You should be ok, worst case you will have to explain why the 2008 return has the maiden name on it. You can call NVC and ask them if you need to include an explain when you submit the AOS package. What name are you listing on the I-864 for your wife?

For the I-864 I'm using her new last name (my last name) of course because from now on, that's her legal name.

Hi everyone, I just have a minor situation and I hope it does not trigger any RFE-s with the NVC. When I did my tax returns this year, I filed as "Married filing jointly." At the time, I applied for the ITIN number for my wife. As you know, the IRS only accepts passports as proof of identity for the G7 ITIN number application. At that time, my wife had the old passport with her maiden last name on it. After the marriage, she took my last name. So in a way, I was "forced" to put her maiden last name in the return, otherwise I wouldn't have been able to file. She's getting the new passport right now with the new last name. Anyway, my concern is that when I submit my AOS (I-864) to the NVC, I might get an RFE because the 2008 tax transcript shows my wife's maiden name on it. Should I be worried about this? My take on this would be that the NVC does not care, all they care about is that I have paid my taxes and the I-864 is filled out correctly, but I want to hear your opinions. Please let me know if you think this might trigger an RFE.

Hi all, I filed the I-129F petition last year for my fiance in Albania and that case is officially closed (long story). Now I need to retreat an original document (police certificate from Greece), because I'm in the middle of the I-130 process and gathering all the required documents. It's really hard and expensive to get this document again from Greece, so can I call NVC or the Embassy to try to retreat the original? I reckon the embassy has returned all the paperwork to NVC by now. The police certificate does not need to be within 6 months because, last time she lived in Greece was 2004, so 5 years ago. Any ideas, please?

Hi all, I have a quick question regarding the affidavit of support. I was recently laid off from work thanks to the crumbling automotive industry here in the motorcity and I'm getting $362 per week in unemployment benefits. Does that count as income, and should I include it in my I-864 application? By the way, both my parents and I live in the same house and I'm having them fill out individual I-864A applications, so the poverty guideline will be no problem at all.

Hi, my wife took my last name after the marriage, but her passport has her maiden name in it. Does that present an issue at the interview? As far as I know, visas are given with the same last name as the one on the passport. Also, how will this affect the info on the Green Card? Will the GC have her legal last name or her maiden one? Hi, I have a question. For a misdemeanor (CIMT) committed overseas, does the U.S. embassy abroad use the U.S. Criminal Code for the equivalent offense to establish the maximum sentence possible, or do they just go by the criminal law of the foreign country? The reason why I'm asking is that it could make all the difference in the world for me trying to get the "petty offense exception." That way I would not be inadmissible. Also, the US Code makes it very very clear as to what the maximum sentence is for the equivalent crime, where as the Penal Code of the foreign country does not. Hi all, My wife is Albanian and we are currently in the middle of the I-130 process. I believe she will need a waiver because she had a shoplifting charge in Athens, Greece over 5 years ago. That is definitely considered Moral Turpitude. It involved about $50 worth of stuff. Anyway, I'm sure that's gonna show up on her Greek police certificate, she has never been in the US, never broken any US laws, and the aforementioned minor offense was her first and last.

My question is, does the gravity of the offense affect the chances of waiver approval? I mean does a person who steals a chewing gum from the grocery store have better chances of approval than one who was convicted of aggravated assault or armed robbery? Please explain.

Fiances ARE eligible for 601's. . . DOS doesn't do that, USCIS does and the consulate is wrong. Have your attorney help out. . .and/or call the dept of Consular Affairs. There are many people who have successfully proven hardship and gotten waivers approved for fiancees.

In addition, the 601 done from outside the U.S. is the only waiver you will need. . .once in the U.S. AOS will occur without a waiver.

OK, here's a question. Say I file a hardship waiver and it gets approved. By that time, the original K-1 approval will have expired, so how will my fiancee be able to get the visa?

Nita, please stop telling them to just get married and start all over again. 130's are taking forever, and these consulates are just plain wrong, and not doing their jobs correctly. If each person who gets screwed over by a crappy CO who doesn't know their job gets the problem corrected. . . then all those poor schmucks who don't find this website, and don't know any better, will stop getting screwed by crappy CO's who don't know their jobs.

