  1. We knew that our app fell under the AWA and did not want any delays. That is the reasoning for the front-loading. We were not disputing the AWA, but wanted to prove no risk. So now the attorney feels that as we provided everything they wanted, and more, that we will reply as such. She's pretty sure that we will still get denied and then to Appeal. As you Evli1966 we hope to win the appeal. We, as you, have been at this for years and knew it would be long drawn and lots of money put out for filing fees and attorney fees, but are willing to. We have a life together and he poses no risk to me whatsoever. So, just following the law and continue.

  2. Our lawyer prepared and filed our I-130, back in 2013, and included our extensive package of

    documents, which included pysch reports, criminal reports, Affidavits, etc. Unfortunately, we just

    received our NOID. Does anyone have any experience with providing all documents from the

    beginning of Application to receive the NOID anyway? What, if anything, did you provide in your

    support in reply to the NOID?

  3. Our Appeal was filed, by our lawyer, July 2013. In March it was sent from USCIS to AAO. Just received the letter yesterday from AAO that our application and appeal are denied.

    We could not fight the AWA part, as it did fall under the Act. We provided pysch evals, letters, Affidavits, etc. It all came down to that because of those 3 cases from the summer that AAO is not able to get involved in this part of the Appeal. It is solely the discretion of the Secretary.

    Our lawyer had filed a 2nd I130 back in August, in case our Appeal was denied. Does anyone know if we have to file Adjust mentof Status forms and the EAD and AP for this new I130? I can't think that the old one would still be active if our original I130 has been denied, but again not sure.

  4. I found that here, in South Texas, every company hires through a temp agency. That way they do not have to bother with the background/security checks and they can just keep you on indefinite without having to pay insurance or benefits. The oilfield industry is crazy here so people come and go and jump from job to job as they are able to.

    I worked as a Legal Secretary for over 25 years in Canada and my office experience was what got me hired. But again, I was hired on a temporary basis and was on that pay scale for a year before they hired me full time. My boss is great, however would have preferred to have hired an American over an alien :( But hey I can and do the job to her expectations.

  5. You can go ahead 90 days prior to the expiration of your EAD to re-file. They accept it, without hesitation, and it will be renewed. However, I had problems the first time because an employee of USCIS did not understand that there are no renewal fees and rejected my documents. I had to copy THEIR instructions and resent them and they finally filed and approved my EAD/AP during the NOID and even during my Appeal.

  6. When we filed, AOS, EAD & AP, it was sent to Chicago. When we went for biometrics, 2010, it was San Antonio, Tx.

    Nothing happened besides the NOID, until this year in April 2013, when we were advised that our case was transferred

    to Vermont. So almost 3 years. Then on Monday, July 2013 we got a denial email. Still do not know what the denial

    is for tho. AWA or the AOS??? They say it's in the Notice - cannot even hire a lawyer until we know what to tell them the

    denial is for :( And they only give 30 days. So yeah, very stressful - got a lawyer lined up, if we can appeal, but if it is due

    to the AOS,no denial appeal right? Just another day in the good old USA. I could go on about our life and all our responsibilites

    about work, parents poor health, what we are needed for, etc. But what good is that. Everyone assumes that a Sex Offender

    is just that. From morning to nite, just preying on anyone and everyone :( Gawd, it just kills me that mistakes happen, people

    make mistakes and not even against little children that are so precious. But A HUNDRED YEARS FRIGGIN' later we are living

    life, have not harmed anyone, and it will definitely take away from the family unit should the visa not be approved. So sad about

    all these invisible lines around the world - where we can live - who we can marry and not worry about separating loved ones.

    Okay that's my rant :(

  7. I did not come here to get married. Met, stayed my six months allowed. Married and filed. However, the problem is I will have to repost later as this also falls under AWA. So I'm not sure if this denial is due to the fact that USCIS believes that we do not have a real marriage or if it is denied due to the reply to NOID.

    I will let everyone know what the denial says then we can all learn a little more.

  8. I just received an email of Denial. They said the Notice would explain if we had an options. I came here on a Visitor's Visa and also filed the I485. Is there an Appeal process? Or is this where we need to file a Motion to Re-Open?

    Thanks for any help.

    Also, anyone know of a good lawyer in Texas?

  9. We filed AOS I130 & I485 in June 2010. Had our appointment in August 2010. Received RFE for certified

    court documents (we had just copies). Sent in Certified Copy. Received NOID in October and they gave

    us 30 days to respond. We sent in pysch report, Affidavits, letters, Polygraph. Just this week 2.5 years

    later we got our letter transferring our case to Vermont.

