and we asked the owner of the property (my wife cousin) to write a letter explaining why we dont have the lease ( simply because we are a family members). The worst case that can happen is that they may call you for an interview and you wont have any problem. Best of luck, and i`ll post our interview experience soon.

So I send my RFE back last week, and it was signed for. That made me really happy, because I was worried that it might get lost with all the paperwork in it. Online it doesn't show any touches since April when I got the NOA, and I know that since then they took it under review (due to ending up with the RFE). But now I worry that they might didn't get it to the right place, to the rest of my papers that I sent back in April. Did anyone ever call to make sure it got where it belongs, or should I just chill and wait it out? I'm just scared, since they gave me until the 17th of August to send it back, and right now I could send it all again, if I knew that it didn't arrive at the right desk. Sorry, thinking to much, and specially worrying myself crazy.

I sent mine the same day as yours 07/26 and was received the same day like yours 07/28. and i havent got any news yet and no case update since NOA1 too. so it`s just a matter of time. Good luck to us and to everybody.

We are going to send just a statement from the owner and see how it`ll work, some gouvenment letters and ID Cards copies ....the worst case is an interview in the end.Thank you All.

hi brother ... im also we are also gona aplly for risedence i come by k1 visa... i told my wife to colect much evidence as we can but she said evrything will be ok ...because when you tell your wife to put you in some bills to show your names coming to same adress ... she will taught you will took her things... i really have this problem too

)... that`s funny,, i didnt have this problem with my wife, am an all her bills and contracts, just the rental we didnt have it caus the owner is her cousin, we didnt need it and we didnt think we`ll need it.

Thank you for the link:, we dont have any utility everything is included with the rent, but we have some bank checks with both our names and we pay the bills sometimes with checks.

Hi everbody ....

Just received the blue paper RFE, they want evidence for "RESIDENCE". We are renting from the cousin of my wife, and we never had an agreement just simple rent receipt which i sent with my package but maybe was not enough. We have either to re write a new rent agreement or ask the cousin to write a statement. i think a statement is better because it`s simply the truth , we never have had an agreement because we are a family.

did any of you do that and was enough?. Any suggestion?.am intending to send it back Monday.the RFE was so specific, they ask just for Residence eveidence(rent agrrement, lease, deeds, utiliy bills).
