  1. So my husband has an F-1 (opt) visa. He's been here since 2016. His opt began in 2024. We began the marriage based green card process in January 2025. He received his EAD in March. However, the green card application is still processing, but his visa is expiring in July of 2025. Should we fill out the form I-539, or is it okay to wait until the green card application processes. I understand without this form and the green card is denied he has to leave, so should we do it as precaution? Or is it necessary because his visa is expiring?
  2. It makes sense but if his income is sufficient to supporting both of us. Why can’t I take a break and finish school and then start working again? He won’t become a government liability and if something did happen I’d drop out and go back to work.
  3. Hey, I'm sponsoring my husband for his green card. I'm a US citizen. When I filed the I-864 I met the income requirement. My husband has already had his biometric appointment and received his EAD with no restrictions. He now is working and he alone meets the income requirement. Our interview has not beed scheduled yet. So my question is can I take a break from work to go back to school for my masters degree? I'm his sponsor but now he makes enough income to meet the requirement. Would there be a problem with that?

  5. My husband has his F-1 OPT visa (he’s been here 8 years already - he’s 23). We got married three months ago - I’m a US citizen. We are so confused about the process, but we want to do it ourselves because our case seems simple. please help if you can!! 1) What are all the forms we need? 2) Is there anything else we need? 3) He wants to work asap as well - is that a separate form? thanks in advance!