    Does anyone have any idea now what??? How long before we may hear of an approval or denial? Or will they

    send us for another appointment?

    Any information would be appreciated.

  10. We married in June 2010 and filed all appropriate AOS papers. I applied for and got my EAD and SSN.

    In September we had our interview and provided court records. The IO was not aware of the AWA and

    wondered why we provided copies of court documents. We told him about the Act. He left to discuss

    with his superiors. He came back and issued us an RFE for certified court documents and biometrics.

    Very nice gentleman when we asked if he could make an appointment that afternoon for us as we were

    from out of town. He did, we did and that part of the RFE, fingerprinting was done. We provided

    certified copies of court documents with the 72 days (end of November 2010). In August 2011 we

    received NOID. Nothing online had changed since filing in June 2010. We replied before the deadline

    of September 30, 2010. Nothing since then. No update online, no letter, no approval/denial, etc.

    So I called for my AOS status last week. Got a letter today, I am in background checks. I guess

    that must be the standard reply as this app has nothing to do with me, but with my husband's criminal

    records and his app of I-130 for me.

    Anyone out here in VJ land know when we might receive any response to our NOID from August of last year?

    I did renew my EAD and Travel in July 2011, which will expire this summer.

  11. We married in June 2010. Filed I-130 & I485. Biometrics in August interview in September 2010.

    Received RFE at interview - provided Court documents by end of November. June EAD & AP renewed

    for one year (2012). NOID received September 2011 - time to reply October 2011. Provided

    Psychological Report and letter from Probation Officer. Nothing has changed online since November

    when we received NOID. Nothing saying that we received NOID, nothing that we replied to NOID or

    if it has been forwarded from our state to Vermont. Not sure if we'll get approved or denied or

    how long it will take. But as long as they don't deny us I can continue to renew my work permit,

    continue to work and live with my husband. Not great that I can't leave US and travel to see

    my family, but they can come here I guess.

  12. We married in June 2010. Applied for I-130 and the I-485. Beneficiary was issued work permit.

    Had interview in November 2010. RFE. Responded. June 2011 renewed and received workk permit.

    August 30, 2011 received NOID and had 30 days to reply. Got documents together and replied by

    September 26, 2011. How long is the wait for an approval/denial?

  13. Just to a note to say that after an email to say my card production was in process, then the next day my application was approved, a little in reverse, I received my renewed EAD Card. Thank you to all who helped me get this going in the right direction. USCIS does make mistakes and it takes time to turn it around, but thank you to visa journey members to keep us on the straight and narrow and get things done the right way.

  14. So, two months after I sent my renewal for my EAD, still nothing. USCIS erred in rejecting my documents (one month) May 20 - June 21. They acknowledged their error and advised that the scanned documents they kept would be forwarded onto the proper place for processing (June 23). Online status shows that as of July 12 NVC received my documents for processing. My work permit expires August 19. Processing times for EAD renewal is 3 months. I called yesterday and the nice operator put in an expedited request of inquiry for me. I got home, last nite, to an email saying that I am still within processing time so I cannot request an expedite.

    My question - what happens if they do not renew my work permit before my EAD expires?? The operator had indicated that she "thought" that I could attend for an info pass appointment and request an interim EAD? I have never heard of that, but then I don't know everything that USCIS has to offer.

    Has anyone ever experienced this situation?

  15. Crisis averted!!!! Received an e-mail from USCIS this morning apologizing for the error in rejecting documents.

    No payment required - I was right - Yeah thank you Visa Journey. They are sending renewed EAD and AP today for

    no fees.

    I had the package already to send on my lunch hour with the cheques (over $700). So glad they emailed me this

    morning before I put them in the mail.

  16. Yes, I supplied the I-797 (Notice of Action from the I-485). I called the help line today and they said that I was misinterpreting the renewal notice (she thinks). She said to copy the instructions I have, hi-light them, return it with my original package and the checks for renewal of my work permit and advance parole. If I am right, they will grant my application and return my $$. If I am wrong, they will grant my application and keep my money.

    What choice do I have - none, nadda, zip. So I did as she said and it'll go in the mail tomorrow with my covering letter.

    I'll let you know what happens :)

  17. We filed Ajustment of Status (I-485); EAD (I-765) and Advance Parole, all at one time, June 30, 2010.

    My docs expire August 19, 2011. I sent in a copy of my Work Permit and the Notice of Action from the

    Adjustment of Status that it was received and we paid $1010.00. I have an email to DHS.GOV, but I'm

    worried that as busy as they are they won't respond in time for me to do whatever is needed to do.

    Hmm.
