My father-in-law explained that he never appeared before a judge. Instead, his employer’s operation was raided, their property was seized, and the workers were collectively sent back to Philippines. Based on this, we believe it may be considered a deportation. Unfortunately, from my research, situations like this are not uncommon. Many migrant workers in parts of Asia and the Middle East face similar circumstances, where fraudulent or bribed paperwork produced by the employer is used for visa sponsorship and the workers are unaware of these issues until they face serious consequences. PS: Not defending the practice, but merely acknowledging the unfortunate circumstance and curious if anyone has any similar experiences with officers understanding/overlooking it

Father-in-law (64 yo Filipino) got deported from Taiwan about ~30 years ago on a work visa because the company got shutdown (unsure of the reason) and him/all his coworkers got deported. He did construction (e.g. mainly flooring) and was doing this for many companies/countries over of the course of 20 years, but this was the only time he got in trouble and it wasn't entirely his fault (though I don't know if that matters). Curious, how 'severe' of a red flag is this? I know getting a B2 visa from Philippines is already an uphill battle, but just curious, if this is the nail in the coffin for his chances or if it's still surmountable to overcome?

No one can say with any certainty other than the officer themselves, but from my research, I would guess... They failed to establish sufficient ties to their country of origin (e.g. Columbia) to an extent that the officer felt with reasonable certainty that they would return. In other words, the officer feels there is a significant risk that they would overstay their visa. Their financial background & salary would play a major part in this, but usually it can be overcame if they can establish other ties. The officer felt their primary purpose of coming to USA is to provide childcare services, which is a common red flag for grandparents coming over for young children as they tend to overstay, since the need for childcare services doesn't go away quick.

I read the https://www.visajourney.com/guides/visitor-visa/, but I am still unsure what supporting documents I should advise them to bring for establishing the financial/income requirements. For a bit of background, my wife (K-1 Visa / Pending GC Decision) wants her parents to come visit sometime in 2026, which I believe should be fine given they have ample evidence of ties to Philippines (e.g. taking care of family members, owns a home, owns multiple plots of land, etc.), no criminal background, no prior visa/immigration issues, etc. However, the problem comes in regards to financial/income requirements as they are basically retired other than some part-time selling of crops, so on paper, no income. Now I know unlike K-1 Visa, there is no actual connection to myself or even my wife in regards to the application, so no need to provide an Affidavit of Support, but realistically, we would be supporting them when they come to visit and we would be paying for all their travel costs. I'm just curious how to best go about advising them to evidence this plan or if this in itself is a huge red flag that they cannot pay for themselves.

I know relatively speaking it's still pretty early for my wife and I, but just curious, are there any escalate/inquiry timelines for an interview decision? For example, like you can only inquire/escalate after 60, 90, 120 days, type of thing. -

Yeah logically I know I shouldn't worry, especially after dealing with the inconsistency of the K-1 process, but it's just one of those things because they didn't point out anything wrong in the interview and we aren't getting an RFE. I have to assume the worst, plus it just puts a hold on my wife's and I's plans sadly. And yes we interviewed at the Atlanta USCIS field office and based on this experience, I can confirm they are quite slow 🤣 -

I know legally USCIS has up to 120 days to give a decision after AoS interview, but reading from this thread it seems like everyone got some sort of update quickly after their interview. Curious, if anyone else is sitting in the waiting boat? We have had the same status, Case Is Being Actively Reviewed By USCIS, since August 5 and it clearly states, "Our records show nothing is outstanding at this time." Our case seems pretty standard with no 'abnormal' circumstances, other than having a court wedding opposed to a ceremonial wedding. -

Apologies, I am talking about the green card. I mistakenly thought 'Green Card' was the nickname and 'Naturalization Card' was the actual name, but I meant the card you receive after being approved at the AoS interview. No, her interview is Aug 12, so I was assuming if she gets approved, then the Green Card would be sent after that. The expected/average timeline of most applicants is what I was more or less trying to find out, I know it possible range can vary greatly. In other words, do most applicants receive it within a few weeks or do most applicants receive it after a few weeks? -

By chance, does anyone know of a timeline estimate between Interview Date and receiving Naturalization Card? My wife really wants to go on an international work trip with me, which is about 1 month after the Interview Date. We booked her a refundable airline ticket as a precaution, but just curious if we are talking lottery type chance of it coming in time or if there is a reasonable chance of it coming in time. -
Filed for the AoS earlier this year w/ the EAD, but opted to not file for the AP because my wife and I decided that we didn't anticipate needing to travel for the next year, therefore it would be best to save the money than spend it for AP. Well my work decided to schedule a work trip to Mexico in September and my wife really wants to go, which based on AoS time estimates I don't think is possible, therefore I was thinking it may be worthwhile to file the AP today, but unsure how common it is for AP to be approved within 3 months of filing date. I know every case is 'different', so no definite way of knowing, but really just wanting to know if it's very common, common, uncommon, rare, or very rare. Key Dates: AoS Filed: March 24 Biometrics: Apr 21 EAD Received: May 8 SSA Appt: June 5 AoS Appt: PENDING

Has anyone received their SSN card after receiving their EAD? We received our EAD 2-3 weeks ago and still haven't received the SSN, despite selecting it in the application. -
Brief Background: My work surprised me with a Mexico work trip in September. My wife really wants to go, but we are still waiting for her AoS, which may or may not be issued in time, but assuming it is issued in time, is that enough or are there additional steps that we need to take? She's already been granted her work authorization and we didn't file for the AP at the time, since we didn't expect any need for out-of-country travel (obviously a mistake). Few concerns/ideas I have are: Pursue a Mexico tourist visa as a Filipino passport holder Concern is that her AoS was filed under her new last name, so once the green card is issued, it'll differ from her Filipino passport. Once AoS is approved, we try to get a US passport ASAP Concern is that I'm not sure if AoS approval is the sufficient for getting a US passport PS: We are doing a refundable airline ticket, since no matter what she can't leave without the AoS being approved beforehand.

Verdict: For anyone that finds this thread in the future: the facilitator (interviewer) for the CFO (GCP) DID NOT ask for the petitioner's criminal record. They did ask for evidence of our relationship though and a ton of other questions to the beneficiary (e.g. how we met, how will she get to the USA, what is our plan when gets here, etc.)