Excellent post. We must fight for our rights. The consulates have ruled incorrectly many times and only a few people will fight it and get the decision overturned or corrected.

Well, the funny thing is that I spoke with the DOS today and they told me the same thing as the consular officer had told my fiancee: No hardship waiver for INA212(a)(2) unless we get married. So why is there such a huge disconnect between between DOS and USCIS. If I file the I-601 and it gets approved by the DHS overseas and then they transfer it to the consulate, will there be a contradiction, since the consulate thinks no waiver is allowed? I mean, they cannot reject it because the DHS has sole authority over waivers, right?

I think you're dead on. That makes perfect sense. Even the instructions for form I-601 by the USCIS clearly state that fiancess are eligible for waivers. I don't know why the DOS keeps insisting that that's not the case.

If admission to the USA has occured, then why would someone need a inadmissability waiver? Waivers are needed for the issuance of a visa...

Because I believe when you adjust your status, you need a waiver, otherwise you won't get approved and you will still be in the US as a nonimmigrant. So I don't know what to do.

Well, if I just go and marry her, I suppose I have to come back here and file I-130 from scratch, correct? That would take forever. And then add another 6 months on top of that for the waiver, it sucks. I was just hoping to file a fiancee waiver instead.

Ok, here's my situation. My fiancee was denied on Monday. She was found inadmissible because of a small offense in Greece 5 years ago. The consular officer told her she's not eligible for a I-601 waiver because whe is not married to a U.S. citizen. I called the DOS just now and they confirmed that no waivers are available for fiancee aliens.

On the other hand, my attorney told me that's completely bogus and wrong. Also, the instructions from USCIS on form I-601 state the following:

"Special Note to K-1 and K-2 Nonimmigrant Visa Applicants:

Because you do not yet have the requisite relationship to a citizen or lawful permanent resident of the United States to qualify for a waiver, you must enter one of the following in Block B:

If you are fiancee of a of a U.S. citizen:

- Complete items B.1, B.2, B.3, and B.5 with information regarding the U.S. citizen who filed a fiancee petition on your behalf; and

- Indicate "Prospective Spouse" in item B.4 (Relationship to Applicant)."

Therefore, fiancees are clearly eligible for hardship waivers.

You can not cancel a K-1 after the consulate has denied it, you will need to deal with the reason for denial with USCIS through the appeals process if you get a letter from USCIS.

Lawyers – Be Careful Here!

Now in many cases where a K-1 has been delayed, refused or denied at a US Consulate, lawyers have advised clients to simply get married and file and I-130. That is not good advice, unless the attorney also advises the petitioner to pay close attention to the K-1 that has been sent back to the Service Center from the consulate.

If a Service Center begins a revocation proceeding for that K-1 petition, a petitioner’s failure to respond will mean that DHS will revoke the approval of the petition. When that happens, the 212(a)(6)(c )(i) that is pending in our beneficiary file, will become hard finding of Misrepresentation, under 9 FAM 40.63 N10.1 (above).

A Rude Surprise at the Second Consular Interview

Our love birds have followed their lawyer’s advice and forgotten about the K-1 petition. A NOID (Notice of Intent to Deny) letter comes in the mail and petitioner calls his lawyer. The lawyer says,

“Don’t worry about it. She’s your wife now. The K-1 petition is irrelevant.”

The lovebirds have taken the plunge and married. The petitioner has made another costly visit to the foreign country; bought another round trip airplane ticket, and maybe he has even sprung for a costly wedding ceremony.

An I-130 Petition for his new bride has been filed. And it is approved by the DHS Service Center. What will happen when his new wife appears at the US Consulate for her next interview?

Because the petitioner did not respond to the K-1 revocation notice, the beneficiary has a 212(a)(6)(c )(i) finding on her record. Even if the petition for her is approved, she is permanently barred from entering the US, unless she can obtain a waiver to that ground of inadmissibility.

There is NO misrepresentation in this case. She was denied because of a CIMT a long time ago. The funny thing though is that they told her she can't file a waiver because she is not married to me.
