  2. Hello Everyone!

My husband has his interview in casablanca on August 5th. The packet says that his birth. cert. and police records and all of that was received and accepted by the NVC, but doe he need to get those forms again for the interview? Also it says he needs to bring a copie of my tax returns can it be copies or does it have to be the originals?

    Thank you!!

  3. HI Everyone!!!

Well we are about to have another interview for my hisbands new CR1 visa!! I am extremely excited and yet really scared. Our K1 visa was denied last year, by the oh so lovely blond woman. We have since then got married on Jan.3rd of this year and applied for a CR1 visa, my question is: is there anyway they can deny a CR1 visa, and is there anything we should be worrying about due to the last visa?

We are just trying to get past any obstacles now.

    Thanks,

    Rachid & Toree

  4. Hello!

My fiance, Rachid, had his 2nd interview on Tuesday. It did not go well, he received the optional form 194, that states:

"...Dear applicant we regret to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the following section(s) of the Immigration and Nationality Act..." Then they marked the following statement: "... Other: Your case is being returned to USCIS for further review. You will need to wait several weeks before requesting a status on your case, as it will take a number of weeks to reach the US."

    My concern is this:

I met my fiance through my mother. He is her husband's brother. I realize this totally sounds odd, but it is what it is. We went to Morocco for their wedding last year, and Rachid and I fell in love. It never dawned on any of us, that this would be questioned. We mentioned it on Rachid's applications...it is the truth...and just went from there. I also went to Morocco in July 2008 for 2 weeks on my own this time.

In both of his interview's the majority of the questions were about my mother and Said, her husband. What relevance does that have to validating our relationship?!?! The woman from hell never even looked at one of our pictures, emails, phone bill or anything! In the last interview, she even questioned Rachid about my mom and Said's age difference!! Seriously, what does that have to do with us???

I have been in contact with our local Senator's office for 3 weeks now; ever since the 1st interview. Once he heard about the 2nd interview, this was his reply:

"Toree - unfortunately this is not an uncommon occurrence. A large number of fiancé petitions are denied and returned to USCIS because of the inability of the parties to prove to the satisfaction of the interviewing officer that the marriage if valid and not for the purposes of evading immigration laws. Your case is made even more difficult because your mother and Rachid’s brother are also making application for a visa. In the eyes of an interviewing officer, it appears as if you are merely attempting to bring both brothers to the US . The only suggestion that I can make, is if you and Rachid are serious about getting married, that you get consider getting married and filing an immediate relative petition. This will help negate the perception that it is not a valid relationship.

You are correct that when a I 129F petition is returned to USCIS, and you attempt to appeal the decision of the Department of State, it can take years before it is processed. These appeals are considered to be the last priority in processing of any applications or appeals.

I can also send an inquiry to the Embassy but I’m pretty sure that the response is going to indicate that the application was denied based on the officer’s determination that the relationship was not valid and was for the purposes of evading immigration laws.

Please let me know what you would like to do next.

So, I am asking everyone out there .....what do we do next?? We were going to be married here, at the JP and then have our big wedding in the Spring 2009, but now I feel like maybe I should go to Morocco and get married. I really have no idea!

I apologize for how long this is.....but I needed everyone to know the full story, so the advice would reflect what has already been done.

  5. Hi Everyone!

Well we had our second interview today at the consulate in casablanca, they gave my fiance a form stating that they are send our k1 back to the uscis. i know that is not good. i was wondering if anyone else has gone through this and what else we need to prove to them. I could really use some advise and direction. I dont want our k1 to expire at the uscis.

    Thank you

Rachid and Toree   :crying: :crying: :crying: :crying: :crying:

  6. Hey Everyone!

So other then the fact that the consulate cant find my fiance's medical report, I called the other day and they said that he might have to have another interview!!! Which means that he wont have it until October because there are no openings for September. I am not understanding why this is all happening? We do everything and more for what the U.S requires and as soon as its time to do their part they play stupid and act like that is "normal" procedure.

Why must we prove to anyone that we love someone?! But as "Americans" we are allowed to live anywhere in the world and go anywhere in the world when ever we please. Sorry for the ranting and raving, but to be perfectly honest i am over the BS of this country and its come and go attitude.

I have waited over a year to be with the one i love and now that it is my turn to get something in return the U.S. consulate is suddenly making mistakes!!! It is like we can never catch a break!

  7. Has anyone ever had a delay on a medical report or know anything about it?

My fiance had his interview on 8/7 and all we are waiting on is his medical report to get to the consulate.

has this happened to anyone before, if so can someone let me know what the wait time is?

    Thanks,

    Toree and Rachid

  9. The consulate in Casablanca no longer requires the affidavit of support.

You won't need a cosponsor until the adjustment of status.

    HI

OK THEN WHAT WILL I NEED TO SHOW THAT I CAN SUPPORT HIM. I HAVE BANK STATEMENTS AND PAY STUBS. WHAT ELSE WILL I NEED?

    THANKS. RACHID AND TOREE
